Mayor Yu called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember-Bium, Chavez, Vizcarra, Sternquist, Yu ABSENT: Councilmember-None ALSO PRESENT: City Manager Pulido, Acting City Clerk Kuo, Assistant to the City Manager Haworth, Administrative Services Director Hause, Parks & Recreation Director Burroughs, Community Development Director Masura, and Community Preservation Supervisor Sahagun. 3. INVOCATION Pastor John Aitken II, Pastor of Temple City Seventh-Day Adventist Church, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop 169 led those present in the Pledge of Allegiance. 5. CEREMONIAL MATTERS-PRESENTATIONS A INTRODUCTION OF TEMPLE CITY'S SISTER CITY EXCHANGE STUDENTS Nancy Terry, Sister City Organization, presented the six Temple City students who will soon be visiting the City's Sister City of Hawkesbury, Australia. The students are Rachel Johnston, Mackenzie Byers, Kai Ito, Joy Huang, Haley Osborn and Betty Wang. B. RECOGNITION OF 2011-2012 YOUTH COMMITTEE MEMBERS Councilmember Chavez recognized Youth Committee members Amber Lee, Anita Velazquez, Carly Loveland and Kyle Evanko for their dedication to the Committee and doing great projects throughout the year. Not present at the meeting were committee members Jane Li, Justin Lin and Bailee Weisz. C. RECOGNITION OF MR. ROBERT ACOSTA AND MRS. JANE CHAVEZ City Council Minutes June 19, 2012 Page 2 Council presented Mr. Acosta and Mrs. Chavez with Certificates of Recognition and Captain Nee from the Temple Sheriff's Station presented them each with a Letter of Commendation. Mr. Acosta and Ms. Chavez helped to apprehend suspicious persons on February 29, 2012. They took the time to call the Sheriff's department and were instrumental in identifying the suspects. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA City Manager Pulido removed the proposed agreement with the Los Angeles County Animal Control from Consent Calendar Item D for three months to allow staff time to evaluate additional proposals from the San Gabriel Valley Humane Society, Pasadena Humane Society and Los Angeles County Animal Control. Jo Beckwith, Temple City Resident, spoke against the City contracting with Los Angeles County Animal Control for services. Mary Sneed, Temple City Resident, thanked Mayor ProTem Sternquist and City Hall staff for giving her class a tour of City Hall. She spoke against the City contracting with Los Angeles County Animal Control for services. Yvonne Wang, Helen Cheung, William Walker and Wen-Hui Liao, Temple City Residents, expressed concerns over the traffic that will be created as a result of the Gateway Project at the north-east corner of Rosemead Boulevard and Las Tunas Drive. Pam Dugan and Karen Scauzillo, Temple City Residents, expressed concerns over the increase in registration fees for the recreational classes. Council was asked to reconsider the increases. Tony Scaduto, 5420 El Monte Avenue, was upset with the response he received from staff during a Neighborhood Watch meeting when he asked why he had to trim his front yard hedges below 36 inches. 7. CONSENT CALENDAR City Manager Pulido removed the agreement with Los Angeles Animal Control from item D of the consent calendar, Administrative Services Director Hause pulled item K, Councilmember Vizcarra pulled item I and Mayor Yu made a correction to the Regular City Council Meeting Minutes of June 5, 2012 to reflect Councilmember Blum's "no" vote to the adoption of Ordinance No. 12-953 amending Council Expense and Compensation. PLANNING COMMISSION ACTIONS MEETING OF JUNE 12, 2012 Recommended Action: Receive and file C. RESOLUTION NO. 12-4818 DESIGNATING CITY HOLIDAYS FOR FISCAL YEAR (FY) 2012-13 Recommended Action: Adopt Resolution designating City holidays for FY 12-13 D. APPROVAL OF VARIOUS SERVICE AGREEMENTS FOR FISCAL YEAR (FY) 2012-13 Recommended Action: Approve various service agreements