three accessory buildings in the rear with a total floor area of 3,051 square feet. The
Planning Commission approved the request in a 3-2 vote.
2. On November 7, 2011, the City Council requested to review the Planning
Commission's decision because of the neighbors' concern about noise. The
neighbors complained, at time of the Planning Commission meeting, that the
existing use had generated serious noise impact on their properties. The noise
issues were associated with some evening meetings and congregations conducted
on the site. If the proposed preschool/kindergarten were to be approved, it could be
an added noise impact on the enjoyment of their properties.
3. On December 20, 2011 and at a regular meeting, the City Council reviewed the
matter through a noticed public hearing. After receiving testimonies from the public
and a subsequent discussion among the council members, the Council decided to
continue the discussion to a date certain which was set for the meeting of February
7, 2012. The Council also directed staff to collect information about the existing
noise level on the subject site and to retain the opinion of the City's traffic engineer
on the potential impact of parking and traffic that will be generated by the project.
4. On January 1 0, 12, 13, 15, and 19 of 2012, a City Community Preservation Officer
conducted site visits to the subject site. Observation on the noise level was recorded
and is summarized in the Attachment "K". In addition, the opinion of the City's traffic
engineer about the traffic impact was also received and is provided in Attachment
"L.,.
5. On January 19, 2012, notice was sent to the property owners within the 500-foot
radius of the subject site, notifying City Council's review on the case scheduled for the
meeting of February 7, 2012.
6. On January 30, 2012, the applicant submitted the revised project proposal which
included additional modifications to the original request, primarily related to hours of
operation and noise barrier options (see Attachment "1").
ANALYSIS:
The inspection conducted by city staff indicates that no excessive noise was observed
at the time of the site visit, and the opinion of the City's traffic engineer suggests that no
significant traffic impact is anticipated for the project (please refer to Attachments "K"
and "L" for details). However, the reported incidents of noise and nearby resident
concerns of potential added noise impacts from the proposed preschool/kindergarten
should be addressed in reviewing this request for a conditional use permit.
Staff recommends certain measures be incorporated as conditions of approval -the
conditions address hours of operation (the modified hours proposed by the applicant)

and sound issues that may include barrier walls (and/or hedges) along the western and
northern perimeters of the preschool/kindergarten. The most significant new conditions
recommended are to: prohibit any other activities to be conducted on the proposed
preschool/kindergarten site which includes the two buildings, the playground area, and
the parking lot of the preschool/kindergarten (see Condition 7 of Attachment G); and a
condition clearly stating the revocation power of the City should the noise generated by
the project become a significant issue in the future (see Condition 13 of Attachment G).
It should be noted that for the barrier walls (and/or hedges), there are three options
proposed to be considered below. However, in the alternate Draft Resolution
(Attachment G) staff recommends option c) as it appears to be the most effective
measure to attenuate sound (see Condition 5 in the Draft Resolution).
The three options are:
a) Plant 24-inch box Podocarpus Micro trees at a maximum of 5-foot spacing along the
western and northern perimeter walls adjacent to the preschool/kindergarten site .
The landscape and irrigation plan shall be subject to the review and approval of the
Community Development Department. The improvement shall be completed prior to
the issuance of a City's business license.
b) Install an 8-foot acoustical wall (with a landscape pattern -as proposed by the
applicant in their January 30, 2012 submittal) along the western and northern
perimeter walls adjacent to the preschooVkindergarten site, subject to a Zone
Variance approval prior to the Conditional Use Permit being valid. (The maximum
height is limited to six feet per city zoning regulation on a residential zoned lot.)
c) Install acoustical roof-type structures along the western and northern perimeter walls
adjacent to the preschool/kindergarten site. The structure shall be in substantial
compliance with the structural details shown in "Section Through Fence" (detail
3/A4) in the Site Plan submitted on January 30, 2012. Said structure will be subject
to review and approval of the city's Building and Safety Division in accordance with
Building Code regulation. If the structures are not constructed at a stand-alone
location away from the property line and are attached to the existing block fence
walls then it would be subject to a Zone Variance approval (to exceed the six foot
height limit for residential zoned lots) prior to the Conditional Use Permit being valid.
The recommended conditions are included in an Alternative Resolution as Attachment
"G" to this report . The changes from the original approved Planning Commission
Conditions are underlined. (See Conditions No. 1, 4, 5, 7, and 13; in addition, the
previous condition No. 8 is recommended to be deleted)

CONCLUSION
Based on the information provided to date, Staff recommends City Council review of
any new information or public testimony and consider approval of the attached
Resolution with the modified conditions recommended in Attachment G.

2 . On November 7, 2011, the decision was requested to be reviewed by the City
Council because of the neighbors' concern about noise. The neighbors complained,
at time of the Planning Commission meeting, that the existing use had generated
serious noise impact on their properties. The noise issues were associated with
some evening meetings and congregations conducted on the site. If the proposed
preschool/kindergarten were to be approved, it could be an added noise impact on
the enjoyment of their properties.
3. On November 9, 2011, notice was sent out to the property owners within the sao-
foot radius of the subject site , notifying City Council's review on the case scheduled
for the meeting of December 20, 2011 .
ANALYSIS:
At the October 251h Planning Commission meeting, staff had recommended approval of
the project. The recommendation was based on the land use pattern and the result of
the traffic impact assessment. Staff feels that co-locating a preschool/kindergarten with
an existing religious establishment could be a compatible use in terms of parking and
traffic concerns. Pursuant to the zoning regulation, a school is a daytime use which is a
joint use with a nighttime/Sunday use (such as a church) on the parking facilities. For
the noise issue, staff estimated that the potential impact would be concentrated in the
two short periods proposed for the outdoor activities of the school, which would be
between 10:00 am to 11 :00 am in the morning and between 3:45 pm to 4:45 pm in the
afternoon.
However, the concerns of the neighboring property owners should be addressed. In
particular, the residential properties immediately adjacent to the proposed playground
of the preschool/kindergarten may be affected by the increased noise level. Also, the
existing religious activities could be better managed to reduce the source of noise.
In balancing the legitimate interest of conducting a business in the city and the concern
coming from the neighboring residential property owners, staff recommends one or more
of the following measures, if deemed necessary:
1. Require that evening worshiping activities (other than quiet congregation activities
such as a small group bible study meeting with no amplified music) be ceased inside
the three facilities proposed for the pre-school/kindergarten.
2. Increase the height of the perimeter walls to a minimum of six feet abutting the
residential properties to the north and to the west.
3. Plant 24" box Podocarpus Micro trees along the perimeter wall at a m1mmum
spacing of 1 0 feet on center to the satisfaction of the Community Development
Director. (It should be noted that on the resubmitted site plan, the applicant also
proposes to plant trees, as a buffer of noise along the perimeter walls on the west and

