HomeMy Public PortalAbout2016.066 (03-15-16)RESOLUTION NO. 2016.066 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, APPROVING AN AMENDMENT TO THE LONG BEACH BOULEVARD SPECIFIC PLAN TO PERMIT DRIVE -THRU FACILITIES FOR EATING AND DRINKING ESTABLISHMENTS IN VILLAGE III (TRANSIT VILLAGE) AND VILLAGE IV (BUSINESS VILLAGE), SUBJECT TO . THE APPROVAL OF A CONDITIONAL USE PERMIT (SPA 2016 -01) SECTION 1. FINDINGS: WHEREAS, Government Code Section 65450 et. seq. permits cities and counties to adopt specific plans for the systematic implementation of the General Plan and to provide for a greater level of detail in planning sites or areas of special interest or value, and WHEREAS, on November 21, 2006, the City Council by Resolution No. 2006.208 adopted the Long Beach Boulevard Specific Plan, and WHEREAS, Government Code Section 65453 permits the amendment of specific plans as often as deemed necessary by the legislative body, and , WHEREAS, City staff is proposing to amend the Long Beach Boulevard Specific Plan to permit drive -thru facilities for eating and drinking establishments in Village III (Transit Village) and Village IV (Business Village), subject to the approval of a Conditional Use Permit, and WHEREAS, on February 9, 2016, the Planning Commission held a duly noticed public hearing in the City Council Chambers located at 1130 Bullis Road, Lynwood, California, relating to this proposed amendment to the Long Beach Boulevard Specific Plan, and WHEREAS, after said public hearing, the Lynwood City Planning Commission adopted a Resolution recommending to the City Council an amendment to the Long Beach Boulevard Specific to allow drive -thru facilities for eating and drinking establishments in Village III (Transit Village) and Village IV (Business Village), subject to the approval of a conditional use permit, and WHEREAS, this project is exempt from the requirements of the California Environmental Quality Act (CEQA) as provided for in Section 15061(b)(3) as defined by Section 15378 of the CEQA Guidelines, and WHEREAS, the City Council of the City of Lynwood hereby finds and determines that the proposed amendment to modify the Long Beach Boulevard Specific Plan to 1 allow drive -thru facilities for eating and drinking establishments in Village III (Transit Village) and Village IV (Business Village) is consistent with the Lynwood General Plan, and the Long Beach Boulevard Specific Plan is hereby amended to read as shown on Exhibit" A" attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lynwood HEREBY APPROVES Resolution No. 2016.066 approving SPA 2016 -01, thereby amending the long Beach Boulevard Specific Plan as described in the Resolution. SECTION 2: This resolution shall become effective immediately upon its adoption. SECTION 3: The City Clerk shall certify as to the adoption of this City Council Resolution.
