HomeMy Public PortalAbout11) 7H Oversght BdCity Council March 20, 2012 Page2 ANALYSIS: Staff is recommending to the City Council, acting as successor agency, to make the following appointments to the oversight board: • One member shall be appointed by the Mayor for the citv that formed the redevelopment agency. Staff recommends that the City Manager be appointed to fill one of the City's openings on the oversight board . The City Manager served as the Executive Director of the now-dissolved Temple City Community Redevelopment Agency and thus, has the skills and knowledge to effectively represent the City's interests and perform the duties of an oversight board member. • One member shall be appointed representing the employees of the former redevelopment agency by the Mayor. This employee must be a former redevelopment agency employee. Brian Haworth, Assistant to the City Manager, was working for the prior redevelopment agency. Therefore, it is recommended that he be appointed to fill the position. As a clarifying note, while AB x1 26 lists the Mayor as making the appointment, staff has reviewed this with legal counsel and recommends that the actions be approved by the City Council as a whole, as is the City's practice with appointments on outside bodies. The legislation specifies that the oversight board members serve at the pleasure of the entity to which they were appointed. The term of service for each appointee will end as of July 1, 2015, or earlier if the City Council votes to remove the appointees from the oversight board. As of July 1, 2016, a new oversight board, covering the entire county, will be appointed. CONCLUSION: Adopt the attached resolution making and affirming the recommended appointments to the oversight board. FISCAL IMPACT: There is no fiscal impact. As outlined in AB x1 26, oversight board members serve without compensation or reimbursement for any expenses. The Governor's appo intees need not be City representatives or former redevelopment agency employees. Therefore, it is In the City's interest to m ake appointments prior to May 1. RESOLUTION NO. 12-4805 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CONFIRMING THE MAYOR'S APPOINTMENTS OF MEMBERS TO THE OVERSIGHT BOARD WHEREAS, the City Council of the City of Temple City ("City") has heretofore activated the Temple City Community Redevelopment Agency and approved and adopted the Redevelopment Plan for the Rosemead Boulevard Redevelopment Project ("Redevelopment Plan"); and WHEREAS, as part of the Fiscal Year 2011-12 State budget bill, the California Legislature enacted, and the Governor signed AB x1 26 requiring that each redevelopment agency be dissolved; and WHEREAS, AB x1 26 provides that successor agencies be designated as successor entities to the former redevelopment agencies and provides that, with certain exceptions, all authority, rights, powers, duties and obligations previously vested with the former redevelopment agencies under the Community Redevelopment Law are vested in the successor agencies; and WHEREAS, the City is the successor agency to the Temple City Community Redevelopment Agency; and WHEREAS, AB x1 26 further provides that the successor agency's activities are subject to review and approval by an oversight board ("Oversight Board"), which shall be created for each dissolved redevelopment agency; and WHEREAS, the Oversight Board is to be comprised of seven appointees from affected local taxing entities and the community that established the redevelopment agency. Two members are to be appointed by the Mayor, one to represent the City and one to represent the employees of the former redevelopment agency; and WHEREAS, at its meeting of March 20, 2012, the Mayor of the City announced the appointment of City Manager Jose Pulido to serve as the City's representative and Assistant to the City Manager Brian Haworth to serve as the representative for the employees of the former Agency; and WHEREAS, all other legal prerequisites to the adoption of this resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Confirmation of Mayoral Appointments to the Oversight Board. The City Council hereby confirms the Mayor's appointment of City Manager Jose Pulido to LA #4648-7547-5726 v1 Resolution No. 12-4805 Page 2 serve as the City's representative to the Oversight Board and Assistant to the City Manager Brian Haworth to serve as the representative for the employees of the former Agency. SECTION 2. Implementation. The City hereby authorizes and directs the Mayoral appointments to take any action and execute any documents necessary to carry out the purposes of this Resolution, including but not limited to notifying the Los Angeles County Auditor-Controller, the Controller of the State of California, and the California Department of Finance providing notice of the adoption of this Resolution and the Mayor's appointment of the above-named representatives to the Oversight Board , in accordance with AB x1 26 . SECTION 3. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Resolution which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City hereby declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion thereof. SECTION 4. Certification . The City Clerk shall certify to the adoption of this Resolution . SECTION 5. Effective Date. This Resolution shall be considered effective as of March 20, 2012.