on the north. Please see Section 6 of the binder packet dated December 12, 2011,
submitted by the applicant)
4. Adjust the opening hours for the business from 6:30 a.m . in the morning to a later
time of 7:30 a.m. in the morning.
5. Require that no drop~off and pick-up activities be conducted in the small parking lot
in front of the preschool/kindergarten buildings.
As a reminder, that after approval of a Conditional Use Permit the City Planning
Commission has the authority to consider revocation of the Conditional Use Permit or
imposing additional conditions, if future complaints and evidence demonstrate that the
business has caused negative impacts or violations of any conditions.
The binder packet submitted by the applicant dated December 12, 2011 (provided
under separate cover as Attachment G) includes additional information the City Council
may wish to consider such as petition signatures and other research and analysis
related to the proposed use and noise issues.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE
CITY APPROVING CONDITIONAL USE PERMIT 11-1795 TO ALLOW THE
ESTABLISHMENT OF A PRESCHOOUKINDERGARTEN AT 5537 TEMPLE CITY
BOULEVARD. THE BUSINESS WILL HAVE A MAXIMUM OF SIXTY (60)
STUDENTS AND THE AGES OF THE STUDENTS WILL RANGE FROM 2.5 TO 6
YEARS OLD. THE BUSINESS WILL OPERATE FROM 6:30 AM TO 6:30 PM,
MONDAY THROUGH FRIDAY, AND FROM 8:30 AM TO 12:30 PM ON
SATURDAYS. THE SUBJECT SITE IS ZONED HIGH DENSITY RESIDENTIAL (R-
3) AND IS DESIGNATED INSTITUTIONAL BY THE CITY'S GENERAL PLAN LAND
USE MAP. (GOLDEN APPLE CHRISTIAN ACADEMY)
The Planning Commission of the City of Temple City does hereby resolve:
SECTION 1. Based upon a public hearing for the above Conditional Use Permit,
the Planning Commission finds as follows:
1. That the site for the proposed use is adequate in size, shape, topography and
circumstances in that the subject property contains 74,490 square feet of land area
and11, 400 square feet of building area. The proposed pre-school/kindergarten will
occupy two accessory buildings with a total of 3,000 square feet floor area, which
is adequate to accommodate the proposed 60 maximum students; and
2: That the site does have sufficient access to streets, adequate in width and
pavement type to carry the quantity and quality of traffic generated by the
proposed use in that the site is on Temple City Boulevard which is .a local
thoroughfare with a 80-foot right-of-way and 64-foot roadway; adequate onsite
parking and vehicular ingress/egress are provided on the site and through the
circular driveways provided on Temple City Boulevard; and
3. That the proposed use will not have an adverse effect upon the use, enjoyment or
valuation of adjacent or neighboring properties or upon the public welfare in that
the proposed project is consistent with the land use designation of the subject site.
Parking is adequate and the traffic that will be generated by the proposed use is
not anticipated to be significant.
SECTION 2. This project is found to have no significant effects upon the
environment, and is a categorically exempt from further environmental review
pursuant to Section 15301 of CEQA .
SECTION 3. Accordingly, Conditional Use Permit 11-1795 is hereby approved
subject to the following conditions :

1 . The proposed floor plan shall be in substantial compliance with the
development plan submitted and date-stamped the 22nd of September,
2011.
2. If tenant improvement is required, the building plans shall include a blue-
line sheet(s) showing each page of this Resolution, including all conditions
of approval contained herein.
3. The patio cover within the proposed playground area shall be repaired and
maintained to comply with all current building code standards, and to the
satisfaction of the Director of the Community Development Department
and/or their designees.
4. The parking area directly in front the school facilities shall be re-striped to
City standards to the satisfaction of the Director of the Community
Development, and shall be designated as for employee parking only.
5. As indicated on the submitted plans, the business shall install a 6-foot tall
perimeter fence around the school prior to the issuance of a city business
license.
6. The business is required to comply with all relevant regulations of California
Department of Social Services and/or Fire Department governing
preschool/Kindergartens. The approved maximum number of children shall
be limited to 60, ranging from two-and-half (2 112> to six (6) years old.
However, if the maximum number of children allowed by the California
Department of Social Services and/or Fire Department is lesser than 60, the
determination of the California Department of Social Services and/or Fire
Department shall supersede the city approval and the business is required
to comply with the maximum number allowed by that corresponding agency,
but not to exceed 60 children. This approval shall not become valid until a
City business license is issued based upon the submittal of a valid State
license to operate a preschool and/or a kindergarten.
7. As indicated in the application, the hours of operation shall be Monday
through Friday, from 6:30 am to 6:30pm, and Saturdays from 8:30 am to
12:30 pm .
8. No Internet gaming shall be permitted at the subject site and all tutoring ,
educational functions and activities shall occur indoors.
9. All drop-off and pick-up of children shall be conducted in the parking lot and
an adult shall always escort pupil(s) to/from the school. No drop-off and
pick-up shall be conducted in the driveway or along the curbside on
Temple City Boulevard.

