Mayor Chavez called the City Council Regular Meeting to order at 7:31 p .m. in the Council Chambers located at 5938 Kauffman Avenue , Temple City. 2. ROLL CALL PRESENT : Councilmember-Bium, Sternquist, Vizcarra, Yu, Chavez ABSENT: Councilmember-None ALSO PRESENT: City Manager Pulido, City Attorney Vail, Public Safety Officer Ariizumi, Parks & Recreation Director Burroughs, City Clerk Flandrick, Associate Planner Gulick , Community Development Director Masura , Community Services Specialist Rodriguez , Community Preservation Supervisor Sahagun 3. INVOCATION Councilmember Carl Blum provided the Invocation . 4. PLEDGE OF ALLEGIANCE Mayor Tom Chavez led those present in the Pledge of Allegiance to the Flag . 5. CEREMONIAL MATTERS -PRESENTATIONS A. INTRODUCTION OF COUNTY ASSESSOR JOHN NOGUEZ County Assessor staff members Carol Quan and Robert Meraz introduced themselves to Council and provided information regarding property valuation and taxes, and windstorm damage refunds. B. DEPUTY OF THE YEAR-2011 Captain Chris Nee introduced Deputy Paul Han , Deputy of the Year for 2011 . Mayor Chavez and the City Council congratulated Deputy Han and presented him with a Certificate of Recognition . City Council Minutes February 21, 2012 Page 2 C. FIREFIGHTER OF THE YEAR-2011 Battalion Chief Jeff Kaliher introduced Firefighter Paramedic Brian Davy, Firefighter of the Year for 2011 . Mayor Chavez and the City Council congratulated Firefighter Davy and presented him with a Certificate of Recognition . D. RECOGNITION OF ASSISTANT FIRE CHIEF NICHOLAS DUVALL Y E. This presentation was continued to the City Council meeting of March 6 , 2012. PRESENTATION ANNIVERSARY SENIOR LUNCH PROGRAM ONE YEAR Community Service Specialist Rodriguez presented a power point presentation, providing background information on the Senior Lunch Program's successful first year, and detailing its rising attendance and special holiday celebrations . Don Herring, of YWCA San Gabriel Valley -Intervale Senior Services, recognized that the success of the program was due to the commitment of the City and its desire to have a good senior meal program . Councilmember Sternquist thanked Council for supporting this program and also coming out to share with the senior meal attendees . She also acknowledged the many volunteers and staff for their contributions to the success of the program . 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Mary Kokayko, Temple City resident, suggested the City have a plaque honoring those people who volunteered funds to build the bandstand. She also wished to have information on the following : where is the money going from Applebees' loan payments; what is the City going to do with the Primrose property, what amount of rents are collected, and what does it cost to maintain; who owns the easements on Myda behind the Gateway project; and what is happening with the Bender property. Jerry Jambazian, Temple City businessman, read a statement endorsing the selection of Tom Chavez to serve another year as Mayor at the upcoming Council reorganization meeting . He reiterated the accomplishments of Mayor Chavez this past year in concert with the Council, as will be expressed in the Mayor's State of the City address, and asked Council to consider re-appointing Mayor Chavez for another year's term . APPROVAL OF MINUTES Approved the Minutes of the City Council Regular Meeting of February 7, 2012, as presented. B. PUBLIC SAFETY COMMISSION ACTIONS -MEETING OF FEBRUARY 8 , 2012 Received and filed the Public Safety Commission actions of their meeting of February 8, 2012 . D. RELEASE OF GRADING SECURITY FOR PARCEL MAP NO . 66880 AT 4851 AND 4853 HELEO AVENUE Authorized release of a grading security bond. in the amount of $11,000.00, upon completion of grading improvements on the private property at 4851 and 4853 Heleo Avenue, Parcel Map No . 66880. E. PETTY CASH AND VISA CARD REPORTS Received and filed the Petty Cash and Visa Card Reports. G. AMENDMENT OF LEASE AGREEMENT FOR 5934 PRIMROSE AVENUE 1) Approved the Second Amendment to the Monthly Rental Agreement with Elizabeth Howard , tenant at 5934 Primrose Avenue ; and City Council Minutes February 21,2012 Page4 2) Approved a permanent rent reduction of monthly rent from one thousand two hundred fifty dollars ($1 ,350.00) to eight hundred fifty dollars ($850 .00) commencing September 1, 2011. H . ADOPTION OF RESOLUTION NO. 12-4798-APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. 12-4798, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $380,661 .21 DEMAND NOS . 