HomeMy Public PortalAbout04-083 RESOLUTION NO. 04-047 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN RESOLUTION NO. 77-111, BY AMENDING SALARY RANGES ANDY CLASSIFICATION TITLES, TO BE EFFECTIVE AS OF JULY It 2004, AS A RESULT OF THE IMPLEMENTATION OF THE CI TYWIDE CLASSIFICATION AND COMPENSATION STUDY AT THE MEDIAN LEVEL ORIGINAL WHEREAS, the Director of Human Resources is authorized and directed under provisions of Sections 2797.1 and 2797.3(d) of the Carson Municipal Code to prepare and recommend position classification and compensation plans, after consultation with the affected General Managers, which becomes effective upon approval by the City Council. WHEREAS, Rule III of the City of Carson Personnel Rules provides that modification to the classification plan, embodied in Resolution No. 77-111, shall be made only after the Director of Human Resources consults with the affected General Managers and affected recognized employee organizations. WHEREAS, the Administrative Services General Manager, act f Resources, has consulted with the affected parties. ing or the Director of Human NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON HEREBY FINDS, DETERMINES AND RESOLVES AS FOLLOWS: Section 1. The above recitals are true and corcect. Section 2. The City of Carson conducted an extensive citywide classification and compensation study. As a result of this study, many existing job classifications warrant change and are, hereby, reclassified, and many job classifications warrant a salary range adjustment and, hereby, receive such salary range adjustment. Section 3. The results of such citywide classification and compensation study are listed by each bargaining unit in Attachments 1 —7. Section 4. The reclassifications and salary range adjustments authorized herein will take effect on July 1, 2004. Section 2. The City Council, pursuant to its right and authority, does hereby order submitted to the voters at such Special Municipal Election the following proposition: YES Shall Ordinance No. 04-1319, which increases the transient occupancy tax from 9% to 12%, be adopted? NO Section 3. The text of the proposed ordinance to be submitted to the voters is attached hereto as Exhibit A and incorporated herein by reference. The type of tax, the rate of tax to be levied and the method of collection are stated therein. Section 4. The method of collection of the transient occupancy tax is as specified in Carson Municipal Code Article VI, Chapter 4. Section 5. In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. Section 6. Notice of the time and place of holding the election is hereby given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. Section 7. Increase of Tax. Section 6402 (Tax Imposed) of Chapter 4 (Transient Occupancy Tax) of Article VI (Taxes and Licenses) of the Carson Municipal Code is hereby amended to read as follows: "6402 Tax Imposed. For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of 12%. The tax imposed shall be calculated as a percentage of the occupancy rent charged by the operator. Said tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the Tax Administrator may require that such tax shall be paid directly to the Tax Administrator." Section 2. Amendment and Repeal. Notwithstanding California Elections Code Section 9217, without a vote of the People of the City of Carson, the Carson City Council may do any and all of the following: (i) repeal this Ordinance; (ii) reduce the rate of the transient occupancy tax below 12%; or (iii) increase the rate of the transient occupancy tax to 12% if it has previously been reduced below such rate. In no event shall the Carson City Council increase the rate of the transient occupancy tax in excess of 12% without approval by a majority of the voters voting in an election on the increase. Section 3. Findings. The People of the City of Carson hereby find as follows: A. On October 5, 1993, the Carson City Council adopted Resolution No. 93-083 and thereby set the rate of the City's transient occupancy tax at 9%. B. This Ordinance was proposed by the Carson City Council through the adoption of Resolution No. 04-083 by the affirmative votes of not less than two-thirds of its members as required by California Government Code Section 53724(b). - 1of2- 741171.2 EXHIBIT "A" C. This general tax affected by this Ordinance is the transient occupancy tax. if this Ordinance is adopted, then the rate of tax to be levied will be 12%, The tax shall be collected in accordance with the method set forth in the Carson Municipal Code, which generally requires hotel operators to collect the tax from transients at the time rent is paid. Section 4. Intent., In enacting this Ordinance, the People of the City of Carson do intend as follows: A. If this Ordinance and Proposition which would increase the transient occupancy tax to 12%, both should pass, then this Ordinance shall control and Proposition_shall not be effective. B. Section 1 of this Ordinance shall increase the transient occupancy tax to a rate of 12% and thereby authorize future collections of the tax at such rate. Section 2 of this Ordinance shall allow the Carson City Council to do the following without voter approval: repeal the transient occupancy tax; reduce the rate of the transient occupancy tax below 12%; or increase the rate of the transient occupancy tax to 12% if it has previously been reduced below such rate. C. The Carson City Council shall not increase the rate of the transient occupancy tax in excess of 12°/a without voter approval. Section 5. Severabil If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance or any part thereof is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional. -2of2- 741171.2
