A CAPITAL PROJECT RESOLUTION OF THE VILLAGE
COUNCIL OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, AUTHORIZING THE EXPENDITURE OF AN
AGGREGATE AMOUNT NOT TO EXCEED FIVE -
THOUSAND DOLLARS ($5,000), FROM THE LAW
ENFORCEMENT TRUST FUND FOR THE PURCHASE OF
FITNESS EQUIPMENT FOR THE POLICE GYM.
WHEREAS, the Police Department has in excess of $ 55,000.00 in the Law Enforcement
Trust Fund Account; and
WHEREAS, these monies are the result of seized assets from joint investigations between
the Village of Key Biscayne Police Department and local Law Enforcement Agencies; not from tax
revenue; and
WHEREAS, this expenditure is from said forfeited properties; this Police Department need
can be satisfied at no cost to our residents; and
WHEREAS, approximately one year ago, the Police Department in conjunction with the
Village Administration, made a commitment to adopt a major change in its philosophy; and
WHEREAS, these changes were in part directed toward improving the physical fitness of
department personnel; and
WHEREAS, having a physically fit workforce increases attendance and reduces medical
costs, which benefits both the department and its members; and
WHEREAS, this voluntary program is designed to develop positive health practices in the
interest of preventing illness and injury; and
WHEREAS, this voluntary program has been received with great enthusiasm and has
included members of other Village Departments; and
WHEREAS, the Police Department's Gym was originally equipped anticipating a smaller
participation, and
WHEREAS, the success of this program has rendered the fitness equipment in the Police
Department's Gym inadequate to satisfactorily support the department's fitness program; and
WHEREAS, to remedy this insufficiency and to encourage the superlative participation in
the program by both Village and Police Department members, the department has proposed the
purchase of several items of gym equipment from reputable fitness firms such as Precor and Life
Fitness, etc.; and
WHEREAS, the proposed expenditure will cover the costs necessary to bring the gym
equipment up to par with the unexpected participation to the fitness program; and
WHEREAS, costs for "Other Law Enforcement Purposes" is an authorized expenditure of
the Florida Contraband Forfeiture Act, and;
WHEREAS, the Chief of Police has recommended adoption of this Resolution and
determined that the proposed expenditure F.S.S. § 932.7055, the Florida Contraband Forfeiture Act;
and
WHEREAS, funds for this expenditure is not included in the Police Department's operating
budget costs; and
WHEREAS, the Village Council finds that it is impractical to utilize formal bidding
procedures for this transaction, and hereby waives formal competitive bidding as authorized by
Village Code Section 2-85.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY
BISCAYNE, FLORIDA AS FOLLOWS:
Section 1. That the recitals stated above are hereby adopted and confirmed.
Section 2. The Village Council hereby authorizes the expenditure of an aggregate
amount not to exceed five -thousand dollars ($5,000.00) for Police Department Gym
equipment costs.
Section 3. That this expense shall be charged to the Law Enforcement Trust Fund.
Section 4. That this resolution shall take effect immediately upon adoption.
