AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS, AMENDING
THE RICHLAND HILLS CODE OF ORDINANCES CHAPTER 4, BUSINESS
REGULATIONS, SECTION 4B (4) RELATING TO ADVERTISING RESTRICTED
TO PREMISES OF SALES; SECTION 4B(7), RELATING TO PERMIT RE-
QUIRED FOR HOLDING OF SALE; ADDING 4B(9), PENALTY FOR VIOLA-
TION AND CONTAINING A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND
HILLS, TEXAS:
That Chapter 4, Business Regulations, Section 4B4 be amended to
read as follows:
(4) Advertising of Garage Sale
It shall be unlawful for any person to post, fasten,
or display or so cause to be posted, fastened, or
displayed any garage sale sign on any structure, tree
pole, curb, or elsewhere within the right-of-way of any
public street or upon any public property within the
City of Richland Hills, Texas, or upon any private pro-
perty, real or personal, or mixed within the City of
Richland Hills, Texas, without the express written per-
mission of the owner thereof. With proper approval, a
garage sign may be posted three (3) days prior to the
• sale and must be removed within twenty-four (24) hours
after the close of the sale. No more than five (5) signs
maybe posted for each sale, including any sign in the yard
where the sale is being conducted.
That Chapter 4, Business Regulations, Section 4B(7), be amended to
read as follows:
(7) PERMIT REQUIRED FOR HOLDIPIG OF SALE
No person shall display, offer to sell, or sell such per-
sonal property in the City of Richland Hills without first
procuring a permit from the City of Richland Hills for each
sale, at a cost of three dollars ($3.00) at least twenty-
four (24) hours before the beginning of the display offer-
ing to sell or selling of such used personal property.
Said permit shall be posted upon the sale premise during the
sale.
That Chapter 4, Business Regulations, Section 4B9, be added to read
as follows:
(9) PENALTIES FOR VIOLATION
Any person violating any of the provisions of this section
shall be fined as provided for in Section 1F of Chapter 1,
• and each day of violation thereof shall constitute a separ-
ate offense.
SAVINGS CLAUSE: If any section, subsection, or sentence, clause or
phrase of this ordinance is for any reaons held invalid by a court
of competent jurisdiction, such deicsion or decisions shall not affect
the validity of the remaining portions of this ordinance.
