ORDINANCE NO. 5 7 5 AN ORDINANCE AMENDING SUBSECTION B(2) OF SECTION 13, "C-2 GENERAL COMMERCIAL DISTRICT" OF CHAPTER 12, "ZONING" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS; ALLOWING OUTSIDE STORAGE AND DISPLAY FOR SALE OF LARGE ITEMS WHICH ARE STRUCTURALLY PERMANENT AND DESIGNED TO BE MARKETED FOR RESIDENTIAL USE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been brought to the attention of the Richland Hills City Council that certain inequities exist under the current zoning ordinance of the City; and WHEREAS, the City Council now desires to correct said inequities. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of , Richland Hills, Texas: I. That Subsection B(2) of Section 13, "C-2 General Commercial District" of Chapter 12, "Zoning" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: (2) No use hereunder shall be permitted if said use entails storage or display of items for sale not enclosed by a building; provided that incidental display for sale of seasonal retail items, and display for sale of structurally permanent items which are designed to be marketed solely for residential use shall be permitted, but only if such display occupies no more than ten (10%) per cent of the total lot area. II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
