Mayor Yu called the City Council Regular Meeting to order at 7:30 p.m. in the Council Chambers located at 5938 Kauffman Avenue , Temple City. PRESENT: ABSENT: Councilmember-Bium, Chavez, Vizcarra, Sternquist, Yu Councilmember-None ALSO PRESENT: City Manager Pulido, City Clerk Kuo, Administrative Services Director Hause, Parks & Recreation Director Burroughs, Community Development Director Masura, Community Preservation Supervisor Sahagun and Public Safety Officer Ariizumi. 3. INVOCATION Pastor Andrew Kikkert, Pastor of Sunrise Community Church, provided the Invocation. 4. PLEDGE OF ALLEGIANCE 5 . CEREMONIAL MATTERS-PRESENTATIONS A. ADOPTION OF RESOLUTION NO. 12-4836-PLANNING, PARKS AND RECREATION, AND PUBLIC SAFETY COMMISSION APPOINTMENTS Mayor Pro Tern Sternquist moved to adopt Resolution No. 12-4836 confirming the following appointments : Steve Curran and Tom O'Leary to the Planning Commission; Donna Georgina and Pam Vigil to the Parks and Recreation Commission; and Ousama Nimri and Danny Redmond to the Public Safety Commission, each with terms of office ending June 30, 2014, seconded by Councilmember Blum and unanimously carried by the following roll call vote: AYES: NOES: ABSENT: ABSTAIN: Councilmember-Bium, Chavez, Vizcarra, Sternquist, Yu Cou ncilmember -None Councilmember-None Councilmember-None B. PRESENTATION TEMPLE CITY NATIONAL LITTLE LEAGUE ALL STAR TEAMS City Council Minutes July 3, 2012 Page 2 Councilmember Chavez introduced the All Star Team Players and Coaches to Council. C . PRESENTATION TEMPLE CITY HIGH SCHOOL BASEBALL TEAM Mayor Yu presented a certificate of recognition to the team coach and players. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA-None 7. CONSENT CALENDAR City Manager Pulido pulled item 7 A-2 and item 7F from the consent calendar. Council member Blum moved to approve the remainder of the Consent Calendar, seconded by Mayor Pro Tern Sternquist and unanimously carried by the following roll call vote : AYES: NOES: Councilmember-Bium, Chavez, Vizcarra, Sternquist, Yu Councilmember-None ABSENT: Councilmember-None ABSTAIN : Councilmember-None B. PARKS AND RECREATION COMMISSION ACTIONS-MEETING OF JUNE 20, 2012 The City Council is requested to review actions of the June 20, 2012 Parks and Recreation Commission meeting . Recommended Action : receive and file C . PUBLIC SAFETY COMMISSION ACTIONS -MEETING OF JUNE 13 , 2012 The City Council is requested to review actions of the June 13, 2012 Public Safety Commission meeting. Recommended Action : receive and file D. DESIGNATION OF VOTING DELEGATE AND ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE TO BE HELD SEPTEMBER 5 THROUGH 7, 2012 The City Council is requested to designate Councilmember Blum as Voting Delegate and Mayor Yu as Voting Alternate for the League of California Cities Annual Business Meeting on September 7, 2012. City Council Minutes July 3, 2012 Page 3 Recommended Action: designate Councilmember Blum as Voting Delegate and Mayor Yu as Voting Alternate E. SECOND AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH GLADWELL GOVERNMENTAL SERVICES, INC. The City Council is requested to approve the Second Amendment to the Professional Services Agreement with Gladwell Governmental Services , Inc . for on-site consulting services regarding the operation of the City Clerk's office and election management support for the upcoming March 2013 municipal election. Recommended Action: approve the Second Amendment to the Professional Services Agreement G. TEMPLE CITY CHAMBER OF COMMERCE ANNUAL AGREEMENT The City Council is requested to approve the proposed annual agreement with the Temple City Chamber of Commerce. Approval of the proposed annual contract preserves the mutual partnership between the City and Chamber, while allowing the organization to operate as an independent entity. Recommended Action: approve the annual agreement H . ADOPTION OF RESOLUTION N0.12-4837 -APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No . 