HomeMy Public PortalAboutORD-CC-1993-15ORDINANCE NO. 93-15 An Ordinance amending the Moab City code to establishing minimum fine for certain violations of the zoning ordinance. WHEREAS, Moab City has enacted a zoning and other land use Ordinances, and WHEREAS, violations of Moab City zoning and other land use Ordinances are Class B misdemeanors, and WHEREAS, the City Council of Moab City wants to establish a minimum mandatory sentence for violations of such Ordinances to guide the Courts in enforcement of such Ordinances. NOW THEREFORE, be it ordained by the governing body of Moab City that: Moab City code is hereby amended to include the following section: 1. Any person violating any provision of the Moab City Code shall be given written notice specifying the violation and demanding that the violation be rectified within twenty-one (21) days from the date of said notice. 2. All notices and citations required herein shall be deemed sufficient if delivered or mailed by regular mail, postage prepaid and, in the case of all absentee owners, addressed to such owner at his last known address as disclosed by the records of the County Assessor. 3. Any person violating any of the provisions of the Moab City Code shall be guilty of a Class B misdemeanor and upon conviction thereof shall be punished by fine not to exceed the then maximum fine for a Class B misdemeanor as prescribed by Utah state law or imprisonment in the Grand County Jail for not more than six months or both fine and imprisonment and a minimum fine of $100.00. This Ordinance shall take effect immediately upon passage. DONE IN OPEN COUNCIL THIS 20th DAY OF July A.D., 1993. SIGNED: William D.
