HomeMy Public PortalAbout01/29/1960 Special CCMSPECIAL NE STING JANUARY 29, 1960 The meeting was called to order at 8:25 P.M. by Mayor Hatcher in the Village Hall. All members of the council were present also Geo. Hedlund Village Al-tny. The Mayor explained the purpose of the special meeting was to consider the application of Joseph Durda for On Sale Liquor License to be located in a new building that Mr. Durda plans to build in Medina. Joseph Durda submitted a designers drawing of his proposed building to the people for their inspection. The planned size of the building is 80x120 feet, two stories in height consistion of the main floor and balcony. He explained that he had secured an option to buy 14 acres of land from Aliens on highway 12. The proposed cost of this building is 175 thousand dollars. J. Raskob asked about backers for this building and if the applicat- ion is in J. Durda's name alone. He also ahhdd if J. Durda is a resident in the Village and for how long. Mr. Durda said the license would be i;i his mame only and that he resided in the Village about a week. J. Scherer asked where the original home of Mr. Durda was. He stated N. E. Minneapolis. A. Gertz asked if his brother was assistant county attny. Yes. W. Schmit asked if license would be taken out as an individual. Y es. J. Scherer asked who Mr. Durda's parteners were. J. Durda in troduced his wife and his father-in-law as his parteners. R. Roehl asked were he was residing now. He explained in a motel on highway 55. W. Schmit asked the Village Attny ixt if an individual could take out a license and then transfer it to a corperation. G. Hedlund explained that the Village wished the license to be in the name of anti individual so as to pin point personal responsibility on licensee. J. Raskob asked if the liquor co=. required names of all membersof corperation to ap;,ear on license and bond. Yes. T. Reiser asked if the information as to the availibility of the license had been received from am individual. J. Durda replied that the availibilit of the license was a matter of common knowledge. On t.ie question of redidence G. Hedlund explained that the State does not require residency for license and that the Attorney General was 0 the opinion that a person is a redident i- he is physically present and intends to reside. J, Scherer asked if this property is zoned commercial. J. Durda asked A11ens to indicate the area on the Village Map. It is zoned. J. Ganglehoff asked what was expected of the council before building J. Durda replied assurance of On and Off Sale licenses and whatever other licenses necessary. He alse explained thlt his attorneys were handling his application and bond. J. Merz asked why a special meeting was called causing unnecessary expense to the Village. It was explained that the meeting had been called upon the request of J. Durda in connect- ion with applying for the license. W. Sch...it stated that the citizens of Medina are partticular who coAae into the area. He asle brought up the question of the committee to study municipal liquor. The Mayor the i asked if there was anyone else who wished to express opinions or favorable comments. .Interruption ---question on municipal liquor action. The Mayor explainrd the problem of location because of ou- scattered development. Question of puttin__ municipal question to a vote. A.Gertz stated the time to put in municipal was when we incourperated and that now it could be the ruination of the area--- A. Gertz stated that G. Hedlund's sug;estion was good, to grant r2 the 1'cense if all things are found to be in prmper order. An establish- ment representing 175 thousand dollars would be an asset to yhe comm- unity. This type of place would attract high class persons and it is necessary to attract outside capital. J. Scherer asked if this had been brought up before the Planning , Commission. The Mayor replied that this was not necessary as the property was already zoned. T. Reiser asked the meaning of "exclusive" in connection with the place. J. Durda stated that it would surpass Mc Carthy's. J. Raskob asked if liquor is necessary with food. J. Durda stated that adult persons expect to have a cocktail before dinner and that he would not build without liquor license. G. Tauer stated that in the absence of an application and bond there is no way to act on the question. W. Schmit asked what kind of an investigation is made on the applicant. Mayor explained that t e Village Attny checked the backgroun of the applicant. G. Hedlund stated that he had checked with Sheriff Ryan's office and received good recommendations, George Scott, County Attny. gave excellent recommendation. He stated that -ir. Durda had served in War2 then worked for Ryan, Soo Line investigation dept., served in Correan War and retired from the Navy as full commander with decorations. Also studied law. W. Schmit suggested that verbal checking is poor proceedure. G. Hedlund stated that this is common practice. Question was asked on whether the Village Codes would have to be abided by. G. Hedlund explained that license would not be renewed if everything is not up to specifications. Mrs Allen stated that assurance was given on the type of building. J. Ganglehoff stated that he felt that something was wrong and that the proceedure was moving too fast. He alto stated that there was no reason the others that had asked for the license were f;efused. J, Scherer asked for the settling of the Municipal question first. T. Reiser stated that the council should boot out the Village attorney. J. Crahan stated that the Raskobs have as good a recommendation as J. Durda. W. Schmit sug--vested that it would b efair to have a g .tkering of the population for the presentation of Raskobs and Durdas reasons for wanting the license and after listening to the peo le the council should do their wish on issuing the license. Sug_estion seconded by J. Gan1;lehoff. At this point the he�..ring was closed. The council then discussed the question. The clerk explained the tentative motion suggested by the attny. R. Roehl stated that he f el. this kind of motion would be wrong as we do not heve thy;. application or time for him to investigate. He was definitely against the _lotion. Aa T- _eis explained the request of J. Durda for the meeting because of the time element. Her opi;ion was that J. Durda has offered a desir:b. thing and should be cooperated with. Herb Arens stated he felt that i was a good idea to cooperate with J. Durda as long as he is willing to abide by regulations as J. Durda needs to know where he stands in this matter. Leonard Schlosser stated that if J. Durda will do what is required we should go along with him as this will mean additional revenue to the Village. Mayor Hatcher requested a motion. " 3 Motion by AnneTheis that upon receipt of Joseph Durda's application, bond, and federal stamp properly checked and O.K.'d b-- the Village Attorney we grant hi, the On Sale Liquor License. Seconded by Leonard Schlosser. Roll call vote requested by Robert aoehl. Vote was as follows. Robert Roehl NO Herb Arens YES Leonard Schlosser YES Anne Theis YES.