12-4837 authorizing the payment of bills . Recommended Action : adopt Resolution No . 12-483 7 A APPROVAL OF MINUTES The City Council is requested to review and approve : 1) Minutes of the Regular City Council Meeting of June 19, 2012 2) Minutes of the Special City Council Meeting of June 21, 2012 3) Minutes of the Special City Council Meeting of June 25 , 2012 4) Minutes of the Special City Council Meeting of June 27, 2012 City Council Minutes July 3, 2012 Page4 City Manager Pulido pulled item 7 A-2 to make a correction that the meeting location for the Special City Council meeting of June 21, 2012, took place at the City Yard and not the City Hall Community Room . F. RESOLUTION NO. 12-4835 ADDING FULL AND PART-TIME POSITIONS TO THE CITY'S EMPLOYEE CLASSIFICATION AND PAY RANGE SCHEDULE FOR PARKING CONTROL OFFICER, SENIOR COMMUNITY PRESERVATION OFFICER, PUBLIC SAFETY AND SERVICES MANAGER, MAINTENANCE HELPER, MANAGEMENT ANALYST AND PARK PATROL OFFICER The City Council is requested to adopt Resolution No. 12-4835 adding full and part-time positions and associated salary ranges to the City's employee classification and pay range schedule . Administrative Services Director Hause pointed out that the wrong job description was attached as Exhibit 6 for the Parking Control Officer. Administrative Services Director Hause requested Council to adopt the Resolution as amended adding to the class specification and salary range full-time designation to the positions of: Parking Patrol Officer, Senior Community Preservation Officer and Public Safety and Services Manager; and part-time designation to the Maintenance Helper, Management Analyst and Park Patrol Officer. Councilmember Vizcarra made a motion to adopt Resolution 12-4835 as amended adding the proposed new classifications and corresponding salary ranges to the City's Personnel Rules and Regulations, seconded by Mayor Pro Tern Sternquist and unanimously carried. 8. UNFINISHED BUSINESS A . SECOND READING AND ADOPTION OF ORDINANCE NO. 12-957, AN ORDINANCE AMENDING TITLE 1, CHAPTERS 2 AND 4 OF THE TEMPLE CITY MUNICIPAL CODE (ADMINISTRATIVE CITATION ORDINANCE AND FINE RESOLUTION) The City Council is requested to waive further reading and adopt Ordinance No. 12-957 by title only. Community Preservation Supervisor Sahagun & City Prosecutor Eckart, gave an overview of the staff report. Councilmember Blum made a motion to waive further reading and adopt Ordinance No. 12-957 by title only, an Ordinance amending title 1, Chapters 2 and 4 of the Temple City Municipal Code (Administrative City Council Minutes July 3, 2012 Page 5 Citation Ordinance and Fine Resolution) seconded by Councilmember Chavez and unanimously carried. B. PUBLIC HEARING, SECOND READING, AND ADOPTION OF ORDINANCE NO. 12-956, AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING CHAPTER 6 OF TITLE 3 OF THE TEMPLE CITY MUNICIPAL CODE REGARDING ANIMAL CONTROL AND ADOPTING BY REFERENCE TITLE 10 ("ANIMALS") OF THE LOS ANGELES COUNTY CODE The City Council is requested to conduct a public hearing , second reading, and adoption of Ordinance No. 12-956. City Prosecutor Eckart, highlighted the major changes to the City's Ordinance should Council adopt by reference Title 10 (Animal) of the Los Angeles County Code. Councilmember Vizcarra left the meeting at 8:14p.m. and returned to the meeting at 8 :16p.m. Mayor Yu opened public hearing . Mary Kokayko, Temple City resident, spoke in opposition of adopting the ordinance. Pat Brayers, Temple City Humane Society, spoke in opposition of adopting the ordinance . Mathew Wong, Temple City resident, spoke in opposition of adopting the ordinance. Robert Westgate, Temple City resident, wanted to know how effective this ordinance would be in dealing with the neutering of pets . Pat Brayers, Temple City Humane Society, reported that last year the shelter admitted 742 stray animals from City of Temple City and provided other information. Steve Goold and Joseph Chung, both from local Boy Scout Troops, spoke in opposition of requiring