APPROVING CHANGE ORDER #2,
PAYMENT CERTIFICATE NO.3 AND FINAL
PERSHING AVENUE IMPROVEMENTS CONTRACT
WHEREAS, the Governing Body of the Borough of Carteret has previously awarded a contract
to S. Brothers, Inc., in the amount of $969,567.42 for the Pershing Avenue Improvements Project;
and
WHEREAS, the Borough's Consulting Engineer for the project, T &M Associates, has advised
the Governing Body that a modification to the contract is reasonable and necessary and has
recommended that the aforesaid contract be modified in accordance with Change Order #2 and
Final, attached hereto; and
WHEREAS, Change Order #2 and Final includes a change in the description of work to reduce
and/or increase quantities to complete project construction and reflects as -built quantities; and
WHEREAS, Change Order 42 and Final provides for an increase of $44,409.35 to the revised
contract amount resulting in a revised contract price of $1,013,976.77, including all change orders
to date; and
WHEREAS, the Borough's Consulting Engineer, T &M Associates, has advised that the above
described changes and/or modifications to the project were unforeseen at the time of the award of
the original contract. .
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough
of Carteret, County of Middlesex, State of New Jersey as follows:
1. That Change Order #2 and Final, attached hereto and made a part hereof,
providing for an increase of $44,409.35 in the overall, contract price,
resulting in a revised total contract price of $1,013,976.77 including any
modifications to the original contract price in accordance with any and all
previously approved change orders, is hereby approved.
2. That the appropriate Borough officials are hereby authorized and directed to
execute Change Order #2, Payment Certificate #3. and Final (See Attached).
3. That a copy of this Resolution and a fiilly executed copy of Change Order #2,
Payment Certificate #3 & Final be forwarded to the Borough'$ Purchasing
Department and to T &M Associates for distribution to S. Brothers, Inc.

The Change order specifically was for S. Brothers, Inc. with regard
