A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, AUTHORIZING AND ESTABLISHING LIMITED
EXCEPTIONS TO THE VESSEL EXCLUSION ZONE
ESTABLISHED PURSUANT TO SECTION 4-32 OF THE
CODE OF KEY BISCAYNE; PROVIDING FOR
LIMITATIONS; PROVIDING FOR IMPLEMENTATION;
PROVIDING FOR EFFECTIVE DATE.
WHEREAS, pursuant to Section 4-32 of the Code of Key Biscayne, Florida, the Village of
Key Biscayne (the "Village") has established a vessel exclusion zone within the area of the Atlantic
Ocean, 300 feet east of the Beach from the southern boundary of Crandon Park to the northern
boundary of Bill Baggs, Cape Florida State Park (the "Vessel Exclusion Zone"); and
WHEREAS, pursuant to Section 4-32 of the Code, it is prohibited to permit or operate any
Vessel within the Vessel Exclusion Zone except as authorized by the Village Council; and
WHEREAS, the Village Council desires to grant certain limited exceptions to the
prohibition set forth in Section 4-32 of the Village Code; and
WHEREAS, the Village Council finds that the establishment of these limited exceptions is
in the best interest of the Village and its residents.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL
OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the recitals stated above is hereby adopted
and confirmed.
Section 2. Exceptions. That the Village Council hereby authorizes the following
exceptions to the prohibition set forth in Section 4-32 of the Village Code:
(1) Non -motorized Vessels operated by individual Village residents may navigate from and
to the beach along a path perpendicular to the shoreline for the sole purpose of directly
traversing through the Vessel Exclusion Zone. This exception does not permit
navigation through the Vessel Exclusion Zone for any other purpose or in any other
direction.
(2) Vessels operated by municipal, county, state or federal government while engaged in
law enforcement or other necessary municipal or governmental tasks.
(3)
Emergency Vessels used solely for the purpose of affecting an emergency/sea rescue.
Section 3. Limitations of Exceptions. That the establishment of these exceptions does
not authorize the operation of any Vessel for any other purpose within the Vessel Exclusion Zone.
Section 4. Implementation. That the Village Manager is hereby authorized to take any
action which is necessary to implement this resolution.
Section 5. Effective Date. That this resolution shall be effective immediately upon
adoption hereof.
