BOROU(~ OF CARrPARMr PL~Y HE~RING APPFAL WH~, on June 26, 1997 the Mayor and Council of the Borough of Carteret held a hearing regarding certain charges against Plenary Retail Consumption License No. 1201-33-044-004 held by Simon S. Haddad Inc. t/a Simons's Nite Club; and WHEREAS, as a result of said hearing a certain suspension of said license was approved by the Governing Body; and W~, the license holder Simon Haddad (hereinafter "Licensee") filed an Appeal of Action of the Governing Body to the Director of the A.B.C. WH~, since the time of the hearing Licensee's operations have substantially in,roved to the extent that no further incidents have occurred; Additionally, Licensee has installed a sophisticated security syst~ to help minimize any further public nuisance issues; and I~, Licensee was offered by way of settlement of his appeal of five day suspension (non-consecutive) by the representatives of the Borough of -- Carteret; and WHEREAS, in addition to the five-day (non-consecutive) suspension, it was agreed that where Licensee's operations for a period of one year from the hearing date continue without further incident, the record of the five-day suspension shall not become permanent and chargeable to said license; NOW, THEREORE BE IT RESOLV~ as follows: 1. Licensee accepts the period of May 10 through May 15, 1998 as the five- day suspension: 2. Licensee shall continue to operate his establishment in full conformity with all laws, rules and regulations of the Local Issuing Authority as well as all appropriate A.B.C. Regulations. 3. The Mayor and Council of the Borough of Carteret shall approve the Licensee's annual renewal provided Licensee has complied with all of the appropriate filings and payment of annual license fees. _ 4. The five-day suspension shall become nugatory on July 1, 1998 provided Licensee's operations have fully complied with the provisions of Paragraph 2 above. 5. The condition previously imposed upon the Licensee shall also be removed where Licensee remains in full compliance with the terms and conditions of this resolution. 6.
