HomeMy Public PortalAboutOrdinance No. 568A-87 06-22-1987 • ORDINANCE N0. 568-A AN ORDINANCE AMENDING ORDINANCE N0. 420 OF THE CITY OF RICHLAND HILLS, TEXAS, SECTION 13. OPERATIONAL STANDARDS. PARAGRAPH J. EDUCATIONAL ACCESS CHANNELS; AND PARAGRAPH K. PUBLIC ACCESS CHANNELS, PROVIDING FOR ONE (1) EDUCATIONAL ACCESS CHANNEL AND ONE (1) PUBLIC ACCESS CHANNEL; ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE, WHEREAS, the City Council of the City of Richland Hills, Texas adopted ORDINANCE N0. 420, on May 7, 1979 and thereby granted a franchise to Tarrant Cable Communications, Inc., which franchise has been assigned to Sammons Communications, Inc. of Fort Worth; and WHEREAS, Sammons Communications, Inc. has requested the City Council of the City of Richland Hills, Texas, to combine programming currently contained on municipal access, public • access, NASA (educational access) and local originating programming onto Channel 5 received in the City of Richland Hills, Texas; and WHEREAS, Tarrant County Junior College uses Channel 11 for educational access and the other educational access channel is not currently being used; and WHEREAS, Sammons Communications, Inc. will provide Channel 4 or such other channel as may be available if deemed necessary by the City Council of the City of Richland Hills, Texas for public education and city needs; NOW, THEREFORE, PREMISES CONSIDERED, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS THAT: ~ I . ORDINANCE N0. 420 of the City of Richland Hills, Texas, Section 13. OPERATIONAL STANDARDS. Paragraphs J. Educational Access Channels, and K. Public Access Channels, be and they are hereby amended to read as follows: ."J. Educational Access Channel. At least one channel shall be reserved for the use of the educational authorities in City. Such channel shall be provided free of charge." .."K. Public Access Channel. At least one channel shall be reserved for the use of the public, which shall have nondiscriminatory access without charge on a first come, first serve basis." II. The City Council of the City of Richland Hills, Texas reserves the right to require franchisee to furnish at least one other channel for public educational and city use if the City Council deems necessary. III. SEVERABILITY If any provision, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity of the remaining portions of this ordinance. It is the intent of City in adopting this ordinance that no portion or provision thereof shall become inoperative or fail by reason of any invalidity or unconstitutionality of any other portion or provisions, and to this end all provisions of this ordinance and of the franchise ordinance so amended are declared to be severable. IV. PUBLICATION The caption of this ordinance shall be published in the official newspaper of the City of Richland Hills, Texas. Further, copies of the ordinance shall be made available by the City Secretary, City of Richland Hills, Texas, upon request, to any person interested therein. V. EFFECTIVE DATE This Ordinance shall be effective from and after its passage and publication, and it is so ORDERED.
