November 1st, 1935.
The regdar meeting of Council was held to-day at 4:00 p.m.
and was attended by Mayor Bright, who presided, and Councilmen
Cann,. Lovell, Righton and Blumenthal, ani. Town Attorney McIntire.
The minutes of the meetings of June llth, Ju440th, August 2nd
and 14th, September 6th and. October 4th were an adopted.
Plans were presented showing a proposed Jail and. Auditorium
to be built with federal assistance, but no action was taken
in the matter.
Mr. H.L.Thomas, sanitariXe was appointed to this position
at a salary of ) ?5.00/u jec t6 the pleasure of the Chairman
of the Finance Committee, on motion made, seconded and psesed.
The Mayor informed Council that the beach protection had been
a-Troved but that the character of work requires other handling.
There being no furtkkr business Council adjourned subject to
t call of t Mayor.

AND, FURTHER, for tige considering and Adopting of a resolution,
requesting the next Chatham County Representatives in the Legis-
lature of the State of Georgia, and the Senator from the First
Senatorial District of the State of Georgia, to introduce and
have passed a Bill confirming the passing of the title to the
land conveyed by the Town of Savan ah Beach, Tybee Island, to the
Savannah Electric and Power Company, upon which the Electrical
Distribution System is now located.

The meeting was calthed to order by the Honorable
0.E.Bright, Mayor, all of the Councilmen being present, to-wit;

and the following Resolution was introduced by Councilman
W.G.Logan;
RESOLVED that the Rules of this Board, to-wit Council
of Savannah Beach, Tybee Island, be dispensed with at this meetigg
of Council.
The Same was seconded by Councilman Righton.
The Motion was formally put by Mayor Bright, and was
unanimously carried, and he announced that the Rules of Council
were dispensed with at this meeting of Council.

BY COUNCILMAN RIGHTON: AN ORDINANCE GRANTING
FRANCHISES AND PRIVILEGES TO THE SAVANNAH ELECTRIC AND POWER
COMPANY, IN OVER, UNDER, THROUGH AND UP )N THE PUBLIC STREETS,
LANES, WAYS AND ROADS OF THE TOWN OF SAVA%7NAH BEACH, TYBEE
ISLAND, GEORGIA, (FORMERLY TYBEE ISLAND), GEORGIA, AND FOR
OTHER PURPOSES.
COUNCILMAN LOGAN moved that the Ordinance introduced
by him be placed upon its second reading at this meeting; said
Motion was seconded by Councilman Righton and unanamously carried,
and the Ordinance was placed upon its second reading for passage.
After same had been read a second time, a vote was taken thereon,
and theOrdinance was unanamously passed in its final form,

TYBEE ISLAND, TO SAVANNAH ELECTRIC AND POWER COMPANY, THE ELEC
TRICAL DISTRIBUTION PLANT AND SYSTEM NOW OWNED BY THE TOWN OF
SAVANNAH BEACH, AND FOR TONER PURPOSES.
WHEREAS., on the 14th day of February, 1928, the
Mayor and. Councilmen of the Town of Tybee ( now Savannah Beach,
Tybee island,) in pursuance of a resolution adopted by said. Muni-
cipality on the 10th day of ortioruary, 1928, entered into a certain
agreement of the date aforesaid with the Savannah Electric and Power
Company, a corporation incorporated under the laws of the State
of Georgia, with its principal office in Savannah, Georgia, and
engaged in the manufacture, operation anddustribution of electri-
city for heat, light and power purposes, leasing to said Company •
for a period of Twenty-five years the elecrical distribution
plant and system fully described in said agreement, with the right
on the part of the said. Savannah Electric and Power Company to pur-
chase the same on the terms set forth in said resolution and con-
tract; and
WHEREAS, by mutual agreement of the parties said. Savannah
Electric and Power Company has offered to anticipate the date of
purchase of said electrical distribution plant and now to pay
for the same in cash; and.
WHEREAS, the rmnicipality of Savannah Beach, Tybee Island,
is in need of funds to pay off existing indebtedness and for need-
ed improvements, and the money can be derived from said sale to
be used for daid purposes and to the benefit of the citizens of
said town of Savannah Beach, Tybee Island; and
WHEREAS, the Mayor and. Councilmen of Savannah Beach,
Tybee Island, deem it to the best interest of said municipality
to accept the offer of said company and to anticipate the date
of purchase and they have agreed to accept the sum of $ 21,160.00
in cash, in full payment of the same,- and.
WHEREAS, at a meeting of the Mayor and. Councilmen of
the town of Savannah Beach, Tybee Island, held this 25th day of
November, 1935, after due and legal notice havdng been given
to all of the councilmen and the Mayor of the intention to hold
same and the date upon which the same was to be held, and the
purpose for which the same was to be had by the Clerk of
Council of said town of Savannah Beach, Tybee Island, and at
which meeting each and every member of said Council and the
Mayor of the the Town of Savannah Beach, are present, and it
being unanamously agreed that it was to the best interest of
said municipalty of Savannah Beach, Tybee Island, to well and
dispose of the aforesaid electrical distribution plant and
system,-
NOW, THEREFORE,
SECTION 1. BE IT ORDAINED by the said Mayor and. Coun-
cilmen in Council Lssembled, that the said municipal corporation,
to-wit; Savannah Beach, Tybee Island, do sell and convey to the
Savannah Electric and Power Company, a corporation, as herein-
before set forth, the electrical distribution plant and syetem

