HomeMy Public PortalAboutOrdinance No. 632-91 04-08-1991 • ORDINANCE NO. 6 3 2 AN ORDINANCE AMENDING Q(S) "DURATION OF SALE" OF SUBSECTION B "GENERAL RESTRICTIONS" OF SECTION 4 "GARAGE AND/OR YARD SALES" OF CHAPTER 4 'BUSINESS REGULATIONS" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, TO CLARIFY REGULATIONS GOVERNING DURATION AND HOURS OF OPERATION OF GARAGE AND/OR YARD SALES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Richland Hills, Texas, finds that certain clarifications are necessary in the ordinances governing the times when garage and/or yard sales may be conducted within the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That 1f (5) "Duration of Sale" of Subsection B "GENERAL RESTRICTIONS" of SECTION 4: "GARAGE AND/OR YARD SALES" of Chapter 4 "BUSINESS • REGULATIONS" of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: "(5) Duration of Sale No such used personal property shall be displayed, offered for sale, or sold before 8:00 a.m. or after. 9:00 p.m. on the days authorized by the permit. Permits issued shall not exceed a period of three (3) consecutive days. Only one (1) permit may be issued at a time. Persons wishing to conduct sales on two consecutive week-ends must obtain a new permit after the first sale is completed." II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. • ORDINANCE NO. 6 3 2 Page 1 • III. Saving Clause. That Chapter 4 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. 1V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