neutering of animals. Mayor Pro Tern Sternquist made a motion to continue the item, with a date to be determined for staff to conduct public outreach and come back to Council in September/October with recommendations for possible amendment to Title 1 0, seconded by Councilmember Blum and unanimously carried. City Council Minutes July 3, 2012 Page 6 The City Council meeting was recessed at 9:20 p.m. and reconvened at 9:29 p .m. with all Councilmembers present. C. REQUEST FROM EDI MEDIA FOR THE CITY TO HOST AND CO- SPONSOR THE 2012 FULL MOON HAPPY FAMILY FESTIVAL The City Council is requested to consider whether the City will host and co-sponsor the 2012 Full Moon Happy Family Festival on September 15, 2012. Assistant to the City Manager Haworth gave an overview of the staff report. Mayor Yu opened public comment. Peter Choi, President of Temple City Chamber of Commerce, spoke tentatively in support of this event. Chamber is in concept willing to work with EDI but needs approval from the Chamber's governing board . Jerry Jambazian, Temple City business owner, spoke in favor of the event but has concerns about the impact of the event to the residential neighborhood and lack of involvement from local organizations. Dina Piraino, Temple City resident, spoke in opposition of the event. Jack Zhao, Vice General Chair of EDI Media, expressed that Temple City businesses are deserving of the exposure this event will bring. Mayor Yu closed public comment. Mayor Pro Sternquist made a motion to approve the City's co-sponsorship and hosting of the 2012 Full Moon Happy Family Festival on September 15, 2012 and directed staff to report back to Council on the first Council meeting in August and advise if all the conditions have been met, seconded by Councilmember Chavez and unanimously carried . 9. NEW BUSINESS A . PUBLIC HEARING REGARDING TENTATIVE TRACT MAP 71792 AND CONDITIONAL USE PERMIT 12-1803 FOR THE CONSTRUCTION OF A CONDOMINIUM PROJECT CONSISTING OF NINE UNITS AT 6126 AND 6132 TEMPLE CITY BLVD. (DEXTER CORPORATION/HANK JONG) The proposed project is a residential development consistent with the City's prescribed development standards . Traffic impact will be City Council Minutes July 3, 2012 Page 7 insignificant and staffs preliminary review indicates that the project is categorically exempt under Article 19, Section 15322 of California Environmental Quality Act. Mayor ProTem Sternquist recused herself as the project is adjacent to her residence . Associate Planner Liu gave an overview of her staff report. Representative from Dexter Development asked for Council 's approval of the proposed project. Mayor Yu opened public comment. Mary Kokayko, Temple City resident , spoke in favor of the project. Mayor Yu closed public comment. Councilmember Chavez made a motion to approve Conditional Use Permit 12-1803 and Tentative Tract Map of 71792 ; and adopt Resolution No . 12-4834 to approve Conditional Use Permit 12-1803 and Tentative Tract Map 71792, seconded by Councilmember Blum and unanimously carried. 10. COMMUNICATIONS-None 11. ACTIONS TAKEN BY CITY AS SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY A. FEE AGREEMENT TO PROVIDE GENERAL COUNSEL SERVICES TO THE OVERSIGHT BOARD OF THE SUCCESSOR AGENCY TO THE FORMER TEMPLE CITY REDEVELOPMENT AGENCY The City Council as the Successor Agency to the former Temple City Redevelopment Agency is requested to approve a fee agreement for general counsel services to the Oversight Board of the Successor Agency to the former Temple City Redevelopment Agency. Administrative Services Director Hause gave a brief overview of her staff report. Councilmember Blum made a motion to approve fee agreement for general counsel services to the Oversight Board of the Successor Agency to the former Temple City Redevelopment Agency, seconded by Councilmember Chavez and unanimously carried . City Council Minutes July 3, 2012 Page 8 RECESS TO FINANCING AUTHORITY MEETING At 10:47 p .m ., the City Council recessed to the Financing Authority Meeting . City Attorney Vail reported that pursuant to AB x1 26 , the Temple City Community Redevelopment Agency no longer exists. Given the Financing Authority's joint powers arrangement between the City and its former Redevelopment Agency, the Financing Authority no longer exists . RECONVENE AS CITY COUNCIL The City Council meeting was reconvened at 1 0:50 p.m . with all Councilmembers present. 