TO PROVIDE for_the taxation of real and personal property in the Town of Savannah Beach, Tybee Island, Ga., for the fiscal year commencing May 1st, 1935, and to provide for the rate of licenses for doing business in said Town of Savannah Beach, Tybee Island, Ga., for the fiscal year end- ing April 30, 1936, and for other purposes. SECTION 1. Be it Ordained by the Mayor and Council- men of the Town of Savannah Beach, Tybee island, Ga., in Council assembled and it is hereby ordained by the authority of the same that the rate of taxation upon real estate and personal property within the limits of the said Town of Savannah beach, Tybee Island, Ga., for the fiscal year com- mencing May 1st, 1935, shall be ONE AND OB'EI QUARTER PER CENT upon the assessed or returned value of same, the value of real estate and improvements to be ascertained from the re- turns of the Committee on Assessments of said. Mayor and Coun- cilmen and the valuation of personal property to be ascertained from the returns of the owners thereof in pursuance of the scheme and plan contained in sections One, Two,.,Thratand Four of the ordinance to provide for the assessment of taxable property in the Town of Savannah Beach, Tybee Island, Ga., and the mode of valuing such property for taxation and to carry into effect the provision of the Act of the General Assembly . of the State of Georgia approved August 19, 1922, Section 21, passed in Council assembled October 13, 1922, and it is fur- ther ordained that if any person or persons should refuse or neglect to pay any tax required by this Ordinance within THIRTY (30) DAYS after same shall become due, or shall fail or refuse to pay any DOUBLE TAX assessed as above provided within THIRTY (30) DAYS after same shall become due, the Clerk of Council as Ex- officio Treasurer of said Town shall issue execution therefor and the furth sum of ONE DOLLAR 01.00) for costs, the Chief of Police and Ex- officio Tax Collector shall proceed with such execution in the same manner as now provided by the law in such cases of execution lodged with the Sjeriff - of Chatham county. SECTION 2. Be it further ordained that any property, including new improvements upon completion and installation, will become taxable after May lst, 1935, and shall be subaect to taxation from the first day of the month immediately succeeding the time when the same becomes taxable and the owner or owners shall pay such proportions of the tax required by this Ordinance as the time left for the taxable year shall bear to the whole. SECTION 3. And every person who shall pay his taxes within FIFTEEN (15) DAYS after same shall become due shall be entitled to a deduction of Ta NTY (20) PER -CENT on account, thereof, and the Clerk of Council and Ex- officio Treasurer of said Town is hereby authorized to make such deduction upon receipt of tax. The provision of this section shall not apply to licenses for doing business in said Town, the rate for such licenses being NET. 159 SECTION 4. The licenses for doing business in the Town of,Savannah Beach, Tybee Island, Ga., for the fiscal year ending April 30, 1936, payable on or before commencing of business, shall be as follows: (See Schedule.) bS0TION 5. In the event any business or calling not specifically mentioned in the above list set forth shall be established in the Town of Savannah Beach, Tybee Island, Ga., the mayor and Councilment reserve the right to establish a license fee for same by resolution, which . fee is to be of equal dignity as the licenses specifically mentioned in the above section, provided however that such licnnses shall not be less than TWO DOLLARS- FIFTY CENTS and not more than the sum of ONE HUNDRED DOLLARS. CTION 6. This ordinance shall be subject to altera- tions or repeal in whole or in part at any time during the fiscal year beginning May 1st, 1935, should it be deemed ad- visable and no such amendment or repeal shall be construed to impair the right of Council to assess or levy tax for the whole of such year whenever made. SECTION 7, All ordinances or parts of ordinances con - flicting with provisions of this ordinance are hereby re- pealed provding nevertheless that so much and such parts of ordinances passed as provided for th execution for any tax assessment, or part of tax assessment, required by such ordinance and not remaining unpaid, shall continue and re- main in force so as to authorize the Clerk of Council and Ex- officio Treasurer to issue executions and. the Chief of Police and Ex- officio Tax Collector to collect same, until taxes or assessments shall be fully paid. An urdinance to be entitled "An Ordinance to amend the ordinance adopted between the Mayor and Councilmen of the 'own of Savannah Beach, Tybee Island, Georgia upon the 161 162 day of creating the office of Chief of the Fire .Department and Captain of the Fire Department in the.fo]low- ing parts cularss. ° A- By charging the Chief of the Fire Department with the • duty of inspecting buildings now constructed or hereafter erected within the corporate limits of said Town, to insure that the same comply with the fire regulations now or here- after existing or in force within the corporate limits of said Town and to report of such inspections to the Mayor of said Town. B- By charging the Fire Chief with the duty of inspect- in&AheLinteriOr afbt ildingss or the surrouns:'li1iggs thereof so as to cause the removal of any accumulation . of trash, debris or other matter which increases the fire hazard to any building in said corporate limits. C- To make unlawful the giving or causing to be given, any false alarm of fire by telephone from street alarm boxes or otherwise. D- To give the Fire Department the right of way over traffic when responding to an alarm of fire. E"- To vest in the Mayor of said Town authorized to enforce the fire ordinances. F- To provide penalties for the infraction of any provision hereof and for any other. SECTION 1 - BE IT ORDAIN.D by the Mayor and Councilmen of Savannah Beach, Tybee Island, Georgia, in regular meeting assembled that from and after the passage of this ordinance the mire thief of said Town is hereby charged, without reference to