Home My Public Portal AboutOrdinance No. 565-87 03-09-1987 t ORDINANCE NO. 565 AN ORDINANCE OF THE CITY OF RICHLAND HILLS, TEXAS, ABANDONING A DEDICATED STREET KNOWN AS BETH COURT AND A PORTION OF A DEDICATED STREET KNOWN AS AIRLINE DRIVE IN THE CITY OF RICHLAND HILLS, TARRANT COUNTY, TEXAS; RETAINING EASEMENTS; ORDAINING OTHER MATTERS RELATING TO THE SUBJECT: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, BETH COURT is a dedicated street 50 feet, more or less, in width and lies between Blocks 4 and 5 of the Jordan Addition as shown on the Plat of the Jordan Addition recorded in Volume 388-10, Page 6, of the Plat Records of Tarrant County, Texas; and WHEREAS, AIRLINE DRIVE is a dedicated street 25 feet, more or less, in width, and lies in a northwesterly to southeasterly direction along the west line of Blocks 4 and 5 and in an easterly direction along the south line of Block 5 of the Jordan Addition all as shown by the Plat thereof recorded in Vol. 388-10, Page 6, of the Plat Records of Tarrant County, Texas; and WHEREAS, BETH COURT and the portion of AIRLINE DRIVE south of the south lines of Lots 1, 2, 3, 4 and 5, Block 4, of the Jordan Addition, as shown by the Plat thereof recorded in Volume 388-10, Page 6, of the Plat Records of Tarrant county, Texas, are in excess of the City's needs and are burdensome for the City to maintain; and WHEREAS, the dedicators of the Jordan Addition have petitioned the City Council of the City of Richland Hills, Texas, to abandon BETH COURT and the portion of AIRLINE DRIVE so described above; and WHEREAS, the City Council desires to abandon BETH COURT and the portion of AIRLINE DRIVE above described, subject however to the City's retention of water and sewer and utility easements in, on and under said streets: NOW, THEREFORE, PREMISES CONSIDERED, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS. I. Subject to existing utility and municipal services easements and lines, and particularly subject to a 20 foot water and sewer easement described in a certain instrument from L. M. JORDAN and NORMA M. JORDAN to SMITHFIELD WATER COMPANY, a Texas VOA. ~c~~ •Corporation, recorded in Volume 2723, Page 397, of the Deed Records of Tarrant County, Texas; and particularly subject to a 15 foot easement described in a certain instrument from L. M. JORDAN and NORMA JORDAN to TARRANT COUNTY WATER SUPPLY CORPORATION, recorded in Volume 4124, Page 293, of the Deed Records of Tarrant County, Texas, the City Council of the City of Richland Hills, Texas, hereby vacates, abandons, and releases BETH COURT and the portion of AIRLINE DRIVE lying south of the south lines of Lots 1, 2, 3, 4, and 5, Block 4, Jordan Addition, according to the Plat thereof recorded in Volume 388-10, Page 6, Plat Records of Tarrant County, Texas. II. The City of Richland Hills hereby reserves unto itself easements for present and existing utility and municipal service lines, in, on, over and under the above described vacated and abandoned BETH COURT and portion of AIRLINE DRIVE. The City of Richland Hills further reserves the right to install utility i lines on such vacated and abandoned property in the future without payment of compensation for the use of such property. III. The abandoned and vacated property described above will be placed on the tax roll and assessed to the property owners adjacent to such property. IV. The City of Richland Hills, Texas, makes no warranty or assurance of title to anyone in connection with, or as a result of, this abandonment. V. This Ordinance shall be effective from and after the passage hereof and it is so Ordered.