33764 THROUGH 33843 . I. SECOND QUARTER TREASURER'S REPORT, REVENUE AND EXPENDITURE SUMMARY REPORTS AND CAPITAL IMPROVEMENT FINANCIAL REPORT Received and filed the Second Quarter City Treasurer's Report, Revenue and Expenditure Summary Reports and the Capital Improvement Financial Report. J. SECOND QUARTER BUDGET AMENDMENTS Approved the second quarter budget amendments and amended the adopted budget accordingly . C. AUTHORIZATION TO TEMPORARILY HANG BLUE STAR BANNERS ON LAS TUNAS DRIVE BETWEEN ROWLAND AND LOMA Parks and Recreation Director Burroughs summarized her staff report , stating Staff is requesting City Council authorization to temporarily re -hang Blue Star Banners on City owned poles on Las Tunas Drive between Rowland and Lorna until such time as a policy or ordinance is approved by the Council regulating use of City-owned poles for display purposes . Background information was provided on the banner program which was initiated in 2004 for hanging banners on light poles along Las Tunas Drive. The 2011 windstorm damaged dozens of Blue Star Banners and representatives from the Blue Star Banner program have requested the City re-hang the banners along Las Tunas Drive prior to the 2012 Camellia Festival . During the windstorm assessment, it was determined that many of the poles currently being used for Blue Star Banners were not owned by the City, but rather Southern California Edison (SCE) or the County of Las Angeles . As the City does not have an agreement with either SCE or the County authorizing use of their poles for this purpose, the City Prosecutor and Code Amendment ad hoc committee have been working on developing an ordinance regulating use of City poles for City Council Minutes February 21, 2012 Page 5 displays and advertising . Staff has surveyed the poles and banners on Las Tunas Drive and estimated that 50 banners could be re-hung. Staff is further suggesting that an agreement or conditions for use of City poles be negotiated with the Blue Star Program after an ordinance regulating the use of City owned poles has been considered by the Council. Sharon Johnson, represented the Blue Star Program, indicated in speaking with the Planning department of SCE, that she was assured that other cities using SCE poles do not have agreements. She requested the City re-hang the banners so that all service members of the community are recognized. Council discussed this issue and Ms. Johnson and staff responded to questions. Community Preservation Supervisor Sahagun reported on information relayed to the City by SCE and County crews during the windstorm cleanup stating that many of the poles used to hang the banners were not owned by the City. This information led to the City Prosecutor's Office recommending an amendment to the code covering this practice . Frank Ruedel, Temple City resident, said he understood this is a temporary fix and that the City wished to operate by a code , but these are humans we are dealing with and you have to take that into account in consideration of their lives and what they are dealing with serving in the military. Councilmember Blum moved to authorize staff to re-hang Blue Star Banners on City owned poles on Las Tunas Drive between Rowland Avenue and Lorna Avenue prior to the 2012 Camellia Festival, seconded by Mayor Pro Tern Yu and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: ABSTAIN : Councilmember-Bium, Sternquist, Vizcarra, Yu, Chavez Councilmember-None Councilmember-None Council member -None F. APPROVAL OF AN EMPLOYMENT AGREEMENT FOR THE ADMINISTRATIVE SERVICES DIRECTOR City Manager Pulido stated during the last budget process for Fiscal Year (FY) 2011-12, and as recommended by the Budget Ad Hoc Committee, the Council approved a reorganization which merged Finance, Personnel and Information Technology into a new Administrative Services Department. At that time, the Council also approved a salary range for the newly created position of Administrative Services Director. At the end of City Council M inutes February 21, 2012 Page 6 December 2011 , the Council adopted a resolution requmng all new employees hired on or after January 1, 2012 to pay the full 8% member contribution to CaiPERS. The position was advertised in all national magazines in an extensive recruitment and was extended to December 30, 2011 to obtain a more qualified applicant pool. Seven applicants were selected for a first interview before a panel of outside experts , and a second round of interviews with the City Manager was held for the top three candidates. The selected applicant overwhelmingly scored very high and is experienced in Finance and Administrative Services positions . City Manager Pulido