AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO.
556, AND AMENDING CHAPTER 6 OF THE PERSONNEL
POLICIES MANUAL OF THE CITY OF RICHLAND HILLS,
TEXAS ADOPTED UNDER THE AUTHORITY OF ORDINANCE
556, TO CLARIFY THE SICK LEAVE POLICIES OF THE
CITY; PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
RICHLAND HILLS, TEXAS, THAT,
I.
That Section 1, Ordinance No. 556, Chapter 6, Personnel
Policies Manual of the City of Richland Hills, Texas, as
amended be hereby amended to hereafter be and read as
follows:
CHAPTER 6, Section 3: SICK LEAVE
3.1 Accumulation Rate
The City of Richland Hills provides sick leave
privileges to its employees to allow recovery from
• personal illness. Abuse of this privilege may be
grounds for disciplinary action. Upon commencement of
employment and after completion of the first complete
regular payroll period, full time employees begin
earning sick leave at the rate of 8 hours per month of
employment for a total of 96 hours per year. Earned
sick leave shall be posted at the end of each two week
payroll period. Employees are eligible to use accrued
sick leave after the first thirty (30) calendar days of
employment.
3.2 Maximum Accumulation
No employee will be permitted to maintain a balance of
over 720 hours of sick leave.
3.3 Sick Leave Not Earned
Sick leave shall not be earned during periods when an
employee is in a leave without pay status, while
receiving Worker's Compensation, or other similar
periods as determined by the City Manager. Employees
shall not be paid for accrued sick leave upon
termination of City employment.
3.4 Failure To Report Illness
• If an employee becomes ill and cannot report for work,
the absence must be reported to the immediate
supervisor within one hour after the regular reporting
time. Failure of employees to properly report an
illness to their supervisor before requesting sick
• leave may cause an employee to be charged leave without
pay.
3.5 Sickness During Holiday
An employee who is on sick leave during a Holiday,
shall be permitted to take the Holiday during the
following pay period.
3.6 Sickness During Vacation
An employee who becomes ill or injured while in a paid
vacation leave status may request that the vacation be
terminated and the time of the illness or injury be
charged to accrued sick leave. The City must be
notified as soon as the employee is sick and not after
the vacation is completed and the employee has returned
to work. A physicians statement may be required in
such instances.
3.7 Physician's Statement
The suppervisor may require a physician's statement
prior to the return of any employee in a sick leave
status for three consecutive 8 hr. work days or two
consecutive 24 hr shift days.
• 3.8 Rate of Use
Sick leave shall be used at a rate commensurate to the
number of hours that the employee remains in a sick
leave status. For example, the number of sick leave
hours used shall result in a similar reduction from the
balance of accrued sick leave.
3.9 Sick Leave Prior to or Following Holiday
Employees using sick leave immediately prior to or
following a holiday may be required to provide a
physician's statement.
3.10 Minimum Leave Time
All sick leave must be taken in increments of not less
than one half hour.
II.
SAVINGS CLAUSE. That the remainder of the Personnel
Policies Manual of the City of Richland Hills, Texas, as
amended, shall remain in full force and effect, save and
except as amended by this ordinance.

SEVERABILITY CLAUSE. That it is hereby declared to be the
intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are
. severable, and if any phrase, clause, sentence, paragraph or
section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any
court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs or sections of this
ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of
any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
IV.
EFFECTIVE DATE. This ordinance shall be in full force and
effect from and after its passage and publication as
provided by the Richland Hills City Charter and the laws of
the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular
meeting of the Richland Hills City Council on the 13 day of
March 1989; by a vote of 4 ayes, 0 nays and
abstentions.