and authorize the City Manager to sign E. CONSIDERATION OF A RATE ADJUSTMENT REQUEST FOR WASTE SERVICES FROM ATHENS SERVICES, INC. Recommended Action: Approve the rate adjustment request by Athens Services per the provision of their agreement F. REAFFIRMATION OF COMMITTED AND ASSIGNED FUND BALANCE CLASSIFICATIONS FOR THE GENERAL FUND FOR FINANCIAL STATEMENT REPORTING PURPOSES AT JUNE 30, 2012, IN ACCORDANCE WITH THE ADOPTED GASB 54 FUND BALANCE POLICY Recommended Action: Reaffirm the Committed Fund Balance of $4,500,000 and the Assigned Fund Balance of $17,200,000 for the General Fund City Council Minutes June 19, 2012 Page4 G. FISCAL YEAR (FY) 2012-13 INVESTMENT POLICY Recommended Action: Adopt Resolution No. 12-4829 establishing the Investment Policy for the City of Temple City for FY 2012-13, as required by law H. RESOLUTION 12-4827 ADOPTING THE FISCAL YEAR (FY) 2012-13 GANN LIMITATION AND CONFIRM THE FACTORS USED FOR CALCULATING THE ANNUAL APPROPRIATIONS LIMIT FOR FY 2012-13 Recommended Action: Adopt Resolution 12-4827 confirming the factors used for calculating the annual Appropriations Limit for Fiscal Year 2012-13 J. PETTY CASH AND VISA CARD REPORT Recommended Action: Receive and file L. FOURTH QUARTER BUDGET AMENDMENTS Recommended Action: Approve the fourth quarter budget amendments and amend the adopted budget accordingly I. RESOLUTION NO. 12-4828 APPROVING FULL-TIME AND PART-TIME EMPLOYEES' CLASSES AND SALARY RANGES FOR FISCAL YEAR 2012-13 AND AMENDING THE PERSONNEL RULES AND REGULATIONS Administrative Services Director Hause gave a brief overview of her staff report and answered Councils' questions. Councilmember Vizcarra moved to approve adoption of Resolution No. 12-4828 approving full-time and part-time employee's classes and salary ranges for Fiscal Year 2012-13 and amending the Personnel Rules and Regulations, seconded by Mayor Pro Tern Sternquist and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: ABSTAIN: Councilmember-Bium, Sternquist, Vizcarra, Yu, Chavez Councilmember-None Councilmember-None Councilmember-None K. ADOPTION OF RESOLUTION NO. 12-4831 -APPROVAL OF PAYMENT OF BILLS City Council Minutes June 19, 2012 Page 5 Administrative Services Director Hause stated that corrections will be made to the payment of bills to reflect the changes made to Councilmember Vizcarra and Mayor Pro Tern Sternquist's reimbursement of expenses for the California Contract Cities seminar. 8. UNFINISHED BUSINESS A. ADOPTION OF RESOLUTION NO. 12-4830, ORDERING THE LEVY OF CITYWIDE LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR (FY) 2012-13 Administrative Services Director Hause reviewed her staff report, stating this public hearing was scheduled to allow public input on the Fiscal Year (FY) 2012-13 assessment of the Citywide Lighting and Maintenance District. Mayor Yu opened public hearing. Mayor Yu closed public hearing. Councilmember Blum moved to adopt Resolution No. 12-4830, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ORDERING THE LEVY AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR 2012-13 WITHIN THE CITYWIDE LIGHTING AND MAINTENANCE DISTRICT, PURSUANT TO THE STATE LANDSCAPING AND LIGHTING ACT OF 1972 AND AUTHORIZING THE ADDITION OF SPECIAL ASSESSMENT FEES TO THE TAX BILLS, seconded by Councilmember Vizcarra and unanimously carried. 