AN ORDINANCE AMENDING SECTION 1: "ANIMAL
SHELTER ADVISORY BOARD" OF CHAPTER 13,
"ADVISORY BOARDS", OF THE CODE OF ORDINANCES,
CITY OF RICHLAND HILLS, TEXAS, AS AMENDED:
PROVIDING FOR APPOINTMENT OF ONLY FIVE MEMBERS
TO SAID BOARD; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVING CLAUSE: AND PROVIDING AN
EFFECTIVE DATE.
Be it ordained by the City Council of the City of Richland Hills, Texas:
I.
That Subsections A and B of SECTION 1: "Animal Shelter Advisory Board" of
CHAPTER 13: "Advisory Boards" of the Code of Ordinances, City of Richland Hills,
Texas, as amended be hereby amended to hereafter be and read as follows:
SECTION 1: ANIlViAL SHELTER ADVLSORY BOARD
A. CREATION: QUALIFICATIONS OF MEMBERS
There is hereby created the Richland Hills Animal Shelter Advisory
Board. Members of the Board shall be registered voters within the City
on the date of their appointment, excepting as follows:
~ The licensed veterinarian and representative of an animal
welfare organization need not be registered voters
residing within the City. Qualified registered voters
residing within the City shall be given preference for
appointment, however.
• The municipal official and person whose duties include
daily operation of an animal shelter need not be
registered voters residing within the City.
No member may serve on more than one other Richland Hills board,
commission or committee. All members shall serve without
compensation. No debts of any kind or character shall be made or
incurred by the Board or by anyone acting in its behalf.
B. COMPOSITION, APPOINTMENTS AND TERMS OF MEMBERS
1. The Animal Shelter Advisory Board shall be composed of 5 members
who shall hold designated places 1 through 5. Each council member shall
be entitled to nominate persons to serve on said Board in the numbered
place corresponding to the numbered place on the City Council held by
said council member. All nominations shall be approved unless rejected
by the affirmative vote of four councilmembers. Members of the Board

shall serve terms of two years, corresponding to the term of the council
member whose place corresponds to the numbered place held by the
• individual member.
2. Place 1 shall be held by a licensed veterinarian, Place 2 shall be
held by a municipal official, Place 3 shall be held by a person whose
duties include daily operation of an animal shelter, and Place 4 shall be
held by a representative of an animal welfare organization. The City
Manager shall recommend persons for appointment to Places 2 and 3,
with the advice of the Chief of Police.
Once assigned a numbered place as provided hereby, the term of
each member of the Board shall be automatically adjusted to correspond
to the term of the councilmember whose numbered place corresponds to
the place of the member.
3. The city staff representative to the Board shall be the Chief of
Police or a designated representative as approved by the City Manager.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
• sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 13 of the Code of Ordinances, City of Richland
Hills, Texas, as amended, shall remain in full force and effect, save and except as
amended by this ordinance.
IV.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Richland Hills City Charter and the
laws of the State of Texas.
PRESENTED, GIVEN FIRST READING AND APPROVED at a regular meeting
of the Richland Hills City Council on the 28 day of JANUARY, 1992, by a vote
of 5 ayes, ~ nays, and ~ abstentions.
