AN ORDINANCE OF MOAB CITY ESTABLISHING AN
EMPLOYEE APPEALS BOARD
WHEREAS, Utah Code Annotated 10-3-1106 requires that Cities of
the third class have an appeals board to which employees who are
discharged by the City may appeal the discharge, and
WHEREAS, Moab City desires to afford their employees a process
to appeal the discharge from City employment.
NOW, THEREFORE, BE IT ORDAINED by the governing body of Moab
City that:
1. An appeals board is hereby created which shall consist of
five members, three of whom shall be chosen by and from the
appointive officers and employees of Moab City and two of them
shall be members of the governing body of Moab City.
2. The appeals board shall have all rights, powers, and
duties as outlined by Section 10-3-1106 of the Utah Code Annotated.
3. The members of the appeals board shall serve for a term of
office of one year.
4. The three members of the appeals board elected by the
employees shall be from the appointed officers or employees who
have previously been elected to the Moab City personnel policies
and procedures committee. The current members of the Moab City
personnel policies and procedures committee shall assign three
members of their board to serve as members of the appeals board for
each individual appeal that may be filed pursuant to this
ordinance.
5. The procedures for filing the appeal, the time limits for
the appeal and the process for handling the appeal shall be as set
forth in Section 10-3-1106 of Utah Code Annotated.
6. This ordinance shall take effect immediately upon passage.