9. NEW BUSINESS A. ADOPTION OF THE DRAFT FISCAL YEAR (FY) 2012-13 CITY BUDGET, FINDING THAT THE CITY IS IN COMPLIANCE WITH GOVERNMENT CODE SECTION 66000 AND APPROVE A ONE-TIME CARRYOVER APPROPRIATION FUNDING FOR THE CHAMBER OF COMMERCE AND PUBLIC ART ADVISORY GROUP Administrative Services Director Hause provided an overview of her report of the proposed budget for next fiscal year via a power point presentation. Mayor Yu opened public hearing. Jerry Jambazian, Temple City Business Owner, spoke in favor of City Budget adoption. Mary Kokayko, Temple City Resident, asked about City's AM radio station. City Council Minutes June 19, 2012 Page 6 Peter Choi, President of Temple City Chamber of Commerce reported on the activities of the Chamber for the past 6 months. Spoke in favor of the Chamber Supplemental Fund roll over to the next fiscal year. Mayor Yu closed Public Hearing. Councilmember Blum moved to adopt Resolution No. 12-4826, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADOPTING THE CITY BUDGET AND APPROPRIATING REVENUE OF THE CITY FOR THE FISCAL YEAR 2011-2012; and adopt Resolution No. 11-4760, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CONFIRMING THE FACTORS USED FOR CALCULATING THE ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2011- 2012, seconded by Councilmember Chavez and unanimously carried. Councilmember Blum moved to approve a one-time carry-over appropriation from the Fiscal Year (FY) 2011-12 FY City Budget of $25,000 for the supplemental funding allocation to the Chamber of Commerce, seconded by Mayor Pro Tem Sternquist and unanimously carried. Councilmember Blum moved to approve a one-time carryover appropriation from the FY 2011-12 City Budget of $15,000 for the Public Art Advisory Group for consulting service, seconded by Councilmember Vizcarra and unanimously carried. B. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 12-956, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING CHAPTER 6 OF TITLE 3 OF THE TEMPLE CITY MUNICIPAL CODE REGARDING ANIMAL CONTROL AND ADOPTING BY REFERENCE TITLE 10, ANIMALS, OF THE LOS ANGELES COUNTY CODE Community Preservation Supervisor Sahagun & City Prosecutor Eckart, gave an overview of the staff report. Councilmember Vizcarra made a motion to introduce Ordinance No. 12- 956 for first reading by title only, amending Chapter 6 of Title 3 of the Temple City Municipal Code regarding animal control and adopting by reference Title 10, Animals, of the Los Angeles County Code; and scheduled the public hearing and second reading of Ordinance 12-956 for July 3, seconded by Mayor ProTem Sternquist and unanimously carried. RECESS/RECONVENE City Council Minutes June 19, 2012 Page 7 The City Council meeting was recessed at 9:17 p.m. and reconvened at 9:27 p.m. with all Councilmembers present C. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 12-957, AN ORDINANCE AMENDING TITLE 1, CHAPTERS 2 AND 4 TO OF THE TEMPLE CITY MUNICIPAL CODE (ADMINISTRATIVE CITATION ORDINANCE & FINE RESOLUTION) Community Preservation Supervisor Sahagun and City Prosecutor Eckart gave an overview of the staff report and informed Council that the Fine Resolution will be presented to Council at the next City Council meeting of July 3'd Mayor Yu opened public hearing. Mayor Yu closed public hearing. Councilmember Chavez made a motion to introduce Ordinance No. 12- 957 for first reading by title only, amending Chapter 2 (Enforcement of the Code) and Chapter 4 (Administrative Citations) of Title 1 (General Provisions) of the Temple City Municipal Code; and waived further reading of Ordinance No. 12-957, seconded by Mayor Pro Tem Sternquist and unanimously carried. D. CONSIDERATION OF A REQUEST FROM ED! MEDIA TO THE CITY TO CONSIDER HOSTING AND CO-SPONSORING THE "2012 FULL MOON HAPPY FAMILY FESTIVAL" ON SEPTEMBER 15 City Manager Pulido gave an overview of the staff report and Mr. Jack Zhao, Vice General Chair of ED! Media, reviewed the activities involved in putting together the Festival. Mayor Yu opened public comment Marv Kokayko, Temple City Resident, spoke against having the event this year. Mayor Yu closed public comment Council directed staff to work with ED! Media Inc. to bring details on the particulars of putting together the "2012 Full Moon Happy Family Festival" on July 3rd so that Council can reconsider the request for hosting and co- sponsoring the event 10. COMMUNICATIONS-None City Council Minutes June 19, 2012 Page 8 11. ACTIONS TAKEN BY CITY AS SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY A. ADOPTION OF RESOLUTION NO. 12-4832-SA -APPROVAL OF PAYMENT OF BILLS Recommended Action: Adopt Resolution No. 12-4832-SA authorizing payment of bills. 