responded to Council's questions. Matthew Wong, Temple City resident, asked Council to vote no on this item and direct the City Manager to renegotiate the agreement. He felt the salary of $146,000 per year was too high as it would be the second highest paid position after the City Manager, and $25,000 more than other management positions . He questioned paying this much for an Administrative Services Director in this economic climate and provided salary survey information of comparable positions in neighboring cities which indicated lower salaries. Frank Ruedel, Temple City resident , felt the City Manager was trying to save the City money by combining three positions into one, and if he can do that, he is doing a great job. City Manager Pulido stated it is important to consider that this position requires three different areas of expertise. In preparation of the budget, this was presented to the ad hoc committee and the salary was already factored into the budget. In a salary comparison of other cities, this is relatively low in order to get someone to achieve the high performance team that Council wanted. Council discussed the item and staff addressed questions as needed . Councilmember Blum moved to : 1) approve an at-will Employment Agreement for the Administrative Services Director position ; and 2) authorize the City Manager to execute the agreement on behalf of the City. The motion failed for lack of a second. City Council Minutes February 21, 2012 Page 7 Council discussion continued . City Attorney Vail advised Council as to the powers delegated to the City Manager by the City Council in regard to hiring personnel, and those issues that were under Council's purview. UNFINISHED BUSINESS-None 9. NEW BUSINESS A. CONTINUED PUBLIC HEARING : APPROPRIATION OF SUPPLEMENTAL LAW ENFORCEMENT SERVICES ACCOUNT (SLESA) FUNDS FOR THE CITIZENS' OPTION FOR PUBLIC SAFETY (COPS) PROGRAM Public Safety Officer Ariizumi provided background information on the Citizens' Option for Public Safety (COPS) program and its funding through the Supplemental Law Enforcement Services Account (SLESA). The COPS grant is a non-competitive state grant that provides cities with annual funding to supplement their front line law enforcement services . On December 15, 2011, the City was notified by the County that it will receive $100,000 from the SLESA for the COPS program . Beginning with Fiscal Year (FY) 2010-11, the funds were used to partially fund one motorcycle City Council M inutes February 21 ,2012 Page 8 traffic enforcement deputy. City and Sheriffs Department personnel met and recommended that funds in the amount of $75,000 be expended for the addition of a third dedicated deputy position for the remaining five months of FY 2011-12 and the amount of $25,000 be used for specialized overtime at the City's direction . The Sheriffs Department will provide the City the dedicated deputy position at a reduced grant rate of $173,612 per year, compared to the regular rate of $226,416 because grant funds are being used to fully fund the position for the remainder of FY 2011-12 . A budget amendment in the amount of $100,000 was requested to reflect an increase in revenue for funds received from the COPS grant, and a budget amendment for expenditures in the amount of $75,000 for the addition of a third dedicated deputy position and in the amount of $25,000 for the specialized overtime. The status of the COPS grant for FY 2012-13 is unknown at this time . If the COPS grant in unavailable for FY 2012-13 , the City Council could eliminate the position or fully fund the position at the regular rate with General Funds or other eligible specialized funds . Mayor Chavez opened the public hearing. Hearing no requests to speak, either for or against this item , the public hearing was closed . Mayor Pro Tem Yu moved to approve the budget amendment and expenditure of funds for the dedicated deputy position and specialized overtime, seconded by Councilmember Sternquist and unanimously carried by the following roll call vote : AYES : NOES: ABSENT: ABSTAIN : Councilmember-Bium, Sternquist, Vizcarra , Yu, Chavez Councilmember-None Councilmember-None Councilmember-None B. PUBLIC HEARING : APPROVAL OF TENTATIVE TRACT MAP 71395 AND CONDITIONAL USE PERMIT 11-1793 FOR THE CONSTRUCTION OF SIX (6) CONDOMINIUMS AT 5416-5420 WELLAND AVENUE (BADE CONSTRUCTION/GILBERT ENGINEERING) The City Council was requested to approve an application to allow the development of a residential condominium project consisting of six dwelling units for property located at 5416-5420 Weiland Avenue . Associate Planner Gulick