HomeMy Public PortalAboutOrdinance No. 434-80 06-16-1980 4 ORDINANCE NO. - AN ORDINANCE CREATING THE POSITION OF CITY ADMINISTRATOR IN THE CITY OF RICHLAND HILLS, TEXAS: PROVIDING FOR HIS POWERS AND DUTIES: AND ORDAINING OTHER MATTERS RELATING TO THE SUBJECT. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: Sec. 1 Creation of Position: The position of City Administrator is hereby created. Sec. 2 Appointment: The City Administrator shall be appointed l by a majority vote"of the City Council for azi indefinite term. He shall be chosen by the Council solely on the basis of his executive and administrative qualifi- cations. At the time of his appointment, he need not be a resident of the City or the State, but he shall become a resident of the City of Richland-Hills within six months of his appointment, or waiver of resident requirement by the Council in a reasonable time. No Council member shall receive such appointment during the term for which he was elected nor within two years after the expiration of his term. Sec. 3 Removal: The City Administrator shall serve at the will of the City Council and may be removed or suspended by a three-fourths (3/4) vote of the City Council. The City Council may designate some qualified person to act in the absence or disability of the Administrator. Sec. 4 Compensation: The City Administrator shall receive such compensation as may be fixed by the City Council. Sec. 5 Powers and Duties: The City Administrator shall be the administra officer of the City, who shall serve under the Mayor/Council as directed in a regular or called session. He shall be responsible to the City Council for the proper administration of all affairs of the City. To that end, he shall have power and shall be required to: (A) Prepare job descriptions for all officers and employees of the City and to recommend removal of any and all officers and employees of the City as necessary. For employees other than department heads and with the concurrence of the department head, he shall fill budgeted posi- tions on the City staff. He shall direct and supervise the day to day activities of all employ- ees through Department Heads. He shall be 2 empowered to suspend any officer or employee until such time as the City Council can act on his re- mendation. Only the City Council shall have the authority to terminate the employment of an officer or employee. (B) Assist the City Secretary and Mayor in preparing the budget annually and submit it to the City Council together with a message describing the important features and be responsible for its administration after adoption. (C) Prepare and submit to the City Council as of the end of the fiscal year a complete report on the finances and administrative activities of the City for the preceding year. (D) Keep the Council advised of the financial cond- ition and future needs of the City, and make such recommendations as he may deem desirable, make proposals for applications for federal grants, make required reports for such grants as may be applicable and desirable for City needs. (E) Supervise the purchase of all materials, supplies and equipment for which funds are provided in the budget; purchase materials and supplies necessary • for operation or maintenance of City services for amounts up to and including $2,999.99, after receiving authorization from the City Council to do so; let and receive bids for purchases over $2,999.99 and for contracts; present them to the Council for approval, and advise the Cour..cil on the advantages or disadvantages of contract and bid proposals. No purchase shall be made, contract let or obligation incurred for any item or service which exceeds the current budget appropriation without a supplemental appropriation by the Council. No contract shall be let except by the City Council. The City Administrator may issue such rules govern- ing procedures for purchasing within the adminis- trative organization as the Council shall approve. (F) Investigate the affairs of the City or any depart- ment or division thereof. Investigate all com- plaints in relation to matters concerning the ad- ministration of the government of the City, and regarding service maintained by the public utilities in the City, and see that the quality of service be maintained by the Public Works department and see that all franchises, permits and priviledges granted by the City are faithfully observed. . (G) Devote his entire time to the discharge of his official duties. 3 (H) Perform such other duties as he may be required by the majority of the City Councilnot inconsistent with law, or city ordinances. Sec. 6 Emergencies: In case of accident, disaster, or other circumstance creating a public emergency, the City Ad- ministrator may award contracts and make purchases for the purpose of meeting said emergency; but he shall file within 72 hours with the City Council a certificate showing such emergency and the necessity for such action, together with an itemized account of all expenditures. Sec. 7 Bond: The City Administrator shall :furnish a surety bond to be approved by the City Council, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be paid by the City. Sec. 8 Savings Clause: If any section,. subsection, or sentence, clause or phrase of this ordinance is for any reason held invalid by a court of competent jurisdiction, such decision or decisions shall not affect the validity of the remain- ing portions of this ordinance.
