HomeMy Public PortalAboutOrdinance No. 631-91 02-11-1991 • ORDINANCE NO. 6 31 AN ORDINANCE AMENDING PARAGRAPH (11) "PROHIBITED USES" OF SUBSECTION O "HOME OCCUPATIONS" OF SECTION 5 "GENERAL PROVISIONS" OF CHAPTER 12 "ZONING" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS AMENDED, TO ADD WRECKER SERVICES, CONIlViERCIAL WOODWORKING, ROOFING SERVICES AND CONIlVIERCIAL MILLWORK AND/OR CABINETRY TO SAID LIST OF PROHIBITED USES CONTAINED IN SAID PARAGRAPH 11; PROVIDING A SAVING CLAUSE; PROVIDING A ~SEVERABILTTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council finds that wrecker services, commercial woodworking, commercial millwork and/or cabinetry and roofing services, when conducted in residential neighborhoods, tend to impair the residential character of such neighborhoods and also to impair the use and enjoyment of their homes by residents of said residential neighborhoods; and WHEREAS, a recommendation was made to the Planning and Zoning Commission by the Richland Hills Code Enforcement Officer that such uses be added to the list of prohibited uses for home occupations contained in the zoning ordinance of the • City; and WHEREAS, the Planning and Zoning Commission held a public hearing and made a recommendation to the City Council of the City of Richland Hills, Texas, concerning such recommendation by the Code Enforcement Officer; and WHEREAS, the City Council of the City of Richland Hills, Texas, has determined that such an amendment to the Richland Hills zoning ordinance would be in the best interest of the citizens of the City, and would promote the general welfare of its citizens; and WHEREAS, proper notice of a public hearing before the City Council concerning such zoning code regulation amendment has been published as provided by the ordinances of the City and by state law; and WHEREAS, the City Council has held a public hearing in compliance with City ordinances and state law concerning such amendment to the regulations contained in the zoning ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: SECTION 1 That Paragraph 11 "Prohibited uses" of Subsection O "HOME OCCUPATIONS" of Section 5 "GENERAL PROVISIONS" of Chapter 12 "ZONING" of the Code of • Ordinances of the City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: ORDINANCE NO. 6 31 Page 1 • (11) Prohibited uses: The following uses have a tendency to increase the intensity of property use beyond the provisions for home occupations and thereby impair the character of residential areas. Therefore, the uses hereafter specified shall not be permitted as accessory uses or home occupations in residential districts: auto repairs, painting of vehicles or boats, barbershop, beauty shop, private schools, photo studios, dance instruction, television repair, child day care center, wrecker service, commercial woodworking, commercial millwork and/or cabinetry and roofing services. SECTION 2 Saving Clause. That Chapter 12 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 3 Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality • shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