WHEREAS., on the 14th day of February, 1928, the
Mayor and Councilmen of the Town of Tybee ( now Savannah Beach,

to -wit; Savannah Beach, Tybee Island, do sell and convey to the
Savannah Electric and Power Company, a corporation as herein -
before set forth, the electrical distribution plant and system

owned by the said municipality located in, over, under,and upon
the streets* highways, roads, ways, strands, and other area of
themunivipality of Savannah Beach, Tybee Island, in Chatham
County, Georgia, consisting of wires, poles, cross -arms, insu-
lators, and all and singular every kind of electrical appara-
tus or euipment awned by the municipality of Savannah Beach,
Tybee Island, the conveyance to be made by warranty deed execut
ed on behalf of the said Savanah Beach, Tybee Island, by the
Mayor, and attested by the Clerk of Council.
SECTION 2. BE IT FURTHER ORDAINED by the authority afore-
said, that the Mayor is authorized to sign such deeds, papers, .
agreements, contracts of other instruments conveying the said
electrical distribution plant and system set forth in Section 1
of said instrument, to eb attested by the Clerk of Council, with
the seal of said town being affixed thereto.
SECTION 3. BE IT FURTHER ORDAINED, that all Ordiner . es
and )artat of Ordinances in conflict with this Ordinance be,, and
the same are hereby repealed.
COUNCILMAN BLUMENTHAL moved that the Ordinance introduced by
him be placed upon its seconded reading at thismeeting; said
Motion was seconded by Councilman Logan and unanamously carried,
and the Ordinance was placed upon its second reading for passage.
After same had been read a second time, a vote was taken thereon,
and the Ordinance was unanamously passed in its final form, as
follows:
AN ORDINANCE TO SELL AND CONVEY BY THE MUNICIPALITY OF
SAVANNAH BEACH, TYB + ISLAND EORGIA, TO SAVANNAH ELECTRIC AND
BOWER COMPANY the lot or parts of lot of land in the town of
Savannah Beach, Tybee, Georgia, upon which is located its elec-
trical plant, and for toher purposes.
WHEREAS, the municipality of Savannah Beach, Tybee Island,
Georgia, id the owner of a certain lot of land located on the
southeast corner of a tract of land designated on the official
map of the town of Tybee, now Savannah Beach, Tybee Island,
Chatham County, Georgia, sicty (60) feet in width North and South,
and Sixty (60) feat in length East and West, and same being
delineated upon said map as a Public Park, the park as a whole
being bounded on the. North by Fourth Street; and on the East by
Butler Avenue; on the South by Fifth Street; and on the West by
Third Avenue. The portion of the said lot or tract of land is
used for the parpose of maintaining thereon an electrical sub-
station of the Savannah Electric and Power Company, The said
lot is shown upon a map or plan attadad to the contract dated
May 26th, 1927, enetred into between the Mayor and Councilmen
of the Town of Tybee, and the Savannah Electric and Power Com-
pany, and to which reference is hereby made for greater par-
ticularity, o.py of which is now on file in the office of the
Clerk of Council; and,
WHEREA, the said Mayor and Council of the town of
Savannah Beach, Tybee Island, have this day sold, conveyed
and delivered to the Savannah Electric and Power Company,
a corporation incorporated under the laws of the State of
Georgia, the electrical distribution owned by it in the muni-
cipality of Savannah Beach, Tybee Island, for the sum of

