AN ORDINANCE AMENDING CHAPTER 1, "GENERAL
PROVISIONS" OF THE CODE OF ORDINANCES, CITY OF
RICHLAND HILLS, TEXAS, BY THE ADDITION OF A NEW
SECTION 21: "MUNICIPAL COURT OPERATIONS" TO SAID
CHAPTER 1; PROVIDING FOR THE ADMINISTRATION OF
DAY-TODAY MUNICIPAL COURT OPERATIONS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Home Rule Charter of the City of Richland Hills, Texas, grants
to the City Council the power to establish administrative departments, distribute the
work of divisions and otherwise regulate the affairs of administrative departments
and divisions of the City; and
WHEREAS, said Home Rule Charter also gives the City Council the authority to
generally oversee the operation of the Richland Hills Municipal Court; and
WHEREAS, the City Council finds that the operations of the Richland Hills
Municipal Court can be administered most efficiently by assigning day-to-day
oversight and administrative authority therefor to the City Manager; and
WHEREAS, the City Council hereby desires to delegate to the City Manager the
authority to perform day-to-day oversight and administrative duties concerning the
Richland Hills Municipal Court, while retaining in the City Council the powers stated
in the Richland Hills City Charter to appoint and remove the Clerk of the Richland
Hills Municipal Court.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS:
I.
That Chapter 1, "GENERAL PROVISIONS" of the Code of Ordinances, City of
Richland Hills, Texas, as amended, be hereby amended by the addition of a new
Section 21, "Municipal Court Operations" thereto, which section shall hereafter be
and read as follows:
"Section 21. Municipal Court Operations.
"The City Council hereby delegates to the City Manager
the authority to perform day-today oversight and
administration of the operations of the Richland Hills
Municipal Court. It is the intent of the City Council hereby to
grant to the City Manager full administrative authority over
the operations of the Richland Hills Municipal Court; provided,
however, the Council retains the authority to appoint and
remove the Clerk of the Municipal Court, as provided by the
Richland Hills City Home Rule Charter. The City Manager
• shall prepare and provide to the City Council periodic reports
on the operations of the Richland Hills Municipal Court."

Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 1 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
IV.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
. PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting of
the Richland Hills City Council on the 22nd day of APRIL 1991, by a vote
of ayes, nays, and 0 abstentions.