10. Preschool staff shall coordinate the drop-off and pick-up activities to ensure
the safety of the pupils. The school shall also require the cooperation of the
parents by disclosing the pertinent conditions of approval contained herein.
11. Prior to the issuance of a city business license, the applicant shall make
necessary improvement to the westerly side yard of the Classroom/Storage
building. That yard area shall be improved with proper land cover such as
landscaping and/or pavement to the satisfaction of the Community
Development Director and/or their Designees.
12. The indoor facility shall be maintained with air-conditioning and heating to
the satisfaction of the City's Building Inspector.
13. This Conditional Use Permit shall expire 24 months from the date of
approval. If the project is not commenced prior to the expiration date, the
applicant may apply in writing for an extension of time at least forty (40)
days before the expiration date.
14. All activities and functions at the site shall be subject to the City's noise
Ordinance. Any violation of the City's noise Ordinance as contained in
Sections 9280 to 9282.1 shall be grounds for revocation of this

15. Any deviation from the conditions contained herein or at the time of
business approval shall require a separate public hearing and a
modification to this Conditional Use Permit.
16. The Conditions Use Permit of Approval contained in this Resolution may
be enforced by the Sheriff's Office as well as City Staff. Any violation of
any condition is a misdemeanor and may be processed directly by
criminal complaint.
17. This Resolution shall not become valid until such time that the
applicant and property owner has signed a copy of the Resolution
acknowledging acceptance of the Conditions of Approval.

City Attorney Vega -Stated that the sentence format should be revised to reflect consistency between
conditions four and five and that the proposed hours of operation shall be corrected.

fence will be placed along the property.

she is willing to modify the parking area.

that children are scheduled to go outside in small groups for approximately one hour per group.
Chairman O'Leary -Asked if anyone from the public would like to speak in favor or against the proposed
request. Four people came forth at this time.
Stephen Morelli, 5537 Temple City Blvd"' Temple City, CA 91780-Stated as the pastor of the church, he
Is in favor of a Christian preschool that will provide Biblical education.
Kenny Rogers. 13829 Lomitas Ave., La Puente. CA 91746-Stated he is the chairman of the church, he
indicated that the parking area is larger than shown on the plans, and that revenue derived from the
preschool will be used to improve the property.
Penny Sprinkel. 9546 Wedgewood St.. Temple City CA 91780 -Stated that she is not in favor of this
request as the church currently has activities that disrupt the peace and enjoyment of the neighborhood.
Yuiang Su, 9552 Wedgewood St .. Temple City, CA 91780 -Stated that she cannot rest due to the
excessive noise from the church and that a preschool will further increase the noise level.
Chairman O'Leary -Invited the applicant to address the concerns of the public.

that she will comply with the City's noise ordinance, and ensured the public that the teachers will keep the

noise level at the church because several congregations occupy his church, and there are many small
groups that visit the church in the evening. Stated that he will speak to the small groups and
congregations in effort to reduce the noise level.
Commissioner Cordes -Asked Mr. Morelli if a lease arrangement exists that allow other organizations to
use his facility, if so noise abatement could be included in the contract.

lease agreements.
Chairman O'Leary -Asked if anyone else from the public would like to speak in favor or against the
proposed request. No one came forth at this time.

and unanimously carried.
Commissioner Cordes-Stated that children have a tendency to become noisy, however, it appears that
the church has several noise issues.
Commissioner Seibert-Stated that he does not observe any issue with the preschool, but does find the
use of the grounds to be problematic. Stated that he would like to add a condition of approval to have the
patio cover repaired and to have conditions four and five revised.
Commissioner Leung-Stated that he concurs with his fellow Commissioners, he would like to explore
noise abatement solutions.

Background:
Grace Baptist Church is a long time religious establishment in town. The institution is
located on the west side of Temple City Boulevard between Live Oak and Broadway
Avenue on a site of 7 4, 490 square feet. The site is developed with a main worship
building, a pastor's residence, and two accessory structures. The total building area on
the site is approximately 11,400 square feet. Parking is facilitated in the parking lot
along the side and behind the main worship building and there are a total of 50 stalls
including five (5) handicapped parking spaces. Vehicular access is through the two
driveways located on Temple City Boulevard which are both one-way bound design
(ingress or egress only) to direct the traffic entering the site from the northerly driveway
and exiting from the southerly driveway. The site is zoned R-3 and is designated as
Institutional by the City's General Plan Land Use Map.
The proposed project involves the two accessory buildings located in the rear of the lot
toward the westerly property line. The two structures had been utilized for the Sunday
school program of the church in the past, and are currently used for small group
assembly and religious studies. The total floor area of the two buildings is
approximately 3,000 square feet.
Proposed Development:
Golden Apple Christian Academy proposes to occupy the two accessory buildings for a
school/Kindergarten. The business will have a total of four classrooms inside the
buildings and have the adjacent open and semi-covered areas for the playground. The
business will operate from 6:30 am to 6:30 pm, Monday through Friday, and from 8:30
am to 12:30 pm on Saturdays. The proposed maximum number of students is 60 and
ages of the students will range from 2.5 years old to 6 years old. The proposed total
classroom area is 2,202 square feet and the proposed playground area is
approximately 5,000 square feet.

Pursuant to the City's Zoning Code, a preschool/kindergarten is considered an
Educational Institute which is subject to the approval of a Conditional Use Permit. In light
of the criteria of the conditional approval and after evaluating the land use and traffic
impact, staff feels that the project could be supported.
In the past experience, co-locating a child care facility or an educational institute with an
established religious institution could result in a compatible land use development. Many
religious institutions have existing facilities or rooms which are occasionally utilized. Most
weekday activities are conducted in the evening hours and the largest congregation is
expected on the weekends. Onsite parking is often adequate because zoning standards
require that parking is provided based on the size of the main assembly hall where
Sunday worship service would be conducted. Consequently, a business which sets the
operation hours around the religious activity could be a good use for those underutilized
facilities. In this case, the proposed preschool/kindergarten will operate from Monday
through Saturday, closing on Sundays when the major congregation of the church is
expected. The church has no weekday activity except for the two bi-weekly meetings
scheduled in the morning at 10:00 am on the 2nd and 41h Tuesday of each month. Onsite
parking is adequate with a total of 50 parking spaces in the parking lot. The overall
circulation pattern is optimal for diverting the traffic and the small adjacent parking lot
could be used exclusively for pick-up and drop-off of the school.
Essentially, staff feels that the facilities proposed for the school are separated from the
main worship building which would help minimizing the conflict of the two different land
uses. The project is consistent with the land use designation of the site and traffic impact
will not be significant. With the conditions stipulated in the Draft Resolution, staff could
recommend for approval of the project.
It should be noted that the applicant has requested a total of 60 students for the business.
In comparison of the occupancy standards of the Department of Social Service which is
the licensing authority of a child care facility and which requires 35 square feet indoor
space per child and 75 square feet outdoor space per child, it appears that the requested
60 maximum number of students would be in compliance. However, staff has
incorporated a condition in the Draft Resolution requiring that the business acquire the
corresponding state licenses prior to the issuance of the City's business license; and if the
determination of the Department of Social Service and/or other authorities such as the
Fire Department concludes a lower capacity based on the condition of the facilities, the
business is obligated to comply with that more stringent standard, and the maximum
number of students approved by the corresponding authority shall dictate the final
approved capacity.

