RESOLUTION NO. 04-176
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARSON, CALIFORNIA, CALLING A CLOSED SESSION
TO CONFER WITH LEGAL COUNSEL REGARDING FOUR MATTERS
OF EXISTING LITIGATION ENTITLED:
DEWITT v. SANTARINA & RABER; HELEN KAWAGOE, INTERVENER,
RICHARD RAND v. CITY OF CARSON, CITY OF CARSON v. PADILLA; AND
AVALON CENTER INVESTMENT COMPANY v. CITY OF CARSON
THE CARSON CITY COUNCIL HEREBY FINDS AND RESOLVES:
Section 1. Pursuant to Government Code § 54956.9(a) and based on advice from
the City Attorney, the City Council determines that a closed session should be held to confer with or
receive advice from the City Attorney regarding four (4) matters of existing litigation involving the
City, the discussion of which in open session would prejudice the position of the City. The titles of
these litigation matters are: Dewitt v. Santarina & Raber; Helen Kawagoe, Intervener, Case No. BS
082401; Richard Rand v. City of Carson, Case No. CV 03-1913 GPS (PJWx); City of Carson v.
Padilla, Case No. BC-301626; and Avalon Center Investment Company v. City of Carson, Case No.
BS 087688.
Section 2. A closed session of the City Council of the City of Carson, California
shall be held forthwith, in recess from this regular meeting, pursuant to Government Code §
54956.9(a), regarding the matters referred to in Section 1 hereof.

I, Helen S. Kawagoe, City Clerk of the City of Carson, California, do hereby certify that the whole
number of members of the City Council is five; that the foregoing resolution, being Resolution No. 04-176
as duly and regularly adopted by said Council at an adjourned regular meeting duly and regularly held on
the 8th day of December, 2004, and that the same was passed and adopted by the following vote:
