HomeMy Public PortalAboutORD-CC-1993-17ORDINANCE 93-17 AN ORDINANCE AMENDING CHAPTER 17.27 OF THE MOAB MUNICIPAL ORDINANCES REGARDING OBJECTIVE, CHARACTERISTICS AND USE CHANGES TO THE C-4 GENERAL COMMERCIAL ZONE. BE IT ORDAINED BY THE MOAB CITY COUNCIL AS FOLLOWS: That Chapter 17.27 of the Moab Municipal Ordinances shall be amended to read as follows: Sections: 17.27.010 Objectives and characteristics. 17.27.020 Use regulations. 17.27.030 Area, width and location requirements. 17.27.040 Special provisions. 17.27.050 Supplementary regulations. 17.21.010 Objectives and characteristics. A. The C-4 general commercial zone has been established as a district in which the primary use of the land is for business and light industrial purposes. Another objective of the zone is to facilitate the development of attractive entrances to the City. The C-4 zone is characterized by clean, well lighted and landscaped streets, ample pedestrian ways and vehicular parking lots for the convenience and safety of the public. In order to accomplish the objectives and purposes of this title and to promote the characteristics of this zone, the regulations set out in this chapter shall apply in the C-4 zone. 17.27.020 Use regulations. The following uses shall be permitted in the C-4 general commercial zone: 1. Retail establishments and service enterprises; 2. Office buildings; 3. Auto body and fender shops, auto painting, welding and sheet metal shops, electrical appliance shops, plumbing shops, carpenter shops, hardware and retail lumber yards, and assembly of appliances from previously prepared parts; 4. Tire recapping (all activities inside of buildings); 5. Service stations; 6. Beer parlors and alcohol dispensing establishments; 7. Fraternity buildings, clubs, lodges; 8. Funeral establishments, mortuaries and churches; 9. Used car lots, farm equipment sales establishments and parking lots (commercial); 10. Engraving and printing establishments, stone and monument sales establishments, taxidermy shops and secondhand stores; 11. Gymnasium or physiculture establishments; 12. Home occupations (city council approval not required); 13. Pawnshops; 14. Motels and lodging establishments; 15. Cafes, restaurants and food drive-ins; 16. Revival tents (temporary); 17. Utility buildings, schools, hospitals and other public buildings; 18. Signs; 19. Wholesale establishments with stock on premises; 20. Trucking companies subject to city council approval; 21. Auction houses; 22. Caretaker dwellings; 23. Manufacturing, compounding and processing; 24. Pasturing of animals; 25. Recreational vehicle courts subject to requirements set forth in this title; 26. Warehouses, garages, storage buildings and accessory buildings; 27. Dwellings and apartment houses require conditional use approval, except that dwellings above the ground floor shall be permitted. The conditions for permitting dwellings, apartments and court apartments include the following: They shall follow the area, width and location requirements of the R-3 zone, they shall be located at least 150 feet from a major street or highway and they shall follow other conditions deemed necessary by the Planning Commission and City Council; 28. Other uses similar to the foregoing uses which are interpreted by the planning commission to be in harmony with the intent of the zone. 17.27.030 Area, width and location requirements. A. There shall be no area, width and location requirements for commercial and service buildings and structures, except for gasoline pumps and, except that all buildings and structures shall be set back at least twenty-five feet from any public street. 17.27.040 Special provisions. A. A strip of land at least fifteen feet in width adjacent to all public streets shall be landscaped as set forth in Sections 17.12.360-- 17.12.420 of this title, except for permitted driveways. B. No dust, odor, smoke, vibration or intermittent light, glare or noise shall be emitted which is discernible beyond the premises, except for normal traffic movements. C. Storage of all merchandise, material and products shall be carried on within a building or within an area enclosed with a sight -obscuring fence or wall, except for vehicles in running order. D. All off-street parking shall be hard -surfaced. 17.27.050 Supplementary regulations. See also Supplementary Requirements and Procedures Applicable Within Zones (Chapter 17.09 of this title).
