HomeMy Public PortalAbout2009 CC RES 09-112RESOLUTION NO. 09 -112 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, URGING RESOLUTION OF UNDERGROUND CONTAMINATION ISSUES IN THE CAROUSEL TRACT WHEREAS, the city of Carson's primary purpose is to protect the health and safety of its citizens; and WHEREAS, the Mayor and City Council are elected to represent the community and to provide leadership and direction to staff and regulatory agencies in order to facilitate a rapid response to dangerous events; and WHEREAS, the city of Carson has recently been notified of significant petroleum contamination in the Carousel Homes Tract caused by Shell Oil Products U.S. at levels reported to be 100,000 times greater than California based on health standards; and WHEREAS, the city of Carson is committed to a rapid and thorough pollution investigation as ordered by the California Regional Water Quality Control Board; and WHEREAS, the city of Carson will organize resources, provide data and facilitate a coordinated effort among all agencies (local, state and federal) ensuring all environmental laws are complied with; and WHEREAS, the city of Carson is primarily concerned with the health and safety of its residents, the City Council is also concerned with the related property damage, the disruption of lives, loss of enjoyment and impacts on the city's unity as a whole. NOW, THEREFORE BE IT RESOLVED, the City Council of the city of Carson does hereby adopt this Resolution of Support for the impacted residence of the Carousel Homes Community; Section 1. the City Council directs staff to establish a data clearing house for all investigations and remedial actions taken by Shell Oil Products U.S., the California Regional Water Quality Control Board, California Department of Toxic Substance Control, California Environmental Protection Agency or any other entity concerned with the Contamination/Pollution Response Plan. Section 2. City Council directs staff to expedite any and all City of Carson Public Works, Building or Encroachment Permits required to conduct work in connection with the Shell Oil Products U.S. Response Plan. City Council directs staff to notify Underground Service Alert to designate the Carousel Homes Tract as a Methane Gas impacted area above explosive condition thresholds that special precautions be taken when evacuating in the area. Section 4. City Council further directs staff to provide assistance to community members seeking property tax reassessment for their homes as a result in their immediate loss in value. Section 5. City Council further directs staff to notify all elected officials, with jurisdiction, that the city of Carson has been significantly impacted by the petroleum contamination by Shell Oil Products U.S., and their assistance is vital to the timeliness of the investigation and ultimate remedial activities which may result. Section 6. City Council further directs staff to seek federal agency intervention and federal funding sources. Section 7. City Council further directs staff to continue to provide leadership and assistants to impacted parties. PASSED, APPROVED and ADOPTED this 7th day of October 2009. ATTEST: City Clerk Helen S.
