HomeMy Public PortalAboutOrdinance No. 669-92 06-09-1992 • ORDINANCE NO. 6 6 9 AN ORDINANCE AMENDING SECTION 11 OF CHAPTER 7, "OFFENSES AND NUISANCES" OF THE CODE OF ORDINANCES, CITY OF RICHLAND HILLS, TEXAS, AS ENACTED BY ORDINANCE 589, TO REVISE THE LIBRARY FEES AND CHARGES SET FORTH THEREIN; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RICHLAND HILLS, TEXAS: I. That Section 11 of Chapter 7, "Offenses and Nuisances", of the Code of Ordinances, City of Richland Hills, Texas, as amended, be hereby amended to hereafter be and read as follows: SECTION 11: LIBRARY. A. DETAINING OR DAMAGING LIBRARY BOOKS AND PROPERTY It shall be a misdemeanor to detain or damage books and other property • of the Richland Hills Library, and any person who violates this section shall be subject to a fine as provided in Chapter 1 of this Code. B. LIBRARY FINES. FEES AND CHARGES (1) Copy Machine - - - - - - - - - $ .15 per copy (2) Lost/Replacement Cards - - - 1.00 for the first replacement card issued; 2.00 for the second; 3.00 for the third; 4.00 for the fourth, and in like manner, without maximum, one additional dollar for each additional replacement card issued. (3) Courtesy Cards - - - - - - - - 1.00 each time (4) Fines -Books, a.v., etc. - - - - .15 per day per item: a. to a maximum of $2.00 on puzzles, paperback books, • periodicals, etc. b. to a maximum of $5.00 on hardback books and audio materials. ORDINANCE NO. 6 6 9 PAGE 1 • (5) Fines -Video cassette tapes -per day per item to a maximum of 10.00 on vide cassette tapes. - - - - - 1.00 (6) Fines - Porta-video players -per day per item-no maximum applicable 5.00 (7) Lost/damaged materials: a. Paperback books, vertical file, periodicals, etc., cost of item + $3.00 service fee b. Hardback books, video cassette tapes, audio materials, etc., cost of item + 5.00 service fee (8) Meeting Room (as available) a. Non-profit organization - - - - - 15.00 up to 4 hours, plus $5.00/hr. thereafter b. (related equipment use) - - - - - 5.00 c. Refundable deposit - - - - - - 25.00 (all organizations) d. Profit Organization - - - - - - 40.00 • e. (related equipment use) - - - - - - 5.00 Available during normal business hours No food/no drinks/no smoking No charge for City Departments or City-related business (i.e. Board meetings, etc.) II. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. III. Saving Clause. That Chapter 7 of the Code of Ordinances, City of Richland Hills, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. • ORDINANCE NO. 6 6 9 PAGE 2 • IV. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Richland Hills City Charter and the laws of the State of Texas.