12. UPDATE FROM CITY MANAGER City Manager Pulido announced that: City Hall and the Live Oak Park Annex will be closed for the 4th of July, but Live Oak Park will be open from 10 a .m. to 10 p .m .; no summer concert tomorrow on 4th of July, but concerts will resume the following Wednesday, July 11th at 7 :30 p .m .; summer recreation classes begin July 91h, residents can still sign up for classes if they haven't already done so; the next Movies in the Park is on Friday, July 131h at 8 p .m.; Rabies Clinic is on also on Friday, July 131h from 6 :30 p.m . to 8 p .m. at the Temple City Park and vaccination will be offered at $5 for each dog or cat; Athens Services and the City will host the second Annual Compost Giveaway Saturday, July 14th from 9 a.m . to 1 p.m . at the City Hall Parking Lot; and the City has been awarded $431,900 in Safe Routes to School Grant funds from Caltrans to implement street and sidewalk improvements near the schools. 13. MATIERS FROM CITY OFFICIALS-None 14. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Blum stepped down from the City Selection Committee and requested Mayor Yu to appoint Mayor Pro Tern Sternquist in his place so she can qualify to fill the vacancy as the County Libraries Representative in District 5 . City Attorney Vail advised Mayor Yu that appointment can be made tonight but an amended resolution will have to be brought back at the next City Council meeting for approval in order to ratify the appointment. Councilmember Chavez reported on the Board of Directors meeting for the County Sanitation District. Councilmember Vizcarra reported on the Art Advisory and San Gabriel Valley Council of Government meeting . 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA City Council Minutes July 3, 2012 Page 9 A. COUNCILMEMBER BLUM w None B . COUNCILMEMBER CHAVEZ Attended the U.S. Geological Survey, Landers 20 1h Anniversary Event. They are working on an advance earthquake warning system for the United States . If there was a big earthquake near the San Andreas Fall , the early warning system would give us a little over one minute to prepare. C . COUNCILMEMBER VIZCARRA Wanted staff to be aware of a notice that is being delivered to the residents offering insurance in the event you lose water from the street to your house . Councilmember Vizcarra reported that staff and volunteers counted 1539 attendees at the last concert in the park . D . MAYOR PROTEM STERNQUIST Attended the Kiwanis lunch meeting with guest speaker Head Deputy David Demerjian from the Public Integrity Division of District Attorney Steve Cooley's office . Head Deputy Demerjian reported on high-profile cases against local public officials they have successfully prosecuted. Mayor Pro Tern Sternquist also reported that she will be meeting with Foothill Transit to explore the possibility of subsidized fares for students interested in attending Mt. Sac College . E. MAYOR YU Reported on the activities of the Rosemead Blvd Improvement Project. Project will be getting ready to go out to bid . Mayor Yu appo inted himself and Mayor Pro Tern Sternquist to the Las Tunas Drive Streetscape and Pedestrian Improvement Ad-Hoc Committee . 16. REIMBURSEMENTS OF EXPENSES PAID TO OFFICIALS FOR CONDUCT OF CITY BUSINESS-None 17. ADDITIONAL PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City business owner, asked for a status on t he Counc il Chamber renovation . City Council Minutes July 3, 2012 Page 10 18. CLOSED SESSION At the suggestion of City Attorney Vail, the closed session items were moved to the next Regular City Council meeting of July 17. 19.