SECTION 1. Based upon a public hearing for the above Conditional Use Permit,
the Planning Commission finds as follows:
1. That the site for the proposed use is adequate in size, shape, topography and
circumstances in that the subject property contains 7 4,490 square feet of land area
and11 ,400 square feet of building area. The proposed pre-school/kindergarten will
occupy two accessory buildings with a total of 3 ,000 square feet floor area, which
is adequate to accommodate the proposed 60 maximum students; and
2. That the site does have sufficient access to streets, adequate in width and
pavement type to carry the quantity and quality of traffic generated by the
proposed use in that the site is on Temple City Boulevard which is a local
thoroughfare with a 80-foot right-of-way and 64-foot roadway; adequate onsite
parking and vehicular ingress/egress are provided on the site and through the
circular driveways provided on Temple City Boulevard; and
3. That the proposed use will not have an adverse effect upon the use, enjoyment or
valuation of adjacent or neighboring properties or upon the public welfare in that
the proposed project is consistent with the land use designation of the subject site.
Parking is adequate and the traffic that will be generated by the proposed use is
not anticipated to be significant.
SECTION 2. This project is found to have no significant effects upon the
environment, and is a categorically exempt from further environmental review
pursuant to Section 15301 of CEQA.
SECTION 3. Accordingly, Conditional Use Perm it 11-1795 is hereby approved
subject to the following conditions:

1. The proposed floor plan shall be in substantial complia nce with the
development plan submitted and date-stamped the 22nct of September,
2011.
2. If tenant improvement is required, the building plans shall include a blue-
line sheet(s) showing each page of this Resolution, including all conditions
of approval contained herein.
3. As indicated on the submitted plans, the business shall install a 6-foot tall
perimeter fence around the school prior to the issuance of a city business
license.
4. The business is required to comply with all relevant regulations of California
Department of Social Services governing preschools. The approved
maximum number of children shall be limited to 60, ranging from two -and-
half {2 1/2lto six (6) years old. However, if the maximum number of children
allowed by the state and/or Fire Department is lesser than 60, the
determination of the State shall supersede the city approval and the
business is required to comply with the maximum number allowed by the
state, but not to exceed 60 children. This approval shall not become valid
until a City business license is issued based upon the submittal of a valid
State license to operate a preschool and/or kindergarten .
5. As indicated in the application, the hours of operation shall be Monday
through Friday, from 6:30 am to 6:30pm, and from 8:30 am to 12:30 pm.
6. No Internet gaming shall be permitted at the subject site and all tutoring,
educational functions and activities shall occur indoors.
7. All drop-off and pick-up of children shall be conducted in the parking lot and
an adult shall always escort pupil(s) to/from the school. No drop-off and
pick-up shall be conducted in the driveway or along the curbside on
Temple City Boulevard.
8. Preschool staff shall coord inate the drop-off and pick-up activities to ensure
the safety of the pupils. The school shall also require the cooperation of the
parents by disclosing the pertinent conditions of approval contained herein.
9. Prior to the issuance of a city business license , the applicant shall make
necessary improvement to the westerly side yard of the Classroom/Storage
building. That yard area shall be improved with proper land cover such as
landscaping and/or pavement to the satisfaction of the Community
Development Director and/or their Designees.

1 0. The indoor facility shall be maintained with air-conditioning and heating to
the satisfaction of the City's Building Inspector.
11 . This Conditional Use Permit shall expire 24 months from the date of
approval. If the project is not commenced prior to the expiration date , the
applicant may apply in writing for an extension of time at least forty (40)
days before the expiration date .
12. All activities and functions at the site shall be subject to the City's noise
Ordinance. Any violation of the City's noise Ordinance as contained in
Sections 9280 to 9282 .1 shall be grounds for revocation of this
Conditional
13. Any deviation from the conditions contained herein or at the time of
business approval shall require a separate public hearing and a
modification to this Conditional Use Permit .
14. The Conditions Use Permit of Approval contained in this Resolution may
be enforced by the Sheriff's Office as well as City Staff. Any violation of
any condition is a misdemeanor and may be processed directly by
criminal complaint.
15. This Resolution shall not become valid until such time that the
applicant and property owner has signed a copy of the Resolution
acknowledging acceptance of the Conditions of Approval.

equipments for children age 2-6, but ultimate they had to close this business due to
multiple reasons. Now, Golden Apple Christian Academy work with Grace Baptist
Church together, to make our community 's kid to get more opportunity to learn advance
and diversity age-appropriate curriculums also get better nutritional care in our preschooL
we want those working parents never have worry about their kids when they working at
daytime and put their kids in our preschool.

Our preschool located in Grace Baptist Church in Temple City, the church have .
approximate 50 parking spaces we can use during school hours, our preschool open at
6 :30am and close at 6 :30pm Monday through Friday, on Saturday, we open from 8:30am
to 12 :30pm. Since preschool open at 6:30am and class start at 9 :00am, we are not
required students come at same time as elementary students, so we planned parents can
send and pick up their kids at different time, such as 6:30am-7:30am for early group ,
and7:31am-8 :55am for later group in the morning, also the parents can pick their kids
start from 4 :30pm-5:15pm as first group, and 5:16pm-6:30pm as second group . On
Saturday, we open from 8:30am to I 2:30pm, during this operation time frame. no any
conflict between church and preschool.

