A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA,
ADOPTING THE OVERALL ANNUAL DISADVANTAGED BUSINESS ENTERPRISE
(DBE) GOAL AND METHODOLOGY REPORT FOR FEDERAL FISCAL YEAR 2004-
2005
WHEREAS, the City of Carson is committed to encouraging Disadvantaged
Business Enterprise (DBE) involvement in all phases of the City's procurement
activities; and
WHEREAS, DBE is defined as a small business that is owned by one or more
socially and economically disadvantaged individuals; and
WHEREAS, "socially and economically disadvantaged individuals" means those
who are citizens of the United States (or lawfully permanent resident) and who are
women, African Americans, Hispanic Americans, Native Americans, Asian-Pacific
Americans, or Asian-Indian Americans, or any other minorities or other individuals found
to be disadvantages; and
WHEREAS, any otherwise eligible individual whose personal net worth is greater
than seven hundred fifty thousand dollars ($750,000) are excluded from obtaining a
DBE status; and
WHEREAS, "disadvantaged business" means a small business concern: (1)
which is at least 51 percent owned by one or more socially and economically
disadvantaged individuals, or, in the case of any publicly owned business, at least 51
percent of the stock of which is owned by one or more socially and economical
disadvantaged individual; and (2) whose management and daily business operations
are controlled by one or more of the socially and economically disadvantaged
individuals who own it; and
WHEREAS, "small business concern" means a small business as defined by
Section 3 of the Small Business Act;
WHEREAS, The City is required to annually establish overall DBE program goals
for DBE anticipated levels of participation for DOT assisted projects. The City's overall
DBE goal shall be expressed as a percentage of the total amount of DOT funds that the
City anticipates spending.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Carson, as follows:

Section 1. The City of Carson's base figure of 13% for its DBE goal on
Department of Transportation (DOT) assisted projects is hereby accepted in
consideration of historical precedent of DBE goal achievement on city contracts and the
forecast of FY 2004-2005 projects. Based on the data analysis conducted by the City, a
13% annual goal for FY 2004-2005 is anticipated.
Section 2. In striving to include DBEs in all phases of Department of
Transportation (DOT) assisted projects under this Program, the City of Carson is
committed, to the maximum extent feasible, to employing race neutral means, as that
term is defined in 49 CFR Part 26. Only after it makes a determination, on an annual
basis that its overall goal for DBE participation in its DOT-assisted project cannot be
reached through race neutral means shall the City of Carson employ contract goals.
Section 3. The City of Carson anticipated that 2% of the annual goal will be
achieved by race-neutral measures. The remaining 11% of the goal is anticipated to be
accomplished through race-conscious measure, including establishing contract specific
goals.
