HomeMy Public PortalAbout2005-14 Authorizing the Expenditure for the Purchase of X-26 Advance TasersRESOLUTION NO. 2005-14 A CAPITAL PROJECT RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AUTHORIZING THE EXPENDITURE OF AN AMOUNT NOT TO EXCEED FOUR -THOUSAND SIX - HUNDRED EIGHT DOLLARS AND NINETY SIX CENTS ($4,608.96), FROM THE LAW ENFORCEMENT TRUST FUND FOR THE PURCHASE OF X-26 ADVANCED TASERS. WHEREAS, the Police Department has in excess of $ 55,000.00 in the Law Enforcement Trust Fund Account; and WHEREAS, these monies are the result of seized assets from joint investigations between the Village of Key Biscayne Police Department and local Law Enforcement Agencies; not from tax revenue; and WHEREAS, this expenditure is from said forfeited properties; this Police Department need can be satisfied at no cost to our residents; and WHEREAS, our officers have been met with violence on several occasions within the past three months during the performance of their official duties; and WHEREAS, as a result of these confrontations, our officers have been hospitalized; and WHEREAS, tasers have been proven to be a safe and effective method to overcome a subject's combative intent, physical resistance, and/or assaultive behavior; and WHEREAS, the tasers may have prevented the injuries received by our officers; and WHEREAS, The Police Department's adopted Policy on the use of tasers is consistent with current Accreditation standards; and WHEREAS, the Police Department's Policy authorizes only those members of the rank of Sergeant or those performing the functions of a Sergeant to carry the taser after the required training and certification; and WHEREAS, to reduce probability of injury to both our officers and subjects, the department purchased and equipped our Sergeants with an X-26 Advanced Taser, Holster and required cartridges for an amount of Four -Thousand Six -Hundred Seven and Ninety -Six cents ($4,607.96); and WHEREAS, this expenditure is an officer safety issue which was not included in the Police Department's operating budget costs/police equipment line item; and WHEREAS, the Chief of Police has recommended reimbursement to the department from the Florida Law Enforcement Trust Fund; and WHEREAS, costs for "Other Law Enforcement Purposes" is an authorized expenditure of the Florida Contraband Forfeiture Act, and; WHEREAS, the Chief of Police has recommended adoption of this Resolution and determined that the proposed expenditure complies with F.S.S. § 932.7055, the Florida Contraband Forfeiture Act. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY BISCAYNE, FLORIDA AS FOLLOWS: Section 1. That the recitals stated above are hereby adopted and confirmed. Section 2. The Village Council hereby authorizes the amount of Four -Thousand Six Hundred Seven Dollars and Ninety Six Cents ($4,607.96) to be reimbursed to the Police Department operating budget, Police Equipment line item for the costs of the tasers. Section 3. That this expense shall be charged to the Law Enforcement Trust Fund. Section 4. That this resolution shall take effect immediately upon adoption.
