ORDINANCE NO. 08 -2009
AN ORDINANCE TO AMEND THE CODE OF ORDINANCES
SECTION 6 -9 REGARDING ALCOHOL PROHIBITIONS APPLICABLE TO MINORS
FOR THE CITY OF TYBEE ISLAND, GEORGIA
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is authorized under Article 9, Section 2, Paragraph 3 of the Constitution of the State of Georgia
to adopt reasonable ordinances to protect and improve the public health, safety, and welfare of
the citizens of Tybee Island, Georgia, and
WHEREAS, the duly elected governing authority for the City of Tybee Island, Georgia,
is the Mayor and Council thereof, and
WHEREAS, the governing authority desires to adopt ordinances under it police, zoning,
and home rule powers,
WHEREAS, it is necessary to amend the Code of Ordinances to make the provisions
prohibiting the consumption or possession of alcohol by a minor consistent with the provisions
of State law so that the following changes shall be made in Section 6 -9(B),
WHEREAS, the City of Tybee Island desires to clarify the Ordinance relating to alcohol
prohibitions as to minors to provide for an effective date and for other purposes.
NOW, THEREFORE, be it ordained by the governing authority of the City of Tybee
Island that Code Section 6 -9(B) regarding alcohol prohibitions as to minors is amended so that
the following change shall be made:
Said Code Section currently reads: "(B) It shall be unlawful for any person under the
age of twenty -one (21) to drink or possess in any public place, or on any public highway or place
of public consort any spiritous, malt or vinous liquors or any intoxicants."
Said Code Section shall hereafter read as follows: (B) It shall be unlawful for any
person under the age of twenty -one (21) to drink or possess any alcoholic beverages or any other
intoxicants except as expressly authorized by State law."
It is the intention of the governing body, and it is hereby ordained, that the provisions of
this ordinance shall become and be made a part of the Code of Ordinances, City of Tybee Island,
Georgia, and the sections of this ordinance may be renumbered if necessary to accomplish such
intention.
This Ordinance shall become effective on q`11 day of L L )1. 2009.
