HomeMy Public PortalAboutOrdinance No. 470-82 08-16-1982 ORDINANCE N0. 470 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS that: 1. There is hereby created a Board of Adjustment for this City. The board shall consist of five members and four alternate members shall serve in the absence of the one or more regular members when requested to do so by the Mayor. 2. The Board of Adjustment is given all the powers granted by Title 28 of the Statutes of Texas. 3. Appeals to the Board may be taken by any person aggreived by any officer of the city. Such appeals shall be taken within 10 days of the ruling of the official of the city by filing with the Board of Adjustment a notice of appeal setting forth the grounds of appeal. 4. The Board of Adjustment shall fix a reasonable time for the hearing of the appeal and give public notice thereof, as well as notice to the parties at interests. Public notice shah. consist of posting a notice of hearing on the property in question for at least seven (7) days and mailing a copy of said notice to each adjacent property owner by certified mail at least five' days before the hearing. 5. There is hereby created a preliminary hearing board to take evidence for the Board of Adjustment. The board shall consist of five members appointed by the City Council. This board shall have the power to take testimony on appeals to the Board of Adjustment by giving the same notice required above. i w It shall be a recommending body and any person aggrieved by its recommendation shall have the right to a hearing de novo before the Board of Adjustment by giving written notice within l0 days from the day that the Board of Adjustment acts upon the recommendation of the preliminary hearing board. 6. Any person appealing the ruling of an officer or board of the city to the Board of Adjustment shall pay a fee of $20.00, to pay for posting and administrative costs, at ' the time of filing notice of appeal. 7. The persons appointed to the initial Board of Adjustment are Bill Hurlburt Al Rodgers ,I and Tom Harvey to serve until April, 1983, and Oliver Pettit and Albert Donohoo to serve until April, 1984. Future appointees shall serve two'i year terms. The alternate members of the Board of Adjustment are W. H. Vincent and Donna Smith II to serve until April 1983, and Don Agan and Vernon Scott to serve until April, 1984. Future alternates shall serve two year terms. 8. The persons appointed to the initial preliminary hearing board are Michael Parrent , Hugh Wilson ' and Allen Cady to serve until April, 1983, and George Grant and Leon Danner to serve until April, 1984. Future members thereof shall be appointed for two year terms. 9. If any portion of this Ordinance is declared to be invalid. -2- by a court of competent jurisdiction it shall not affect the remaining valid portions. PASSED and APPROVED this llv day of 198.
