HomeMy Public PortalAboutOrdinance No. 514-84 07-02-1984 ORDINANCE NO. 514 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS, AMENDING THE CITY CODE OF ORDINANCES, CHAPTER 1, SECTION 15-A, ABANDONED, STOLEN, OR RECOVERED PROPERTY UNCLAIMED TO BE, SOLD OR USED BY THE CITY, AND SECTION 15-B, PUBLIC AUCTION OF UNCLAIMED PROPERTY AND PROVIDING A SAVINGS CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS; 1. That Chapter 1, Section 15-A, of the Code of Ordinances, City of Richland Hi11s, Texas is hereby amended to read as follows: SECTION 15: ABANDONED AND UNCLAIMED PROPERTY A. ALL ABANDONED, STOLEN, OR RECOVERED PROPERTY UNCLAIMED TO BE SOLD OR USED BY THE CITY All abandoned, stolen, or recovered property of every kind, except motor vehicles, which shall remain unclaimed within the Police Department for a period of six (6) months, without being claimed or unclaimed by the owner, whether known or not, may be sold at public auction or appropriated to the City's use, as provided here- in. 2. That Chapter 1, Section 15-B, of the Code of Ordinances, City of Richland Hills, Texas, is hereby amended to read as follows: • B. PUBLIC AUCTION OF UNCLAIMED PROPERTY The Chief of Police, or his designee, shall be responsible for this sale. Notice of the item and place of sale of all property to be offered for sale and a descriptive list of the property shall be published three (3) weeks prior to the sale and posted at or near the front entrance to the Richland Hills City Hall and a copy thereof sent to the last known ad- dress of the owner, if the name of such owner is known. Thereafter, such property shall be offered for sale at public auction to the highest bidder. Such property may be offered as individual items or assembled in lots at the discretion of the Chief of Police. Provided, however, that the head of any City Department may request in writing that any items offered for sale be assigned to his or her department. The City Council may, at their discretion, assign such item or items to such department or order them sold at the public auction. SAVINGS CLAUSE: If any section, subsection, or sentence, clause or phrase of this ordinance is for any reason held invalid by a court of competent jurisdic- tion, such decision or decisions shall not affect the validity of the remaining portions of this ordinance. • .
