AN ORDINANCE AMENDING CHAPTER 3, BUILDING
REGULATIONS, SECTION 2: GENERAL BUILDING
PERMIT REQUIREMENTS, BY ADDING A NEW
SENTENCE TO SUBSECTION C PROVIDING THAT
SUBSECTION C SHALL NOT APPLY TO PROPERTY
ZONED FOR USES OTHER THAN RESIDENTIAL:
REPEALING ALL OTHER ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND
HILLS, TEXAS:
I.
That Chapter 3, BUILDING REGULATIONS, SECTION 2: GENERAL
BUILDING PERMIT REQUIREMENTS, be amended by adding a new last
sentence to subsection C providing that Subsection C shall not
apply to property zoned for uses other than residential. Such
amendment, underscored for emphasis shall read as follows:
C. BUILDING PERMITS NOT TO BE ISSUED IF IN VIOLATION OF
EXISTING DEED RESTRICTIONS.
No building permit shall be issued if the proposed
construction violates any existing deed restrictions
applicable to the property on which the improvements are
to be constructed. No building permit shall be issued
for building(s) or construction on property which has
been subdivided in violation of existing deed
restrictions. It is the responsibility of a person
applying for a building permit to furnish the City with
a copy of deed restrictions applicable to property on
which a building permit is sought. This paragraph shall
not apply to property which has been zoned for a use
other than residential.
II.
All ordinances or parts of ordinances in conflict with
any of the provisions of this ordinance are hereby repealed
insofar as the same are in conflict with the provisions hereof.
III.
The caption of this Ordinance stating in substance the
purpose of this Ordinance and the penalty of this Ordinance
shall be published one time in the official newspaper of the
City of Richland Hills, Texas, upon passage thereof.
IV.
That this Ordinance shall be in full force and effect
- from and after its passage and publication as required by law.
PRESENTED AND PASSED by the City of Richland Hills, Texas,
by a vote of 4 "AYES" and p "NAYS" and
"ABSTENTIONS", this the 13th day of JULY , 1987.
