A RESOLUTION OF THE VILLAGE COUNCIL OF
THE VILLAGE OF KEY BISCAYNE, FLORIDA,
REQUESTING THAT THE FLORIDA DEPARTMENT
OF COMMUNITY AFFAIRS DELEGATE THE
SUFFICIENCY REVIEW OF ITS EVALUATION AND
APPRAISAL REPORT FOR THE VILLAGE MASTER
PLAN TO THE SOUTH FLORIDA REGIONAL
PLANNING COUNCIL, PURSUANT TO SECTION
163.3191(10), FLORIDA STATUTES.
WHEREAS, the Village Council adopted the Key Biscayne Master Plan according
to the requirement of Chapter 163, Part II, Florida Statutes; and
WHEREAS, pursuant to Section 163.3191, Florida Statutes, and Florida
Administrative Code R. 9J-5 and 9J-33, the Village of Key Biscayne is preparing an
Evaluation and Appraisal Report ("EAR") for the Village Master Plan; and
WHEREAS, Section 163.3191(10), Florida Statutes, allows the Florida Department
of Community Affairs ("DCA") to delegate its authority as the State land planning agency
for sufficiency review of EARs to the appropriate regional planning council, while retaining
oversight of the process; and
WHEREAS, DCA entered into an agreement with the South Florida Regional
Planning Council ("SFRPC") to review EARs in Miami -Dade County for sufficiency in
accordance with the prescribed criteria in Section 163.3191, Florida Statutes, and in Florida
Administrative Code R. 9J-5.005, where the local governing body, by vote of a majority of
its membership, requests the delegation in writing; and
WHEREAS, the Village elects to have its EAR reviewed for sufficiency by the
SFRPC in order to obtain a more expeditious review.
NOW, THEREFORE BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, THAT:
Section 1. Recitals Adopted. That each of the above stated recitals is hereby adopted and
confirmed.
Section 2. Request for Delegation of EAR Review to SFRPC. That the Village of Key
Biscayne hereby requests that the Florida Department of Community Affairs delegate the
sufficiency review of its Evaluation and Appraisal Report for the Village Master Plan to the
South Florida Regional Planning Council.