the performance of any like duties by any other official of said Town, to personally inspect all . buildings now, or hereafter to be constructed within the corporate limits of said Town and to enter any of said buildings,at any reasonable time thereare and ascertainq whether there exists any infraction of any of the fire ordinances now, or hereafter in existence, and whether said infraction is of the construction or location of the build- ings or exists because of an- accumulation of debris or other material in or about said building, and in the event that said Fire Chief shall find any infraction he shall immediately report the same to the Mayor of said Town, who shall upon the receipt of such notice take such action as he may determine to correct the condition existing as shown by such report. SECTION 2- That it shall be unlawful from and after the passage of this ordinance for any owner and %or occupant of any building now, or hereafter, within the corporate limits of said Town to have or permit to exist within any such building or upon the premises or streets or lanes ad- jacent thereto, any material of any kind or character or accumulation thereof which exposes any building to danger from fire. 163 SECTION 3 - the mayor of said Town uopn receipt of such report from=the Fire.uhief as aforesaid, there existing an infraction of any of the fire ordinances of said Town as now in existance or which hereafterfy be adopted to notify in writing the owner and occupant of such premises, of such condition so reported and requiring said owner or occupant within forty- eight (48) hours from the receipt of the notice, from said Mayor to rectify the condition so reported and upon failure so to do the Mayor may %cause said condition to be i mediately rectified at the expense of the owner of said peoperty and the cost of such work shall be the subject matter of an execution to be issed by the Clerk of said Town and en`orced by the Chief of Police, as in the case of other execution authorized to be issued under the Charter or Ordinances of said Town. bi r. .N 4 - That from and after the passage of this ordinace it shall be unlawful for any person or persons to wilfully give or cause to be given any false alarm, either from telephone, from street alarm boxes,or otherwise, or who shall break or cause to be broken any fire signal boxes or any pole containing such said fire signal boxes, or who shall injure or in any matter interfere with the same or any part hereof or the working of the same, in- cluding any wires which may be a part of such fire alarm system. 6BL'T1ON - BE IT FURTHER ORDAINED by the authority aforesaid that the Fire Department, with its apparatus of all kinds, when ring to any fire in said Town or in respnse to any call for said department whether or not, shall have the right of way over streets, lanes, and ways of said Town to the exclusion of all persons and over all vehicles of all kinds, except those carrying United States mail and any person in or upon or having any vehi- " cle upon the streets or lanes of said Town shall on the approach of any apparatus of said department give ample room in any street, lane, or way in which said vehicle may befor the time being, until passed by said apparatus. SECTION 6 - BE IT FURTHER ORDAINED by the authority afore said that any person or persons violating any of the provisions of the foregoing ordinance shall upon conviction thereof before the Police Court of said Town be subject and liable, for each and every offense, to a fine of not more than One Hundred ($100.00) Dollars and to imprisonment not exceeding thirty days (30), either or both, or any part of either or both, at the discretion of the Court. SECTION 7 - BE IT FURTHER OR AINED that any ordinance or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. it was moved and seconded and passed that the follow- ing Ordinance be adopted; ORDINANCE, An Ordinance to entitled 14An Ordinance to establish and pro- vide rules and regulations governing the parking of automobiles and other vehicles within certain area in Savannah Beach, Tybee Idiand, Georgia; governing the use of said area by such automobiles and vehicles; to establish toll gates and toll houses at dertain designated places; to provide for the collection of fees for the use of the space provided for the parking of automobiles and other 164 vehicles; to provide for the violations of the provisions of this ordinance and for other purposes." Section 1 - Be it ordained by the Mayor and Councilmen of oavannah Beach, Tybee Island, Georgia, in regular meeting assem- bled that from and after the passage of this ordinance no auto- mobile or other vehicle shall be parked for a consecutive period of longer than thirty (30) minutes within the area bounded on the North by Fourteenth (14) street, on the South by Eighteenth (18) street, on the west by Inlet Avenue and on the East by the otrand, Savannah Beach, Tybee Island, Georgia, except however residents occupying dwellings, or tenant occupying dwellings,or those operating businesses within said area may, upon applica- tion to the Clerk of Council of said Savannah Beach, Tybee Island, ueorgia, be granted special parking permits, for automobiles and /or other vehicles, which will entitle them to park cars or other vehicles owned by such permit holder at or near their homes or places of business for an unlimited time. Upon the granting of such permit, tickets or other marks of identification shall be issued to show that the automobile or other vehicle is covered by such permit. Section 2 - De it further ordained by the authority aforesaid that operators of riotels or Rooming Houses within said area may, upon application to the Clerk of Council of said Town be furnished with' a book of tickets at a cost of ten (104 cents per ticket and such 'operator may issue such ticket, with or without consideration, to their bona fide guests only; and thereupon the holder of such ticket shall be permitted to park the car or vehicle so covered for one day within the parking area provided therefor. Section 3 - Be it further ordained by the authority aforesaid that no automobile or other vehicle