The church main entrance on Temple City Blvd. with the church exit is not same
direction, the main entrance on the right side of the church, the exit on the left side of the
church, and preschool is behind the church, to ensure safety, we required all parents enter
through main entrance (the right side drive way) and exit through left side drive way.
5. TRAFFIC PATTERN:
Automobiles must enter the parking lot from Live Oak Ave. by way of the driveway next
to the church. Exit through the drive way next to the pastor house. ONE WAY
DIRECTION ONLY 6:30A.M.- 9 A.M . AND 4 :30P.M.-6:30P.M. NO STOPPING IN
TRAFFIC LANE. The parents must park their car to load or unload students. Usc parking
spaces on the north half of the parking lot. No vehicles allowed on the south half ofthe
parking lot when children drop off time and pick up time . Speed limit is 5 miles per hour
in the parking lot. NO DOUBLE PARKING. NO DOUBLE LOADING and
UNLOADING. NO DOUBLE DRIVING ON DRIVEWAY.

should be no any conflict and problems to use parking spaces between church and
preschool.

To ensure safety, we planned the parents may be dropped off the students at front gate of
the fence under their calling request and our supervision (the planned fence is 6ft height),
and also can pick them up at front gate of the fence under our supervision . Both patterns
we require the parents to sign in and sign out with their full signature on our school
signing sheet to prove the students we take over from the parents hand.

UPHOLDING THE PLANNING COMMISSION'S ACTION AND APPROVING A
REQUEST FOR CONDITIONAL USE PERMIT (CUP 11-1795) TO ALLOW THE
ESTABLISHMENT OF A PRESCHOOUKINDERGARTEN AT 5537 TEMPLE CITY
BOULEVARD. THE BUSINESS WILL HAVE A MAXIMUM OF SIXTY (60)
STUDENTS AND THE AGES OF THE STUDENTS WILL RANGE FROM TWO-
AND-HALF TO SIX YEARS OLD. THE BUSINESS WILL OPERATE FROM 6:30
AM TO 6:30PM, MONDAY THROUGH FRIDAY, AND FROM 8:30AM TO 12:30
PM ON SATURDAYS. THE SUBJECT SITE IS ZONED HIGH DENSITY
RESIDENTIAL (R-3) AND IS DESIGNATED INSTITUTIONAL BY THE CITY'S

THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff report to the City

Planning Commission minutes of October 25, 2011, and based upon a review of the plans
and testimony received at noticed public hearings before the Planning Commission on
October 25, 2011, and based upon a noticed public hearing before the City Council on
December 20, 2011 , the City Council hereby uphold the action of the Planning Commission
and approves Conditional Use Permit 11-1795 based upon the following findings:
1. That the site for the proposed use is adequate in size, shape, topography and
circumstances in that the subject property contains 74,490 square feet of land area
and11, 400 square feet of building area. The proposed pre-schooVkindergarten will
occupy two accessory buildings with a total of 3,000 square feet floor area, which is
adequate to accommodate the proposed 60 maximum students; and
2. That the site does have sufficient access to streets, adequate in width and
pavement type to carry the quantity and quality of traffic generated by the proposed
use in that the site is on Temple City Boulevard which is a local thoroughfare with a
80-foot right-of-way and 64-foot roadway; adequate onsite parking and vehicular
ingress/egress are provided on the site and through the circular driveways provided
on Temple City Boulevard; and
3 . That the proposed use will not have an adverse effect upon the use, enjoyment or
valuation of adjacent or neighboring properties or upon the public welfare in that the
proposed project is consistent with the land use designation of the subject site.
Parking is adequate and the traffic that will be generated by the proposed use is not
anticipated to be significant.
SECTION 2. This project is found to have no significant effects upon the
environment, and is a categorically exempt from further environmental review pursuant to
Section 15301 of CEQA.
SECTION 3. Accordingly, Conditional Use Permil11-1795 is hereby approved
subject to the following conditions:
1. The proposed floor plan shall be in substantial compliance with the development
plan re-submitted and date-stamped the 12th of December, 2011.

2. If tenant improvement is required, the building plans shall include a blue-line
sheet(s) showing each page of this Resolution, including all conditions of approval
contained herein.
3. The patio cover within the proposed playground area shall be repaired and
maintained to comply with all current building code standards, and to the
satisfaction of the Director of the Community Development Department and/or their
designees.
4. The parking area directly in front the school facilities shall be re-striped to City
standards to the satisfaction of the Director of the Community Development, and
shall be designated as tor employee parking only.
5. As indicated on the submitted plans, the business shall install a 6-foot tall perimeter
fence around the school prior to the issuance of a city business license.
6 . The business is required to comply with all relevant regulations of California
Department of Social Services and/or Fire Department governing
preschooVKindergartens. The approved maximum number of children shall be
limited to 60, ranging from two-and-half (2 1/2) to six (6) years old. However, if the
maximum number of children allowed by the California Department of Social
Services and/or Fire Department is lesser than 60, the determination of the
California Department of Social Services and/or Fire Department shall supersede
the city approval and the business is required to comply with the maximum number
allowed by that corresponding agency, but not to exceed 60 children. This approval
shall not become valid until a City business license is issued based upon the
submittal of a valid State license to operate a preschool and/or a kindergarten .
7. As indicated in the application, the hours of operation shall be Monday through
Friday, from 6:30am to 6:30pm, and Saturdays from 8:30am to 12:30 pm.
8. No Internet gaming shall be permitted at the subject site and all tutoring, educational
functions and activities shall occur indoors.
9. All drop-off and pick-up of children shall be conducted in the parking lot and an adult
shall always escort pupil(s) to/from the school. No drop-off and pick-up shall be
conducted in the driveway or along the curbside on Temple City Boulevard.
1 0. Preschool staff shall coordinate the drop-off and pick-up activities to ensure the
safety of the pupils. The school shall also require the cooperation of the parents by
disclosing the pertinent conditions of approval contained herein .
11 . Prior to the issuance of a city business license, the applicant shall make necessary
improvement to the westerly side yard of the Classroom/Storage building . That yard
area shall be improved with proper land cover such as landscaping and/or
pavement to the satisfaction of the Community Development Director and/or their
Designees.
12. The indoor facility shall be maintained with air-conditioning and heating to the
satisfaction of the City's Building Inspector.

