HomeMy Public PortalAbout2009 CC RES 09-026 RESOLUTION NO. 09-026 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING THE SCOPE OF WORK AND BOUNDARIES OF UNDERGROUND UTILITY DISTRICT NO. 9 NOW, THEREFORE, the City Council of the city of Carson does hereby resolve as follows: Section 1. A public hearing was held in the Council Chambers in the City Hall, Carson, Californi on March 4, 2009, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the city designated as follows: • From the centerline of Lucerne Street easterly to a point between the Union Pacific Railroad (UPRR) and the Dominguez Channel and from approximately 100-feet east of Wilmington Avenue to Arco Way. Section 2. Notice of such hearing was given to all affected property owners as is shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by the law; and Section 3. The hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. Section 4. The City Council hereby finds that the public necessity, health, safety and welfare requires the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within the above-designated area. Section 5. Pursuant to Ordinance No. 52 of the city of Carson, the above-designated area is hereby declared to be Underground Utility District No. 9 of the city of Carson. Section 6. The amended area in the district is shown upon that certain map entitled "city of Carson, Amended Underground Utility District No. 9," dated March 18, 2009, which is on file in the office of the City Clerk, city of Carson. Section 7. The City Council does hereby order the utilities as follows: • Complete the removal of the overhead cables and structures on 223rd Street by December 31, 2010; except for the Southern California Edison (SCE) 66kv overhead lines and poles between Lucerne Street and a point between the Union Pacific Railroad (UPRR) and the Dominguez Channel by December 31, 2012 [MORE] RESOLUTION NO. 09-026 PAGE 2 OF 3 • Removal of all poles with 66kv transmission overhead wires, and associated overhead cables and structures on 223rd Street, from approximately 100 feet east of Wilmington Avenue to approximately 200 feet west of Arco Way shall be done at a future date when the city of Carson has accumulated sufficient funding from Rule 20A allocations. Section 8. The City Council hereby requests the affected utilities to pay for the installation of up to 100 feet of the customer's service lateral. Additionally, the City Council hereby requests SCE to utilize Rule 20A allocations to convert affected existed overhead services. Section 9. The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within the above-designated area of the adoption of this resolution within ten days after the date of such adoption. The City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities. Such notification shall be made by mailing a copy of this resolution, together with a copy of city of Carson Ordinance No. 52, to all affected property owners as shown on the last equalized assessment roll and to the affected utilities. Section 10. The City Council hereby finds and determines that the Underground Utility District is in the general public interest, as the undergrounding to be accomplished will avoid or eliminate an unusually heavy concentratior of overhead facilities. Section 11. The City Clerk shall certify to the passage and adoption of this resolution, and it shall be in immediate force and effect.
