HomeMy Public PortalAbout2005-21 County Conflict of Interest, code of ethics ordinances exemptions, certain Village Advisory BoardsRESOLUTION NO. 2005-21 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, EXEMPTING CERTAIN VILLAGE ADVISORY BOARDS FROM THE APPLICATION OF THE MIAMI-DADE COUNTY CONFLICT OF INTEREST AND CODE OF ETHICS ORDINANCE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the conflict of interest and ethics guidelines mandated by state law and county ordinance impose similar but independent obligations upon local regulated persons; and WHEREAS, Village of Key Biscayne, Florida (the "Village") advisory board members are responsible for compliance with all applicable ethical guidelines and requirements mandated under both state and local law; and WHEREAS, Council wishes to attract more citizens to serve on Village advisory boards, and to simplify the standards of conduct imposed on said citizens; make such service more convenient; and WHEREAS, Section 2-11.39-2 of the Miami -Dade County Code (the "County Code"), as interpreted by the staff of the County Ethics Commission, authorizes the Village Council to exempt members of designated Village advisory boards from the provisions of the Section 2-11.1, Miami -Dade County Conflict of Interest and Code of Ethics Ordinance (the "County Ethics Code") as the same may be amended from time to time; and WHEREAS, members of any and all designated Village advisory boards shall remain responsible for complying with all applicable ethical guidelines and requirements mandated by state law; and WHEREAS, the Village Council wishes to implement the exemption authorized by said section of the County Code and designate certain Village advisory boards thereunder. NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the above stated recitals are hereby adopted and confirmed. Section 2. Designated Village Advisory Boards. That the following Village advisory boards are hereby designated pursuant to Section 2-11.39.2 of the County Code: 1. Crandon Boulevard Streetscape Advisory Committee, ratified pursuant to Ordinance No. 2004-02. 2. Noise Ordinance Review Committee, ratified pursuant to Ordinance No. 2004-02. 3. Crandon Boulevard Master Plan Implementation Committee, established pursuant to Ordinance No. 2004-05. 4. Crandon Boulevard Zoning and Development Committee, established pursuant to Ordinance No. 2004-06. 5. Community Center Advisory Board, established pursuant to Ordinance No. 2003-7, and codified in Section 2-150, Village Code of Ordinances. 6. Art -in -Public -Places Board, established pursuant to Ordinance No. 2001-14, and codified in Section 2-142, Village Code of Ordinances. 7. Vision Plan and Evaluation and Appraisal Report Committee, established pursuant to Ordinance No. 2005-1. Section 3. Application. That the members of each Village advisory board listed above in 2 Section (2) are hereby exempt from the provisions of the County Ethics Code pertaining to their board membership. Section 4.
