A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA,
SUPPORTING ASSEMBLY BILL 984, THE WITNESS RESPONSIBILITY ACT
WHEREAS, on October 24, 2009, in Richmond, California, a 16 year -old young woman
left her high school dance and was invited to a darkened area on campus. She was beaten,
robbed, and raped by up to 10 attackers. Police think from 15 to 20 people stopped to watch,
take pictures and laugh. No one called the police throughout the 2 hour attack; and
WHEREAS, under current law, any person who reasonably believes that he or she has
witnessed a murder or rape of a person under the age of 14 is required to notify the police, or
face up to a $1,500.00 fine and/or up to 6 months in county jail; and
WHEREAS, as the victim was 16 years -old, witnesses were not required to notify the
police, and only a few of her attackers were held accountable; and
WHEREAS, in an effort to compel witnesses to act, AB 984 (Nava),The Witness
Responsibility Act, would require any individual who witnesses a murder or a rape, regardless of
the age of the victim, to contact law enforcement authorities. Failure to do so is punishable by a
fine of up to $1,500.00 and/or 6 months in county jail. The bill retains all existing protections
for witnesses who have circumstances that would make it unreasonable for them to report the
crime.
NOW, THEREFORE, BE IT RESOLVED, that the city of Carson, California, supports
the Assembly Bill 984 (Nava), The Witness Responsibility Act.
PASSED, APPROVED and ADOPTED this 3`d day of March, 2010.
