AMENDING & SUPPLEMENTING § 42 -5 OF CHAPTER 42
OF THE CODE OF THE BOROUGH OF CARTERET
BE IT ORDAINED by the Mayor and Borough Council of the Borough of Carteret (the "Borough ") that
the Code of the Borough is hereby amended and supplements as follows:
Section I §42 -5 of Chapter 42 is hereby amended and supplemented to delete the current
Paragraph B thereof and replace it with the following, with the balance of said
Section remaining unchanged:
B. To the extent not otherwise authorized by law, and subject
to the rules and regulations and orders of the Chief of Police:
Special Law Enforcement Officers, Class I, shall have the
additional power to issue summonses for disorderly persons and
petty disorderly persons offenses, violations of municipal
ordinances and violations of Title 39 of the Revised Statutes. The
use of a firearm by an officer of this class shall continue to be
strictly prohibited and no Class I officer shall be assigned any
duties which may require the carrying or use of a firearm. The
Chief of Police may authorize the use of mechanical force
weapons, but such special law enforcement officers must train and
demonstrate proficiency with such mechanical force weapons with
the same frequency as regular police officers.
2. Special Law Enforcement Officers, Class II, are authorized to
exercise powers and duties commensurate with those of a regular
pollee officer. The use of a firearm by such officer may only be
authorized upon successful completion of training and instruction
as required by law and New Jersey Attorney General's
requirements. The Chief of Police may authorize the use of
mechanical force weapons, but such special law enforcement
officers must train and demonstrate proficiency with such
mechanical force weapons with the same frequency as regular
police officers.
Section 2 All ordinances or parts thereof inconsistent with the provision of this ordinance
are hereby repealed limited to the extent of any
such inconsistency.
Section 3 If any section, paragraph, sub - division, clause or provision of this ordinance is
adjudged invalid, such adjudication shall apply only to the section, paragraph,
sub - division, clause or provision so
adjudged and the remainder of this ordinance shall be deemed valid and
effective.
Section 4 This ordinance shall take effect upon its passage and publication according to
applicable law.
