HomeMy Public PortalAboutOrdinance No. 639-91 08-27-1991 ORDINANCE NO. 639 • AN ORDINANCE BY THE CITY OF RICHLAND HILLS ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1991, AND ENDING SEPTEMBER 30, 1992, IN ACCORDANCE WITH TEXAS STATUTES, THE CHARTER OF THE CITY OF RICHLAND HILLS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Manager of the City of Richland Hills has submitted a budget proposal to the City Council prior to the beginning of the fiscal year as required by the City Charter; and WHEREAS, said budget proposal sets forth the estimated revenues and expenditures for each fund for the current and proposed fiscal year; and WHEREAS, the City Council finds that all provisions pertaining to the adoption of a budget contained in the City Charter have been compiled with; and WHEREAS, the City Council has held a public hearing on said proposed budget; and WHEREAS, after full consideration, the City Council is of the • opinion that the budget should be approved and adopted: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS, THAT: I. The budget estimate of the Revenues of the City of Richland Hills and the estimate of the Expenses of the Fiscal Year beginning October 1, 1991, and ending September 30, 1992, as directed at the public hearing on August 27, 1991, is hereby adopted. II. The sum of $2,899,705 is hereby appropriated out of the General Fund for the payment of Operating Expenses and Capital Outlays of the City Government, as set forth in detail in the budget. III. The sum of $2,142,430 is hereby appropriated out of the Enterprise Fund for the Operating Expenses, Capital Outlays, and Debt Service of the Water and Sewer Works as set forth in the budget. This includes amounts necessary to provide for a sinking fund for the payment of the principal and interest and the retirement of the enterprise fund debt of the City. • IV. • The sum of $101,387 is hereby appropriated out of the Levee and Floodway Improvements Fund for the Operation, Construction and Maintenance Expenses of drainage channels and related floodway appurtenances as set forth in this budget. V. The sum of $15,000 is hereby appropriated out of the Parks and Beautification Fund for Operating Expenses and Capital Outlays for public parks, recreation and beautification facilities or programs as set forth in this budget. VI. The sum of $818,000 is hereby appropriated out of the Capital Projects Fund for the construction of a new Police Station and the acquisition of a new fire truck as set forth in this budget. VII. That the City Manager is authorized to make line-item and departmental budget adjustments during said fiscal year in order to avoid over expenditures of particular line items. Said adjustments require no further Council action if the total • appropriation for each fund as set forth herein is not exceeded. Expenditures in excess of the herein adopted appropriations for each fund require budget amendments in accordance with the Charter of the City of Richland Hills. VIII. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of the ordinance shall be declared invalid or unconstitutional by the valid judgment of decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation of this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. IX. EFFECTIVE DATE. This ordinance shall be full force and effect from and after its passage and the publication as provided by the Richland Hills City Charter and the laws of the State of Texas; provided, however, that the new municipal budget provided for in • this ordinance shall take effect October 1, 1991.