12. UPDATE FROM CITY MANAGER City Manager Pulido announced that Connect magazine is now available and if any resident has not yet received a copy to call City hall and one will be delivered to their residence. City Concert series starts tomorrow and will continue every Wednesday at 7pm until August 29. Movies in the Park will start on June 29 at 8 p.m. and continue every Friday until August 10. City Hall will be closed on 4th of July for Independence Day. Lastly, City Manager Pulido reported to Council and residents that efforts are being made by staff to improve the City's environment from the cleanliness of the parks to City Hall landscape and facade. We want everyone to feel welcome in our City. 13. MATTERS FROM CITY OFFICIALS-None 14. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Blum reported on the meetings for League of California Cities and City Selection Committee. He also announced that the Commission Appointment Ad Hoc Committee (i.e., Councilmember Blum and Chavez) has narrowed down four candidates for each of the Commissions and recommended final interview for the candidates in front of full Council on June 25 at 6:30 pm. Council concurred to the date and time of the special meeting and directed staff to contact the final applicants for interview on Monday, June 25 at 6:30 p.m. in the City Council Chamber. Councilmember Chavez reported on the School District/City Standing Committee meeting of June 18 and announced that a Joint School District/City Council meeting has been set for July 12, 2012. Mayor Pro Tem Sternquist reported on the meeting for Mosquito Vector Control and the Foothill Transit She stated that the Foothill Transit may be willing to sponsor a City events/projects and directed staff to follow up with them. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER BLUM City Council Minutes June 19, 2012 Page 9 Announced that he attended the Pasadena Chalk Art Festival. He thought it was a great event and would like to see a similar event in Temple City. B. COUNCILMEMBER CHAVEZ Announced that he also attended the Chalk Art Festival in Pasadena and would also like to have a similar event for our City. Councilmember Chavez reported that he attended the Boy Scouts' Religious Diversity Hike last Saturday and thought it was a great event and hoped this event will be brought back every year. Councilmember Chavez thanked staff for the work done in putting together the Citizen's Academy. The third session is scheduled for this Thursday at 7 p.m. at the City Yard. He commented that a good number of the commission applicants are participants of the Citizen's Academy. C. COUNCILMEMBER VIZCARRA Encouraged everyone to shop at the Farmers Market set up at the City Hall parking lot every Sunday 8:30a.m. to 12:30 p.m. rain or shine. D. MAYOR PROTEM STERNQUIST Reminded the public to come and enjoy the concert in the park tomorrow night and encouraged the public to visit the Relay for Life booth at the park during the concert. E. MAYOR YU Thanked Mayor Pro Tern Sternquist for facilitating the last Council meeting and commented that he enjoyed the visit from the Cloverly Elementary School. 16. REIMBURSEMENTS OF EXPENSES PAID TO OFFICIALS FOR CONDUCT OF CITY BUSINESS Recommended Action: Approve the reimbursement of expenses paid to officials for conduct of City business and approve corrections made to reimbursement amount paid to Councilmember Vizcarra and Mayor Pro Tern Sternquist for expenses from the California Contract Cities Seminar. The correct amount of reimbursement for both is $230.74. 17. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA-None 18.