shall a t any time within said area proceed at a rate of speed in excess of ten'(10) miles per hour and all officers of said Municipality are especially enjoined to see that this provision is rigidly enforced. Section 4 - it further ordained by the authority aforesaid that toll gates or toll houses shall be established at the inter- section of oixteenth (16th) street and of Fourteenth (14th) street with the strand and the officer in charge thereof shall collect the parking charge, provided for the use of the parking area as the same is now or hereafter established, from the driver of each car entering the parkway, except upon delivery to such officer of a ticket of one of the classes herein enumerated. The officer in charge of each toll house will keep an accurate record of all oath and tickets received making a detailed report and settlement to the Clerk of Council of said Municipality or to such other officer thereof that the Mayor may designate at the time or times so designated. Section 5 - Be it further ordained by the authority aforesaid that the officer in charge of each toll house shall be furnished with a cash register_ and shall immediately, upon the payment of any money or parking charge, ring up upon the register the amount so received. The cash register so provided will print receipts for payments showing date and amount. ,A receipt shall be given to every person paying a parking charge. Section 6 - Be it further ordained by the authority aforesaid that upon application to the Clerk of Council of said Town, any " person may purchase a season parking ticket which shall entitle the holder thereof to admission to the parking area of said Municipality as the same is now or which may hereafter be es- tablished, at any time during the remainder of the calendar year 1935, and shall pay therefore the sum of Five (5.00) Dollars and thereafter such parking tickets maybe obtained for each calendar year at the sum or price of Five 05.00) Dollars. Such season or annual parking ticket shall be in the form of a book of tickets, upon the outside cover of which shall be inscribed the name of the holder thereof and the make and license number of -the automobile or automobiles of the applicant or a description of the other vehicle sought t�� be covered thereat. Each time the holder of such book of tickets e;htots the parking atea he shall give the officer in charge of such area one of the. tickets. Upon the exhaustion of such tickets a new book of tickets shall be issued by the Clerk of Council of said Town without cost to the applicant. Should the holder of such book of tickets dispose of his automobile or vehicle covered thereby he may, upon application to the Clerk of Council, have changed the make and license number of the automobile or automobiles covered thereby or any other vehicle for which application is sought. Section 7 - Any person desiring to leave the parkway with the purpose of returning during the same day shall, if he expects to return without payment of another parking charge, obtain from the Officer at the toll gate or other police officer stationed on the parkway a memorandum, from the officer or officers, written upon the cash receipt previously given him, which memorandum shall indicate the license number of thecar. Section 8 - Be it further ordained by the authority aforesaid that this ordinance is cumulated of all other ordinances passed for the purpose of regulating traffic or parking of vehicles within the corporate limits of Savannah Beach, Tybee Island, Georgia or of establishing parking areas therein, and such prdinances previously past are kept of full force and effect, except where in this ordinance a contrary rule is established, in which event this ordinance shall prevail and any conflicting ordinance or part thereof is repealed. Section 9 - .3e it further ordained by the authority aforesaid that any person or persons violating any of the provisions of this ordinance governing the parking of automobiles or vehicles and the regulation of such while the area described, shall for each offense upon conviction before the Police Court of said mown, be punished by a fine not exceeding One. It was moved and seconded and passed that permission be given subject to the pleasure of Council. It was moved and seconded and passed that the Workmen's Compensation Insurance carried by the Town for a number of. years be canceled. 169 Mrs. Swann one of the school teachers at Savannah Beach petitioned that she be given housing accommodations dur- ing the school term. No action was taken on this. The owners of the Tybrisa and Breaker's Pavilion properties petitioned that they be allowed the discount on their back taxes provided same are paid not later than July 5th. It was moved and seconded and passed that the request be granted with the distinct understanding that the discount would not be granted if the taxes were not paid in full by -uly 5th. The Mayor informed Council that on several oc- cassions he had been approached by representatives of organi- zations requesting permission to use th.`a- parking areas with- out charge. After some discussion, it was moved and seconded and passed that this matter be left to the discretion of the mayor. The matter of advertising Savannah Beach for the coming season was discussed and it was estimated that for broadcasting over the radio during the summer season it would cost about TWENTY -SIR HUNDRIM DOLLARS ($2,600.00), this cost to be paid by the teveral operators, and the Town is requested yo pay ONE THOUSAND DOLLARS ($1,000.00) towards this. After some discussion it was suggested that SEVEN HUNDRED DOLLARS ($700.00) be used for radio and THREE HUNDRED DOLLARS ($300.00) for newspaper advertising making a total of ONE THOUSAND DOLLARS ($1,000.00) . On motion made and seconded and passed, the chairman of the Finance Committee was requested to appoint a Committee to handle this matter. Dr. Howard T. Exley requested that Council instruct Mr. W. J. Bryan to pay him TEN DOLLARS ($10.00) for profession- al services rendered Mr. Bryan's family and which he is unable to collect. The matter was referred to the Mayor for handling.