3 21,160.00; and,
WHEREAS, it was understood and agreed as a part of the
consideration, -the municipality would sell and convey to the
said Savannah -- Electric and Power Company the land upon wWich
the said electrical sub- station --is- built; and
WHEREAS, said lot of land has heretofore been designated
upon said official map as aopart of a Public Park, but it has
never been used or utilized as such, and has never been offic-
ially designated to the public, or used for public uaep .: °and has
never been m.sedpOr.Iaccepitd as a public park. The said park
plan was many years ago abandoned and the public norrnany indi-
vidual has acquired any rights thereto,.and a fee simple title
to said tract-of-land remains-in-the' the town- -of Savannah Beach,
Tybee Island, with the-right-to sell and convey the same.
SECTION1. TBEREFO_ X, BE IT ORDAINED by the Mayor and
Councilmen of the town of Savannah Beach, Tybee Island, in
Council assembled, that the said municipality do sell and convey
to the said Savannah "lectric and Power Company the tract of land
designated as follows;
That certain lot of land located on the
Southeast corner of a tract of land designated on the official
map of the town of Tybee, now Savannah Beach, Tybee Islan4,
Chatham County, Georgia, Sixty (60) feet in width North and
South, and Sixty (60) feet in length East and West, and same be-
ing delineated upon said map as a public park, the park as a
whole being bounded on the North by Fourth Street; on the East
by Butter Avenue; on the South by Fifth Street; and on the West
by Third Avenue; as a part of the consideration for the sum
paid for the electrical distribution system, to -wit: $ 21,160.00.
SECTION 2. BE IT FURTHER ORDAINED by authority aforesaid,
that the °Tayor be, and he is, hereby authorized to execute a war-
ranty deed, cr such conveyance, agreement, or stipulation as
shall be necessary to convey the said lot to the Savannah Elec-
tric and Power Company, same to be attested by the Clerk of
Council, with the seal of the town thereon.
SECTION 3. AE IT FURTHER ORDAINED, by authority afore-
said that all Ordinances and parts of Ordinances in conflict
with this Ordinance, be, andthe same are, hereby repealed.
Councilman Righton moved that the Ordinance introduced by him
be placed upons. its second reading at this melting; said motion
was seconded by Councilman Blumenthal and un5namously carried,
and the Ordinance was placed upon its second reading for passage.
After same had bean read a second time, a vote was taken thereon,
and the Ordinance was unanmously passed in its final form, as
follows :
AN ORDINANCE GRANTING FRANCHISES AND PRIVILEGES TO THE
SAVANNAH ELECTRIC AND POWER COMPANY, IN, OVER, UNDER, THROUGH,
AND UPON THE PUBLIC STREETS, LANES, WAYS AND ROADS OF THE TOWN
OF SAVANNAH Bf]ACH, TYBEE ISLAND, GEORGIA, (FORMERLY TYBEE
ISLAND, GEORGIA) , AND FOR OHER PURPOSS .
WHEREAS, the Savannah Electric and Power Company has
agreed to, and will, purchase all the electrical distribution

plant now owned by the Savannah Beach, Tybee Island, consisting
of poles, wires, cross - arms,appurtenances and all equipment used
innconnection with the, .lighting pystem now on' Savannah Beach,
Tybee Island, Georgia; and,
WHEREAS, the purchase price tendered by the Savannah
Electric and Po7er Company to Savannah Beach, Tybee Island, for
its electrical distribution system id the full initial cost
thereof, and will be a very advantageous sale by the munici-
pality; and,
WHEREAS, the municipzlity of Savannah Beach, Tybee
Island, is now in need of funds to pay off some of its exist-
ing indebtedness, and make needed imprmvements, and the money
that will be derived from said sale will be used for those
purposes, and to the benefit of the citizens of the community;
and,
WHEREAS, as a part of the consideration for the pur-
chase of saidelectrical distribution system by the Savannah
Electric and Power Company from Savannah Beach, Tybee Island,
it is ggreed and un:ierstood that the said town of Savannah
Beach, Tybee Island, would grant franchises to the Savannah
Electric and Power Company, its successors, lessees, or assigns,
with the right tooperate, build and own a system or systems for
the transmission of electric power and lighting current, in,
over, under, through and upon all the public streets, lanes,
roads, and ways, including the Strand of the . town of Savannah
Beach, Tybee Island,Georgia, and with the reight of said company
to maintain and operate an electrical transmission and distribut-
ion system with all necessary wires, poles, and appliances, and
all underground conduits necessary, and needful to conduct the
business of furnishing the electric light, heat and power for
the inhabitants of the town of Savannah Beach, Tybee Island,
Georgia; and,
WHEREAS, upon the passage of an Ordinance at this meet-
ing of Council authorizing the sale of the electrical distri-
bution system by the town of Savannah Beach, Tybee Island, to
the Savannah Electric and Power Cmpany, said Company will
purhcase the same;
SECTION 1. THEREFORE, BE IT JRDAINED, by the Mayor
and Council of Savannah Beach, Tybee Island, in Council
assembled, that a franchise be, and it is hereby grahted
to the Savannah Electric and Power Company, a corporation with
its 3rincipal offices in the City of Savannah, Chatham County,
Georgia, engaed in the business of, generating and selling
electricity for light and power, and to its successors, lessees.,
or assigns, to operate, build maintain, own and lease a system,
or systems, for the manufacture and transmission of electric
power and lighting current, in over, through and upon all
public streets, lanes, roads,and ways, including the Strand
of the town of Savannah Beach, Tybee Island, Georgia, and to
maintain and operate an electric ttalisin ssion and distributing
system, with all necessary wires, poles and appliances, and
all,underground conduits necessary and needfulto conduct the
business of furnishing electi' ±c light, heat and power for the
inhabitants of the town of Savannah Beach, Tybee Island, Georgia,

