HomeMy Public PortalAboutOrd. 19-13OrbinanU No. 1943 of t4Q 1Bvrr t 4 of Turftro, AUTHORIZING RULES AND REGULATIONS FOR THE GOVERNANCE OF THE OPERATIONS OF THE CARTERET MARINA BE IT ORDAINED by the Mayor and Council of the Borough of Carteret (the "Borough ") that the Code of the Borough us hereby amended and supplemented to include the following: Section 1 The attached Schedule "A" entitled "Carteret Marina Vessel Safety and Security Course Supplement' issued to all boat slip lessees at the Carteret Municipal Marina as part of the required annual boat safety training course is hereby incorporated in the Code of the Borough of Carteret as if set forth herein, and shall be enforceable along with any additional rules and regulations as set forth in the terms and conditions of the seasonal boat slip rental agreement. Section 2 All ordinances or parts thereof inconsistent with the provision of this ordinance are hereby repealed limited to the extent of any such inconsistency. Section 3 If any section, paragraph, sub- division, clause or provision of this ordinance is adjudged invalid, such adjudication shall apply only to the section, paragraph, sub - division, clause or provision so adjudged and the remainder of this ordinance shall be deemed valid and effective. Floating, submerged, or semi - submerged objects may be present. • Boaters shall observe fire Vessel Traffic Signal installed at the entrance to the marina: In light of the unique operational environment in which the Carteret Marina exists, the following safety measures have been installed and will be enforced at all times. A vessel traffic signal has been installed at the entrance to the marina and is located on the southerly wave attenuator. The traffic signal faces north towards boat traffic preparing to exit the marina. The traffic signal uses cameras to sense the potential presence of large vessels approaching the marina from the north and south. Boaters are reminded that not all vessels (including small or large vessels, barges, or vessels in tow) may trigger the signal; therefore, caution and attention to surroundings must be exercised at all times. Boaters are reminded that this signal DOES NOT control vessel traffic in the Arthur Kill and passing vessels will not stop or alter their course to accommodate vessels entering or exiting the marina. Additionally, vessels exiting the marina are only permitted to make right hand (southerly) turns and must proceed south a safe distance to establish a safe environment in which to turn and begin on a northerly course. Boaters shall only exit the marina when permitted by the marina's vessel traffic signal: • A steady RED signal indicates that a vessel with limited maneuverability may be near the marina's entrance. While the red signal is illuminated, boaters should remain a safe distance from the mouth of the marina and not enter or exit the marina. • A flashing YELLOW signal indicates that the signal system has not identified a vessel with limited maneuverability approaching the marina enhance. Boaters may enter or exit the marina while exercising caution and remaining aware that not all vessels may trigger the warning system. • Boaters are reminded that the fastest currents and turbulent water conditions generated from passing vessels may exist near the wave attenuators and entrance to the marina, and may exist an extended period of time before or after a large vessel has passed the entranced; therefore, boaters are cautioned to remain clear of the areas.until a YELLOW signal appears and water conditions have calmed. Vessels are not permitted to moor themselves to the wave attenuators or steel pier while waiting for vessels in the Arthur Kill to pass. • In the event that the signal system is not operational or appears RED for an extended period without an obvious vessel traversing the Arthur Kill, the boater shall immediately contact the Carteret Marina Harbormaster for further instruction. All boaters are provided with copies of the following safety and informational guides which must be reviewed annually at the time of the Marina Safety Training Course: • A quick reference guide to the US Coast Guard's "Rules of the Road ".
