CITY HAL Pamela S. Jones Clerk- Treasurer The Greencastle Common Council met in Executive Session Wednesday, December 30, 1998, 4:00 p.m. at City Hall. Mayor Michael called the meeting to order. On the Roll Call, the following were found to be present: Councilor Hammer, Councilor Green and Councilor Baynard. Councilor Roach arrived at 4:15 p.m. Councilor Masten was absent. Also present was Attorney Selvia, Charles Wood and Attornev Bob Perry. Attorney Selvia explained this meeting was called to discuss pending litigation filed by Officer Carol Deom in U.S. District Court. Officer Deom received a "right to sue" letter September 30, 1998. The City did not receive their copy of the letter. The suit is filed against the City and Mayor Nancy Michael, in her individual capacity; Darrin J. Cox, in his individual capacity and Charles Wood, in his individual capacity. Attorney Selvia stated Attorney Bob Perry has practiced ® in U.S. District Count and has the experience to handle this case. Attorney Perry also helped as an advisor with the EEOC suits filed by Officer Deom. Attorney Perry stated that if this suit goes to jury trial the City's exposure could be up to $100,000.00. The bottom line is she was not denied the job because of age or sex, but because the other candidates were more qualified and the Chief has the right and ability to choose their own Assistant Chief. Councilor Roach arrives at 4:15 p.m. Attorney Perry stated there was some concern about him having a conflict of interest due to the fact he is a Deputy Prosecutor and works with Officer Deom on court cases. Attorney Perry stated he spoke with Robert Ziegler, head of the Ethics Committee, and Mr. Ziegler stated there is no conflict for Attorney Perry in handling this case. Councilor Hammer made the motion to allow Attorney Perry to be the City's legal representative in this case at an hourly rate of $90.00 per hour. Attorney Perry is to submit claims on a quarterly basis. Motion was seconded by Councilor Roach. Vote was unanimous. Motion to adjourn made by Councilor Hammer, seconded by Councilor Roach.
