USFS CLAIM: ++++++++++ The Committee reviewed the City Engineer's recommendation on the settlement for the asphalt damage to the new taxiways. After discussion, Tucker moved that the Committee recommend to the City Council that the claim be settled, as proposed by the USFS for $4960. Colburn seconded and the motion carried unanimously. III. ASSIGNMENT OF LEASE ++++++++++ The Committee reviewed the proposed assignment of the Conley lease to the Lees. After discussion, Fereday moved to recommend to the City Council that the assignment be approved. Wolf seconded and the motion carried unanimously. IV. 1994 AIRPORT IMPROVEMENT PROJECT, STATUS: The Committee reviewed efforts on the UST removal by Pioneer Aviation, relocation of the CAP to the old jumper base building office and donation of the antique NDB to the Caldwell museum, as well as the report by Kim Allen that the Engineer's have received word that the DBE (Disadvantaged Business Enterprise) goals have been approved by FAA and the project can proceed to advertisement for bids. V.OTHER BUSINESS: The revised Mission Statement was noted. VI. Please keep in mind that the overlay was considered because it was the only alternative which would return the taxiway to its pre-existing condition. Full depth pavement replacement of the damaged area is the standard repair procedure which will provide a satisfactory finished product if done carefully. We understand that as a result of this report the U.S. Forest Service is willing to offer $4960 to settle the claim for damage to the taxiways. We recommend that the City accept this settlement, but that no action be taken at this time to repair the taxiway. We would recommend instead that the required taxiway repair be delayed until the completion of the FY ' 94 AIP airport project for the following reasons: 1. Rerouting of ground traffic around the construction sites on the airport will increase the traffic on the taxiways during the construction project which could accelerate the deterioration of the taxiway or increase the area of deterioration; 2. It is appropriate to repair the taxiway at the same time that an experienced contractor is on the airport working on the FY '94 AIP project. Please call if you have any additional questions. Conley a present leaseholder at the Municipal Airport and Christopher and Tonyah Lee as assignees of that lease. As previously discussed the Lee's wish to clarify their ability to configure the improvements differently from that originally proposed by Mr. Conley and thus we have added language in the approval by the City which incorporates that feature, conditioned on all improvements complying with the governing standards and regulations and the ultimate lease payment being in turn subject to the applicable lease rates set by the standards. Finally we clarified the need for a site and grading plan at the time construction is actually imminent. We would appreciate it if you would present this to the Council for their consideration and, hopefully, approval. CONLEY (CONLEY), presently holds a Tenant Lease at the McCall, Idaho, Municipal Airport executed on or about December, 1992; and WHEREAS, CHRISTOPHER M. LEE and TONYAH L. LEE, husband and wife (LEES), wish to assume said Lease and CONLEY is agreeable to assigning same; and WHEREAS, the CITY OF McCALL (CITY), as Lessor/Landlord is agreeable to the foregoing and is also agreeable to a request by the LEES to permit the construction of improvements differing in size from those contemplated in the CONLEY Lease Agreement. NOW, THEREFORE, in consideration of the foregoing, and the terms and conditions which follow, the parties agree to perform, each for the other, as follows: 1. In consideration of the payment by the LEES to CONLEY of a sum equal to his 1993 lease payment to the City, namely, $755.25, CONLEY agrees to transfer, absolutely, all his right, title and interest in and to the subject leasehold to the LEES and by execution of this Agreement does formalize such transfer. LEES hereby agree to assume and timely satisfy all the remaining Tenant obligations under such Lease Agreement and by execution of this Agreement does formalize such assumption. 3. CONLEY represents the Lease is not in default and he has faithfully performed all material terms thereof from and after its inception and that he, and he alone, holds all interests under such lease and is free to alienate same; that it is free from all liens or encumbrances. 4. This Agreement shall bind the parties, their heirs, assigns and any other successors in interest. A true and accurate copy of the Lease Agreement has been provided to the LEES (save and except for Exhibit C which does not exist, the area leased being depicted instead on the Airport Taxi Plan posted at City Ha11, Rev. 7/27.92, prepared by the Toothman-Orton Engineering firm, and on which are depicted Lots 4C and 4D referenced in the Lease Agreement). 5. This Agreement is expressly conditioned on approval by the City of McCall as Landlord and, further, on their approval of the request by the LEES to permit the construction of improvements differing in size from those contemplated in the original Lease Agreement. FURTHER, said Lease Agreement is amended to provide as follows: 1. Actual site improvements may vary from that permitted in the original Lease Agreement, subject to the general standards for the leasehold as set forth in the Minimum Standards and General Standards for Airport Leases, as well as applicable building codes and zoning ordinances. 2. To the extent the size of the building constructedvaries from the originally contemplated hangar of 65' x 45', the annual lease payment shall likewise vary based upon the standard lease rates and any intervening CPI adjustments. 3. The Tenant shall be obligated to provide, in conjunction with any actual construction, a site plan and grading plan, prepared by a registered engineer or surveyor depicting the contemplated site improvements and grade. 4. To the extent the proposed improvements by way of configuration, location, or use vary materially from those contemplated by the governing standards and regulations, additional special conditions may be imposed as a condition of approval to proceed with such improvements. That plan includes sale or demolition of the old tanker base building that is now used by the CAP along Deinhard Lane. That means that we must relocate your equipment and supplies to another facility or location. I would like to discuss this with you and consider other alternatives. Box 962 McCall, ID 83638 Dear Kirk, The Airport Committee and the City Council have completed their approval of the plans for the 1994 Airport Improvement Project. That plan anticipates your removal of the fuel island and UST's from the field. When removed, we must amend the lease to allow the city to asphalt that portion of the ramp. It can not be paved while under lease or thereafter. In the unlikely event that the tanks are leaking, the removal project could result in long delays for testing of ground and water quality. We are concerned that, if this occurred, it would delay our construction. We are hoping that you are scheduling the demolition and removal for this fall. The terms of that lease required that by the end of the lease, the materials stored on the airport land was to be removed and the site returned to its former condition. (Lease, Exhibit B, Special Conditions, No. 3). Those materials have remained on the airport property from November 15, 1991 until the date of this letter. It seems only fair that the city should be paid the lease rate for 2 additional years, totaling $212.00 ($106 per year) for this continued use. I am asking the City Treasurer to bill you for this amount. Furthermore, the city is planning a major airport improvement project on the field next year. That project will excavate material from the area on which you are storing logs. To avoid any delays in our project commencement next spring, it is essential that your materials be removed by November 15, 1993, at 5 o'clock p.m. Any materials, equipment, etc. remaining on the site after that time will be regarded as abandoned and will become the property of the City of McCall. (see Lease, Exhibit A, General Conditions, Section 15). I cannot grant any further delays or time extensions for removal and clean-up of the site. If you have questions, please call me. PE Dear Mr. Rogers: Enclosed are three copies of the plans, specifications, and the General Checklist for the McCall Airport Sewer project, consisting of approximately 6300 feet of gravity sewer line across the airport for review and approval. Due to the size and cost of the project, construction is anticipated to be phased. The first phase of construction, MH AP- 11 to MH Ap-16, is to be completed during the summer of 1994 as a portion of the McCall Airport Improvement project. Timing for future phases of construction is not known at this time and is dependent on funding by the City of McCall. We understand that approvals for a project normally are for a one year time period. As construction for this project will take more than one year to complete, we would hope that extensions to the original approval could be obtained as required by submitting to you the proposed future project phasing for your approval.