inc uding the installation of such wires, poles, cross -arms,
appliances and appurtneances as may be requir.d from time to
time, or deemed necessary and expedient for accomplishing the
aforesaid purposes.
SECTION 2. BE IT FURTHER ORDAINED, BY authority afore -
said, t`.at the faanchises granted to the Savannah Electric and
Power Company by the tow of Savannah Beach, Tybee Island, to
operate, maintain, own and lease a system or systems for the
transmission of electric power and 1 ghting plant, in, over,
under, throu;h, and upon the public streets, lanes, roads, and
ways, including the Strand of the town of Savannah Beach,
Tybee Island, shall remain in full force and effect, and shall
not be affected by the passage of thid Ordinance, but the rights
herein granted shall be suplemental thereto.
SE' -TION 3. BE IT FURTHER ORDAID BY THE authority
aforesaid, that the Savannah Elctric and Power C"mpan , its suc-
cessors, lessees or assigns, shall, within thirty (30) days
after the passage of this Ordinance, file its written accep-
tance of the terms granted in this Ordinance with the Clerk
of Council of the town of Savannah Beach, Tybee Island, which
letter shall be placed upon the minuts of Council.
SECTION 4. BE IT FURTHER ORDAINED, by authority afore-
said, that all 0rdinances and parts of Ordinances in conflict
with this Ordinance, be and the same are, hereby repealed.
After the passage of the above Ordinance, the following resol-
utbon was introdueced by Councilman Logan, and unanamously
passed;
WHEREAS, on an offical map of the town of Savannah
Beach, Tybee Island, (formerly the town of Tybee), a certain
tract of land located and bounded on the North by Fourth
Street; on the East by Butler Avenue; South by Fifth Street;
and on the West by Third Avenue, is designated as a certain
public park thereon; and,
WHEREAS, never at any time since the official desig-
natbon has there been any dedication, acceptance, or use for
public park purposes and no park has in fact ever bean laid out,
and no dedication for public pur oses of said tract has arisen
and no rights of the public have intervened ; and,
WHEREAS, said municipality has htis day sold:and conveyed
to Savannah Electric_and Power, Company a portion of said lot
upon which there has been maintained for many years a sub-
station for use in connection with the electrical transmission
system owned by the said municipality; and,
WIIEREA$ it is desired to confirm and ratify the said deed
and to confirm and ratify the title to the remaining portion of
said tract in the town of Sava nah Beach, Tybee Island, freed
from all claim of dedication for such use as a public park,
NOW, THEREFORE, BE IT RESOLVED, by the municipality of
Savannah Beach, Tybee Island, in meeting assembled, that the
Legislature of the.a.te of Georgia, and the Senators and Repre-
sentative_s from this District, be requested to have introduced
and passed by the Georgia Legislature such appropriate Bill as
shallconfirm the title to the land conveyed to the Savannah
Electric and Power Company a,ncL theoremainu g portionb;therebf
in -fee simple in this municipality,
The Mayor informed Council that in connection with the town's
application for federal aid for beach protection that it would
necessary to have certain surveys made and maps and other data
prepared for submission to the local office of the U.S. Dis-
tricy Engineer, this would require the employement of several
engineers. It was moved and seconded and passed that the Mayor
be given authority to make the expenditure necessary to have
the work done.
•Petition of H.P.Anderson and J.E.Tant for permission to conduct
a business of sealing beer and other beverages. over 4% at the
Ocean View Hotel Dining Room at a reduced license for the balance
of the fiscal year. It was moved and seconded and passed that
petition be granted and that the license to be charged for con-
ducting the business to the remainder of the fiscal year, April
30th, 1935, shall be 1/3 of the annual fee for boti commodities.

A regular meeting of Corancil was held to-day at 4:00 p.m., and
was attended by M yor Bright, who presided, and Councilmen
Cann, Blumenthal, Sharpley, Righton,Logan and Lovell and Town
Attorney McIntire.
The minutes of the meeting of November 1st, were read and adopted.
A request from the Savannah Beach Civic Club for assistance
in creatinga fund for the care of volunteer fireman when they

Councilman Logan informed Council that he had had several
reports that Motorcycle Officer Ede:wards was using the private
automobiles of persons living on the island. The opinion was
that this practice must be stooped.
The aathorities of Fort Screen presented plans and requested
permission to erect an archway over Campbell Street, between
the auto road and the reservation, as the plans called for a
span of only 20feet for vehicular traffic, this was considered
to narrow. The Clerk was instructed to notify the petitioners
that if they would increas the span to 30 feet, which would
afford ample room for fraffic that authority to erect same
would be granted.