presented his staff report, stating the Plann ing Commission heard this item on January 24 , 2012 and recommended the City Council consider adopting a resolution approving a Negative City Council Minutes February 21,2012 Page 9 Declaration and approve Tentative Tract Map 71395 and Conditional Use Permit 11-1793. Background information was provided as well as a short visual presentation . Staff responded to Council 's questions, and City Attorney Vail advised of Council's discretion in meeting affirmative findings and/or adding additional conditions of approval. The project is consistent with the land use designation, zoning, and design review standards of the City. The site is zoned R-2 with a land area of approximately 24,300 square feet. The proposed density is 12 units per acre, with is consistent with that allowed by the General Plan . The subject site is of sufficient size to accommodate the proposed six dwelling units and will provide adequate off-street parking. The total building area is 12,043 square feet. Mayor Chavez opened the public hearing. Susan Bade Hull, Bade Construction Co., property owner and applicant , showed a picture of their recently built project on Farago and stated that the project complied will all city and county regulations . Ousama Nimri, Temple City resident, asked if the development would increase the water flow on Weiland. Ms . Hull responded that the development had complied with all regulations . Community Development Director Masura confirmed that there is no increase in runoff because measures have been included to capture the runoff on site. Hearing no further requests to speak, either for or against this item, the public hearing was closed. Councilmember Blum moved to: 1) approve the Negative Declaration; and 2) adopt Resolution No . 12-4792, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING TENTATIVE TRACT MAP 71395 AND CONDITIONAL USE PERMIT 11-1793 TO ALLOW THE DEVELOPMENT OF A RESIDENTIAL CONDOMINIUM PROJECT WITH SIX (6) UNITS FOR THE PROPERTY LOCATED AT 5416-5420 WELLAND AVENUE, City Council Minutes February 21 , 2012 Page 10 seconded by Mayor ProTem Yu and unanimously carried by the following roll call vote : AYES: NOES: ABSENT: ABSTAIN : Councilmember-Bium, Sternquist, Yu, Chavez Councilmember -None Councilmember-None Councilmember-Vizcarra 10. UPDATE FROM CITY MANAGER City Manager Pulido announced the Mayor's State of the City address would be presented at 6:30 p.m. on March 6. There is a newly designed magazine replacing the City's quarterly newsletter that will be coming out in March. 13. MATTERS FROM CITY OFFICIALS -None 14. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS The City Council reported on recent meetings of the Contract Cities Association and Public Art Advisory Ad Hoc Committee . 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER BLUM-None B. COUNCILMEMBER STERNQUIST Councilmember Sternquist thanked City Manager Pulido for walking the business district with her on Friday. They visited businesses and spoke to owners about what they liked or what could be improved upon . C. COUNCILMEMBER VIZCARRA Councilmember Vizcarra mentioned the City's Farmer's Market now has a tamale cart which seems to be working out well and attracting more people . Councilmember Vizcarra asked about the Chamber Remodel meeting before the full Council and City Manager Pulido stated that a meeting date would be determined next week . MAYOR PROTEM YU Mayor Pro T em Yu requested the City Clerk 's Office provide him with a regular Council packet for each meeting in addition to the electronic version. E. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Matthew Wong, Temple City resident, said he was disappointed with what occurred this evening and was surprised that previous management hires were given such generous packages. Just because this City is better off than others doesn't mean it should be spending more . Previous City Councils worked hard to be fiscally conservative and, as taxpayers , residents have the right to express these concerns to Council. Mary Kokayko, Temple City resident, praised Matthew Wong for his continued interest in the City, even when away at college, and thought he was an exceptional young person . She was also glad that Council did not just "rubber stamp" approval on the employment agreement item . Frank Ruedel, Temple City resident, said he appreciated Edison and all of the work they did during the windstorm cleanup . He was most disappointed about the Blue Star Banner Program issue, and reminded everyone the City did not have a 9-11 event. 18. CLOSED SESSION -None 19.