13. This Conditional Use Permit shall expire 24 months from the date of approval. If the
project is not commenced prior to the expiration date, the applicant may apply in
writing for an extension of time at least forty (40} days before the expiration date.

Any violation of the City's noise Ordinance as contained in Sections 9280 to 9282.1
shall be grounds for revocation of this Conditional
15. Any deviation from the conditions contained herein or at the time of business
approval shall require a separate public hearing and a modification to this
Conditional Use Permit.
16. The Conditions Use Permit of Approval contained in this Resolution may be
enforced by the Sheriff's Office as well as City Staff. Any violation of any condition
is a misdemeanor and may be processed directly by criminal complaint.

maintained to comply with all current building code standards, and to the
satisfaction of the Director of the Community Development Department and/or
their designees.
4. The parking area directly in front the school facilities shall be re-striped to City
standards to the satisfaction of the Director of the Community Development, and
shall be designated for employee parking only. In addition. a 6-foot wall shall be
installed to enclosed the employee parking lot with an electric gate for access.
5. Install acoustical roof-type structures along the western and northern perimeters
walls adjacent to the preschool/kindergarten site . The structure shall be in
substantial compliance with the structural details shown in "Section Through
Fence" (3/A4l in the Site Plan submitted on January 30. 2012. Said structure will
be subject to the review and approval of the Building and Safety Division of the city
in accordance to the Building Code regulation. If the structures are not stand alone
away from the property line and are attached to the existing block fence walls then
it would be subject to a Zone Variance approval prior to the Conditional Use Permit
being valid .
6 . The business is required to comply with all relevant regulations of California
Department of Social Services and/or Fire Department governing
preschool/Kindergartens. The approved maximum number of children shall be
limited to 60, ranging from two-and-half (2 1/2) to six (6) years old . However, if the
maximum number of children allowed by the California Department of Social
Services and/or Fire Department is lesser than 60, the determination of the
California Department of Social Services and/or Fire Department shall supersede
the city approval and the business is required to comply with the maximum number
allowed by that corresponding agency , but not to exceed 60 children. This

approval shall not become valid until a City business license is issued based upon
the submittal of a valid State license to operate a preschool and/or a kindergarten .
7. The hours of operation of the preschool/kindergarten shall be limited to Monday
through Friday. from 7:00 a.m. to 6:00 p.m. In addition. the proposed
preschool/kindergarten facilities which includes the two buildings. the playground
area. and the parking lot of the preschool/kindergarten ("School Facilities") shall. at
all times. be used exclusively for preschool/kindergarten activities. All other
activities previously conducted at or in the School Facilities. including without
limitation musical practice. adult training or educations classes. social events. or
any other type of group activities shall be ceased after the establishment of the
preschool.
No internet gaming shall i:>e peFFAitted at the subject site and all tutoFing,

condition 8 and is recommended to be deleted)
8. All drop-off and pick-up of children shall be conducted in the parking lot and an
adult shall always escort pupil(s) to/from the school. No drop-off and pick-up shall
be conducted in the driveway or along the curbside on T ample City Boulevard.
9. Preschool staff shall coordinate the drop-off and pick-up activities to ensure the
safety of the pupils. The school shall also require the cooperation of the parents
by disclosing the pertinent conditions of approval contained herein .
10. Prior to the issuance of a city business license, the applicant shall make necessary
improvement to the westerly side yard of the Classroom/Storage building. That
yard area shall be improved with proper land cover such as landscaping and/or
pavement to the satisfaction of the Community Development Director and/or their
Designees.
11 . The indoor facility shall be maintained with air-conditioning and heating to the
satisfaction of the City's Building Inspector.
12. This Conditional Use Permit shall expire 24 months from the date of approval. If
the project is not commenced prior to the expiration date, the applicant may apply
in writing for an extension of time at least forty (40) days before the expiration date.
13. All activities and functions at or in the School Facilities shall be subject to the City's
noise Ordinance. notwithstanding any exception of school facilities in the
ordinance. Any violation of the City's noise Ordinance relating to the School
Facilities as contained in Sections 9280 to 9282.1 shall be grounds for revocation
of this Conditional Use Permit. Permittee agrees that in addition to the forgoing
grounds for revocation. the City may revoke this CUP. subject to the provisions in
Section 9230. if the noise level generated by operation or use of the School
Facilities has a demonstrable negative and significant impact on the surrounding

properties.
14. Any deviation from the conditions contained herein or at the time of business
approval shall require a separate public hearing and a modification to this
Conditional Use Permit.
15. The Conditions Use Permit of Approval contained in this Resolution may be
enforced by the Sheriff's Office as well as City Staff. Any violation of any condition
is a misdemeanor and may be processed directly by criminal complaint.
16. This Resolution shall not become valid until such time that the applicant and
property owner has signed a copy of the Resolution acknowledging acceptance of
the Conditions of Approval.

\V.: arc residents of Temple City and our homes are in the Grace Baptist Church area. We are in
agreement and would be pleased to see the Golden Apple Christian Academy choose Grace Raptist
Church lor the Christian pre-school project. We arc excited and look forward to the facility
opening in our neighborhood. There are not enough pre-schools in Temple City. Many tamilies
must travel to Arcadia and San Gabriel in order to find pre-schools for their children. The children
are on Temple City pre-school waiting lists over a year at times. We are sure this project will be
great for families and good for Temple City.

