RESOLUTION NO. 01-067
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON,
CALIFORNIA DELINEATING CERTAIN LOCATIONS FOR THE INSTALLATION
AND OPERATION OF PIPELINES OR OTHER FACILITIES IN CONNECTION WITH
A NONPUBLIC UTILITY PIPELINE FRANCHISE AWARDED TO
AIR PRODUCTS & CHEMICALS, INC.
The City Council of the City of Carson hereby finds and resolves:
Section 1. Recitals.
A. The City Council granted a nonpublic utility pipeline franchise-. to .Air
Products & Chemicals, Inc. (hereinafter referred to as "the Franchisee"), a Delaware
corporation, by adoption of Ordinance No. 99-1157.
B. Ordinance No. 99-1157 provides that the Franchisee may, as approved
from time to time by Resolution of the City Council, lay or construct from time -to time,
and may maintain, operate, renew, repair, change the size of, remove or abandon in
place pipes and pipelines for the collection, transportation or distribution of industrial
gases together with all manholes, valves, appurtenances and service connections
necessary or convenient for the operation of such pipes or pipelines including conduits,
cathodic protection devices, wires, cables and other appurtenances necessary or
convenient for the exercise of the Franchisee's business, in, under, along or across any
and all streets within the City of Carson.
C. The City Council previously authorized the Franchisee to install and
operate pipelines and other facilities in connection with Ordinance No. 99-1157 by
adoption of Resolution Nos. 99-010 and 00-122.
D. Due to objections by Caltrans, some of the Franchisee's pipelines
authorized by Resolution No. 00-122 will need to be rerouted and 620 additional feet of
pipeline will need to be installed within 223`d Street.
Section 2. Location of Pipeline. The City Council finds that the public
interest would be served by allowing the installation and operation of pipelines and
appurtenant facilities limited to those certain streets, highways, roads, alleys and other
public places dedicated to public use shown on the map attached hereto as Exhibit "A"
and legally described as set forth in Exhibit "B" attached hereto. Exhibit "A" and

Exhibit "B" are incorporated herein by reference. The City Council intends that the
pipeline footage authorized herein include that footage specified in Resolution No. 00-
122 as well as the additional 620 feet for the rerouting made necessary by Caltrans.
Section 3. CEQA Findings.
A. On September 1, 1994, following a duly noticed public hearing, a
supplemental environmental impact report ("SEIR") was certified for the Ultramar Inc.
Wilmington Refinery Reformulated Fuels Program (SCH No. 92111042). The
environmental findings required by the California Environmental Quality Act are set forth
in the Notice of Determination prepared by the South Coast Air Quality Management
District (SCAQMD) and are hereby incorporated by reference.
B. On September 19, 2000, by adoption of Resolution No. 00-122, the City
Council approved an addendum to the SEIR ("the Addendum").
C. The SEIR contemplated the construction of the Wilmington hydrogen plant
as well as associated pipelines, including a hydrogen pipeline from Wilmington to
Torrance, California. The hydrogen plant was built in Wilmington and began
commercial operation in 1996. In 1998, the City of Carson prepared a final
environmental impact report for the Carson Hydrogen Facility and Specialty Gas Facility
(SCH No. 97071078) as well as associated pipelines, including a tie-in to an existing 6-
inch hydrogen pipeline that runs from the Wilmington facility towards Carson. The
hydrogen plant was built in Carson and began commercial operation in 1999. The
Franchisee seeks to complete the hydrogen pipeline evaluated in the SEIR to provide a
connection to the Mobil Refinery located in Torrance.
D. Based upon the record before the City Council, including the Addendum,
the Initial Study of the environmental impacts prepared in connection with the pipeline
franchise, and the findings set forth above, the City Council hereby finds and
determines that neither a Subsequent EIR, Supplemental EIR, nor further environmental
review is required for the pipeline franchise pursuant to Public Resources Code Section
21166, 14 Cal. Admin. Code Section 15162 or 15163 based upon the following findings:
1. The elements of the project were contemplated and fully and
properly analyzed in the SEIR certified and approved by SCAQMD on September 1,
1994.
2. There have been no subsequent changes to the project since
August, 1994 which require major revisions of the SEIR due to the involvement of new
significant environmental effects or a substantial increase in the severity of previously
identified significant effects.
3. Substantial changes have not occurred with respect to the
circumstances under which the project is undertaken which will require major revisions

of the previous SEIR due to the involvement of new significant environmental effects or
a substantial increase in the severity of previously identified significant effects.
4. There is no new significant information since the certification of the
SEIR which would show or tend to show that the project might have one or more
significant effects not discussed in the SEIR.
5. There is no new information since the certification of the SEIR
which would show or tend to show that significant effects previously examined might be
substantially more severe than shown in the SEIR.
6. There is no new information since the certification of the SEIR
which would show or tend to show that mitigation measures or alternatives previously
found not to be feasible would in fact be feasible and would substantially reduce one or
more significant effects of the project.
7. There is no new significant information since the certification of the
SEIR which would show or tend to show that mitigation measures or alternatives which
are considerably different from those analyzed in the SEIR would substantially reduce
one or more significant effects on the environment.
E. The above determinations represent the independent judgment of the City
Council.

Section 4. Approval of Installation. The installation and operation of
pipelines as nonpublic utility pipelines is approved within the limitation stated in Section
2 above. Such pipelines shall be in addition to, and not in lieu of, the pipelines
authorized by Resolution Nos. 99-010 and 00-122.
