HomeMy Public PortalAboutOrdinance No. 599-89 08-14-1989 • ORDINANCE NO. 599 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A CLEAN CITY COMMISSION FOR THE PURPOSE OF ASSISTING THE CITY COUNCIL IN ESTABLISHING A CITY-WIDE POLICY FOR REFUSE MANAGEMENT: PROVIDING SPECIFIC CONSTITUENCIES OF THE CITY; DESCRIBING THE DUTIES OF SUCH COMMISSION; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Richland Hills, Texas: SECTION I. That a Clean City Commission is hereby created. for the purpose of assisting the City Council in establishing a city-wide policy for decreasing the amount of loose refuse in the City. • SECTION II. That the Clean City Commission provided for herein shall be comprised of fifteen (15 ) members to be nominated by the Mayor and approved by the City Council and shall be residents of the City. The board shall consist of representatives from: Number of Members Place Number Business & Industry 5 1-5 Labor Representatives 1 6 Community Organizations 4 7-10 Education 3 11-13 Members at Large 1 14 Director of Public Works 1 15 Members of the Commission originally appointed to fill odd- numbered places 1 through 15 shall be appointed for a term of one (1) year. Members of the Commission originally appointed • to fill even-numbered places 2 through 14 shall be appointed for a term of two ( 2 ) years . No Commission member shall serve two ( 2 ) consecutive terms provided, however, that a Commission member appointed to complete the term or another Commission • member shall, at the completion of such term, be eligible for appointment for another full-term; and provided further, that place 15 shall always be filled by tYie Director of Public Works who shall serve as a non-voting ex-officio member of the Commission . SECTION III. That the Executive Director of the Clean City Commission shall be the non-voting secretary of the Clean City Commission. He/She shall be custodian of all minutes and records of the board and perform such other duties as the Commission may deem necessary and consistent with both the responsibilities of the Commission and his/her responsibilities to the City of Richland Hills through the City Manager and the Director of Public Works. He/She shall be hired by the City Manager and shall be given office space at or near the Department of Public Works. The Executive Director shall work under the supervision and control of the City Manager and/or the Director of Public Works for the purpose of implementing the provisions of this ordinance. SECTION IV. That seven (7) members of the Commission shall constitute a • quorum for the conduct of business. The members of the Commission shall regularly attend meetings and public hearings of the Commission and shall serve without compensation except for reimbursement for authorized expenses attendant to the performance of their duties. The Commission shall hold an organization meeting in May of each even number year and shall elect a Chairman and Vice- Chairman from among its members before proceeding to any other matters of business. The Commission shall meet regularly and shall designate the time and place of its meetings. The Commission shall adopt its own rules of procedures and keep a record of its proceedings in accordance with the provisions of the ordinance and the Charter of the City of Richland Hills. Newly appointed members shall be installed at the first regular meeting after their appointment. Each month a report shall be submitted to the City Council showing the cumulative attendance of each member with notation of members who have been absent from three (3) consecutive meetings. SECTION V. • That the Clean City Commission shall recommend refuse and environmental management policies to the City Council so all City refuse and clean city activities may follow a common purpose. The Commission shall have the following Ordinance No. 599 • responsibilities. 1. Develop City-wide refuse and environmental policy plan(s); 2. Evaluate City actions in light of that policy; 3. Determine and recommend to the City Council management and program priorities on a City-wide basis; 4. Recommend enforcement and additional program alternatives; 5. Monitor City performance from data collected and examined under the Keep America Beautiful, Inc. Keep America Beautiful System guidelines and make an annual report to the City Council; and 6. Carry out such other tasks as the City Council may designate. To accomplish these responsibilities the Commission shall establish sub-committee including, but not limited to, areas • of Business and Industry, Communications, Community Organizations, Municipal Operations and Schools. Each sub-committee will be chaired by a Clean City Commission member with an unspecified number of community volunteers chosen by the Commission as working sub-committee staff. SECTION VI. That office space, supplies, telephone, postage and secretarial support for the Executive Director shall be furnished by the City within the budgetary appropriation process. Additional funds for Commission activities involving travel or training for the Executive Director shall also be supplied by the city within Council imposed budgetary restraints. The Executive Director will serve in a Volunteer capacity. Any expenses, whether specifically enumerated in the preceding paragraph or not, may be paid from donations when, as and if same are received by the City from the general public, business, industry, foundations and other sources for the purposes embraced by the scope of the Commission's purpose and responsibilities administered in accordance with standard City policy and practice as governed by statute, charter and ordinance. Ordinance No. 599 • SECTION VII. Severability Clause: That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this Ordinance shall be declared unconstitutional or illegal by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionality or illegality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, since the same would have been enacted by the City Council without incorporation in this Ordinance of any such unconstitutional or illegal phrase, clause, sentence, paragraph or section. SECTION VIII. Effective Date: That this ordinance shall be in full force and effect from and after the date of its passage, and it is so ordained.