Pastor Steven Morelli Biography
Pastor Steve has been a pastor for about 35 years, spending the last 25
years at Grace Baptist Church in Temple City California. He was
presented with the Gospel of Jesus Christ at the age of 16 in North
Long Beach California at Grace Brethren Church. About a month later
at a youth rally, he came to a saving knowledge of Jesus Christ.
At Long Beach Jordan High School, Steve played football, basketball,
and baseball. He received a football scholarship to UCLA and while at
college he got away from the Lord, but believed in John 3:16 to remain
saved.
He joined the Air Force and was sent to Germany from 1972-1974. He
played football for his Air Force base team throughout Europe. He also
played and coached baseball at this time. While in Germany, he
~uttended an off-base church where he rededicated his life to Christ It
was here that he was water baptized at the age of 22.

After the Air Force service, he went to Cheyenne Wyoming
and attended Faith Baptist Church for a few years. He took classes at
several colleges including colleges in Long Beach, Casper,
andCheyenne. He received a degree in Pastoral Studies with a major in
Theology from Denver Baptist Bible College. He worked for Safeway
Grocery to support his family while attending college.
He became pastor of Faith Baptist Church in Casper Wyoming in 1977
and remained there for about 8 years. Mter this he moved to Long
Beach California. He became pastor of Grace Baptist Church in 1985.
The church at that time was called Grace Brethren Church until 1990
when it changed to its current name. The number of people attending
Grace Baptist Church have varied in number over the last 25 years
from 12 to 90 with a current population of around 60. The church has a
strong missionary outreach to help reach the world for Jesus Christ.

9283.1: VIOLATIONS AND PENALTIES:
9280: INTENT:
At certain levels, sound becomes noise and may jeopardize the health, safety or general
welfare of Temple City residents and degrade their quality of life. Pursuant to its police power,
the city council hereby declares that noise shall be regulated in the manner described herein.
This article is intended to establish citywide standards regulating noise. This article is not
intended to establish thresholds of significance for the purpose of any analysis required by
the California environmental quality act and no such thresholds are hereby established . (Ord.

9280.1: EXEMPTIONS:
Sound emanating from the following sources is exempt from the provisions of this article:
A. Facilities owned or operated by or for a governmental agency .
B. Capital improvement projects of a governmental agency.
C . The maintenance or repair of public properties.
D. Construction operation , maintenance, and repairs of equipment, apparatus, or facilities of
ttu~ parks and recreation department, public works projects, or essential public services
and facilities , including those of public utilities subject to the regulatory jurisdiction of the
California public utilities commission.
E. Public safety personnel in the course of executing their official duties, including, but not
limited to, sworn peace officers, emergency personnel and public utility personnel. This
exemption includes, without limitation, sound emanating from all equipment used by such
personnel, whether stationary or mobile.
F Public or private schools and school sponsored activities.
G. Private construction projects located one.fourth C/4) of a mile or more from an inhabited
dwelling.
H. Private construction projects located within one-fourth Ct4 ) of a mile from an inhabited
dwelling, provided that construction does not occur between the hours of seven o'clock
(7 :00) P.M. and seven o'clock (7:00) A .M .
I. Property maintenance, including, but not limited to, the operation of lawn mowers, leaf
blowers , etc., provided such maintenance occurs between the hours of seven o'clock
(7:00) A.M. and seven o'clock (7:00} P .M .
J. Motor vehicles , other than off highway vehicles. This exemption does not include sound
emanating from motor vehicle sound systems.
K. Heating and air conditioning equipment.
L. Safety, warning and alarm devices, including, but not limited to, house and car alarms,
and other warning devices that are designed to protect the public health, safety, and
welfare.
M . The discharge of firearms consistent with all state and federal laws.
N. Any activity as to which the city council or planning commission has issued an exception
based on hardship, or to execute phase-in requirements.
0 . Involuntary noise.
P. Isolated singular noises (not exceeding 2 seconds) not repeated within sixty (60) minutes .
Q. Matters preempted by state or federal law.
R. Matters involving the reasonable exercise of constitutional guarantees unless outweighed
by compelling governmental interests or appropriate exercise of the police power.
S. "Emergency work" as defined under section 9280.2 of this article.
T. Noise as to which there is specific consent from all affected persons. (Ord. 08-920)
9280.2: DEFINITIONS:
As used in this article, the following terms shall have the following meanings:
AUDIO EQUIPMENT: A television, stereo, radio, tape player, compact disc player, MP3
player, iPod or other similar device.
DECIBEL (dB): A unit for measuring the relative amplitude of a sound equal approximately to
the smallest difference normally detectable by the human ear, the range of which includes
approximately one hundred thirty (130) decibels on a scale beginning with zero decibels for
the faintest detectable sound . Decibels are measured with a sound level meter using
different methodologies as defined below:
A-Weighting (dBA): The standard A-weighted frequency response of a sound level meter,
which de-emphasizes low and high frequencies of sound in a manner similar to the human
ear for moderate sounds.
Maximum Sound Level (Lmax): The maximum sound level measured on a sound level
meter
EMERGENCY WORK: Work made necessary to restore property to a safe condition
following a public calamity, or work required to protect persons or property from an imminent
exposure to danger or work by public or private utility to restore utility service.
GOVERNMENTAL AGENCY: The United States, the state of California, the county of Los
Angeles, the city of Temple City or any combination of these agencies.
MOTOR VEHICLE: A vehicle that is self-propelled.
MOTOR VEHICLE SOUND SYSTEM: A stereo, radio, tape player, compact disc player, MP3
player, iPod or other similar device.
NOISE: Any loud, discordant or disagreeable sound.
OCCUPIED PROPERTY: Property upon which is located a residence, business or industrial
or manufacturing use.
OFF HIGHWAY VEHICLE: A motor vehicle designed to travel over any terrain.
PUBLIC OR PRIVATE SCHOOL: An institution conducting academic instruction at the
preschool, elementary school, junior high school , high school, or college level.
PUBLIC PROPERTY: Property owned by a governmental agency or held open to the public,
including, but not limited to, parks, streets, sidewalks, and alleys.
SENSITIVE RECEPTOR: A land use that is identified as sensitive to noise, including, but not
limited to, residences, schools, hospitals, churches, rest homes, cemeteries or public
libraries.
SOUND AMPLIFYING EQUIPMENT: A loudspeaker, microphone, megaphone or other
similar device.
SOUND LEVEL METER: An instrument meeting the standards of the American National
Standards Institute for type 1 or type 2 sound level meters or an instrument that provides
equival_ent data . (Ord. 08-920}
9281: GENERAL SOUND LEVEL STANDARDS:
No person shall create any sound, or allow the creation of any sound, on any property that
causes the exterior sound level on any other occupied property to exceed the sound level
standards set forth by the following standards :

