HomeMy Public PortalAboutOrdinance No. 525-85 01-07-1985 i ORDINANCE N0. 525 • AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS, PROVIDING PROVISIO S FOR HANDICAPPED PARKING, PROVIDING FOR THE MARKING OF OFF-STREET PARKING OR HANDICAPPED PERSONS; PROVIDING FOR THE USE OF SUCH SPACES BY AUTOMOBI ES WITH SPECIAL LICENSE PLATES, TAGS OR DEVICES ISSUED BY THE STATE OF T XAS FOR DISABLED VETERANS AND DISABLED PERSONS; PROHIBITING THE PARKING 0 ANY OTHER VEHICLES IN SUCH SPACES; PROVIDING FOR THE TOWING OF ALL SUCH V HICLES NOT HAVING SPECIAL LICENSES; AND PROVIDING A PErIALTY. WHEREAS, the City Council of the City of Richland Hills has been requ sted by merchants providing handicapped parking and by handicappe person generally to make ordinance provisions for the limiting of c rtain parking spaces to the handicapped; and, WHEREAS, the State of Texas has provided for special licenses and tag for disabled persons and disabled veterans by Art. 6675a-5e and 675a- 5e1, Texas Revised Civil Statutes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RIC LAND HILLS, TEXAS: 1. That the Code of Ordinance, Richland Hills, Texas, is hereby', amended by adding sections which shall read as follows: A. Marking Handicapped Parking Spaces • Upon the installation by the owner or operator of any offstr et parking facility, the Police Department of the City is autho ized to designate stalls or spaces in an off-street parking facility for the exclusive use of vehicles which display a distinguishing license plate, specially designed symbols, tags, or other devices, issued pursuant to Art. 6675a-5e, and 6675a-Sel, Texas Revised Civi Statue to disabled veterans and disabled persons. Such stalls or s aces shall be designated by posting immediately adjacent to and v'sible from each stall or space a sign consisting of a profile view of a wheelchair with occupant in white on a blue background. B. Parking Restricted; Towing of Unauthorized Vehicles from Han icappec Spaces j It is unlawful for the operator of any vehicle not displaying a dis- tinguishing license plate issued to disabled persons pursuan to Art 6675a-5e1, Texas Revised Civil Statues, or to disabled vetera s pur- suant to Art. 6675a-5e, Texas Revised Civil Statutes, to stop, stanc park, or leave standing such vehicle in any parking space pro erly designated for the exclusive use of physically handicapped pe sons pursuant to the foregoing section. Such shall constitute a Class C misdemeanor. Any vehicles not displaying the proper license plates, tags, r de- • vices, may be towed from a handicapped parking space designat d by the foregoing section at the expense of the owner of such veh'cle, and may be impounded until all towing and storing charges are paid. Any person, firm or corporation violating any of the provisions • of this Ordinance shall be deemed guilty of a misdemeanor anc~ upon final conviction thereof fined in an amount not to exce d Two Hundred Dollars ($200.00).
