AN ORDINANCE AMENDING CHAPTER 11 "UTILITIES" OF THE
CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS
AMENDED, TO ADD A NEW SECTION 12 "STREET SWEEPING
RATES" TO SAID CHAPTER; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Richland Hills, Texas, acting by and through its City
Council, has entered into a contract with BFI for street sweeping services within
the City; and
WHEREAS, the charges for street sweeping under said contract are to be billed
to Richland Hills water and sewer customers monthly as a part of their water utility
bills; and
WHEREAS, a rate of $.75 per month per water customer will allow the City to
pay the charges agreed to under its contract with BFI for sweeping of streets every
other month.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
RICHLAND HILLS, TEXAS:
I.
That Chapter 11 "UTILITIES" of the Code of Ordinances, City of Richland
Hills, Texas, as amended, be hereby amended by the addition of a new SECTION 12:
. "STREET SWEEPING RATES" to said chapter, which new section shall hereafter be
and read as follows:
SECTION 12: STREET SWEEPING RATES
A. STREET SWEEPING RATES ESTABLISHED
From and after February 1, 1992, there shall be imposed on each water
utility customer in the City of Richland Hills a charge of $.75 per month,
plus applicable sales tax, for street sweeping services to be provided
under contract with the City. City streets shall be swept a minimum of
once every other month.
B. BILLING
The street sweeping charges shall be billed on monthly water bills to all
water customers within the City. All applicable sales taxes shall be
added to the base charge and included on said water bill.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
• shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.

Saving Clause. That Chapter 11 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 14 day of JAN 1992, by a vote
of 4 ayes, 0 nays, and 0 abstentions.