At the boundary line between two (2) of the above zones, the noise level of the quieter zone

9281.1: SOUND LEVEL MEASUREMENT METHODOLOGY:
Sound level measurements may be made anywhere within the boundaries of an occupied
property. The actual location of a sound level measurement shall be at the discretion of the
enforcement officials identified in section 9282 of this article. Sound level measurements
shall be made with a sound level meter. Immediately before a measurement is made, the
sound level meter shall be calibrated utilizing an acoustical calibrator meeting the standards
of the American National Standards Institute. Following a sound level measurement, the
calibration of the sound level meter shall be reverified . Sound level meters and calibration
equipment shall be certified annually. (Ord . 08-920)
9281.2: SPECIAL SOUND SOURCES STANDARDS:
The general sound level standards set forth in section 9281 of this article apply to sound
emanating from all sources, including the following special sound sources, and the person
creating, or allowing the creation of, the sound is subject to the requirements of that section.
The following special sound sources are also subject to the following additional standards,
the failure to comply with which constitute separate violations of this article.
A Motor Vehicles:
1. Off Highway Vehicles:
a . No person shall operate an off highway vehicle unless it is equipped with a USDA qualified
spark arrester and a constantly operating and properly maintained muffler. A muffler is not
considered constantly operating and properly maintained if it is equipped with a cutout,
bypass or similar device.
b. No person shall operate an off highway vehicle unless the noise emitted by the vehicle is not
more t~an ninety six (96) dBA if the vehicle was manufactured on or after January 1, 1986,
or is not more than one hundred one (101) dBA if the vehicle was manufactured before
January 1, 1986. For purposes of this subsection, emitted noise shall be measured a
distance of twenty inches (20") from the vehicle tailpipe using test procedures established by
the Society of Automotive Engineers under standard J-1287.
2. Sound Systems: No person shall operate a motor vehicle sound system, whether affixed to
the vehicle or not, between the hours often o'clock (10:00) P.M . and seven o'clock (7:00)
A.M., such that the sound system is audible to the human ear inside any inhabited dwelling.
No person shall operate a motor vehicle sound system, whether affixed to the vehicle or not,
at any other time such that the sound system i s audible to the human ear at a distance
greater than one hundred feet (1 00') from the vehicle.
B. Power Tools And Equipment: No person shall operate any power tools or equipment
between the hours of ten o'clock (10:00) P.M. and seven o'clock (7 :00) A.M. such that
the power tools or equipment are audible to the human ear inside an inhabited dwelling
other than a dwelling in which the power tools or equipment may be located. No person
shall operate any power tools or equipment at any other time such that the power tools or
equipment are audible to the human ear at a distance greater than one hundred feet
(100') from the power tools or equipment.
C. Audio Equipment No person shall operate any audio equipment, whether portable or not,
between the hours of ten o'clock (10:00) P.M . and seven o'clock (7:00) A.M . such that
the equipment is audible to the human ear inside an inhabited dwelling other than a
dwelling in which the equipment may be located . No person shall operate any audio
equipment, whether portable or not, at any other time such that the equipment is audible
to the human ear at a distance greater than one hundred feet (1 00') from the equipment.
D . Sound Amplifying Equipment And Live Music: No person shall install, use or operate
sound amplifying equipment, or perform, or allow to be perfonned, live music unless
such activities comply with the following requirements. To the extent that these
requirements conflict with any conditions of approval attached to an underlying land use
permit, these requirements shall control.
1. Sound amplifying equipment or live music is prohibited between the hours of ten o'clock
(10:00) P.M. and seven o'clock (7:00) A.M. and sound emanating from sound amplifying
equipment or l ive music at any other time shall not be audible to the human ear at a distance
greater than two hundred feet (200') from the equipment or music.
2 . The use of sound amplifying equipment or live music in a condominium complex which
exceeds the noise limits as set forth in section 9281 of this article , measured at any property
line, or, measured in another condominium unit within the complex, shall be in violation of

9282: ENFORCEMENT:
City of Temple City code enforcement personnel and the Los Angeles County sheriff shall
have the primary responsibility for enforcing this article; provided, however, code
enforcement personnel and the sheriff may be assisted by the public health department.
Violations shall be prosecuted as described in section 9283.1 of this arti cle, but nothing in
this article shall prevent the sheriff, code enforcement or the department of public health from

engaging in efforts to obtain voluntary compliance by means of warnings, notices, or

9283: DUTY TO COOPERATE:
No person shall refuse to cooperate with, or obstruct, the enforcement officials identified in
section 9282 of this article when they are engaged in the process of enforcing the provisions
of this article. This duty to cooperate may require a person to extinguish a sound source so
that it can be detennined whether sound emanating from the source violates the provisions

9283.1: VIOLATIONS AND PENAL TIES:
Any person who violates any provision of this article once or twice within a one hundred
eighty (180) day period shall be guilty of an infraction. Any person who violates any provision
of this article more than twice within a one hundred eighty (180) day period shall be guilty of
a misdemeanor. Each day a violation is committed or permitted to continue shall constitute a
separate offense and shall be punishable as such. Penalties shall not exceed the following
amounts:
A. For the first violation within a one hundred eighty (180) day period the minimum
mandatory fine shall be five hundred dollars ($500.00).
B. For the second violation within a one hundred eighty (180) day period the minimum
mandatory fine shall be seven hundred fifty dollars ($750 .00).
C . For any further violations within a one hundred eighty (180) day period the minimum
mandatory fine shall be one thousand dollars ($1 ,000.00) or imprisonment in the county
jail for a period not exceeding six (6) months, or both. (Ord . 08-920)
