HomeMy Public PortalAbout2016.081 (04-05-16)RESOLUTION NO. 2016.081 LHA RESOLUTION NO. 2016.004 A JOINT RESOLUTION OF THE BOARD OF DIRECTORS OF THE LYNWOOD HOUSING AUTHORITY AND CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING THE NEGOTIATIONS FOR THE PURCHASE OF, ALONG WITH THE ACTUAL ACQUISITION AND PURCHASE OF THE CALTRANS OWNED PROPERTY PART OF THE ALAMEDA TRIANGLE KNOWN AS CALTRANS PARCEL # 058166- 01-01 TO FURTHER THE DEVELOPMENT OF LOW- AND MODERATE - INCOME HOUSING OPPORTUNITIES IN THE CITY OF LYNWOOD WHEREAS, the Lynwood Housing Authority ( "Housing Authority ") is a component unit of the City of Lynwood that provides safe and sanitary housing conditions in the city available to persons of low- and moderate - income. at affordable low- and moderate - income rental rates; and WHEREAS, Caltrans is an executive department within the State of California, responsible for the design, construction, maintenance, and operation of the California State Highway System, as well as a portion of the Interstate Highway System within the state's boundaries; and WHEREAS, Caltrans owns that certain real property in the City of Lynwood generally known As Caltrans Parcel # 058166 -01 -01 (the "Triangle Property "); and WHEREAS, the purchase of Caltrans Parcel # 058166 -01 -01 Triangle Property would further the aims of the Housing Authority to promote the development and construction of low- and moderate - income housing opportunities in the City; and WHEREAS, the Triangle Property is part of a larger site known as the Alameda Triangle; and WHEREAS, the Alameda Triangle is the site of considerable contamination of several types and has been the subject of extensive cleanup efforts but remains contaminated at various levels, from various sources and at several locations within the site; and WHEREAS, the City of Lynwood ( "City ") and Housing Authority believe the Triangle Property may serve the City's interest in the development of low and moderate income housing opportunities and would, after necessary soil remediation work, serve the goals and objectives of the Housing Authority; and WHEREAS, Caltrans has indicated to the City its interest in disposing of the Triangle Property and pursuant to its legal mandates will sell the. Triangle Property to the Housing Authority on terms and conditions acceptable to all agencies. NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF LYNWOOD AND THE BOARD OF DIRECTORS OF THE LYNWOOD HOUSING AUTHORITY DO HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City Council of the City of Lynwood and Lynwood Housing Authority authorize the City Manager /Executive Director to engage in negotiations with Caltrans for the acquisition of the Triangle Property at a negotiated purchase price using the nearby comparable sales, the Triangle Property's fair market value, and taking into consideration any remaining remediation work required to render the property suitable for the development of low- and moderate - income housing. Section 2. That this authorization confers upon the City Manager of the City and Executive Director of the Housing Authority, to engage in negotiations with Caltrans for the acquisition of the Triangle Property at fair market value insuring that the value established for the Triangle Property takes into account any adjustment to price required to reflect any remaining remediation work at the Triangle Property. Section 3. This resolution shall become effective immediately upon its adoption. Section 4. The City Clerk and Housing Authority Secretary shall certify as to the adoption of this City Council Resolution and Housing Authority Resolution.
